ISSUING REGULATIONS ON SANITARY CONTROL DURING THE HARVEST OF BIVALVE MOLLUSKS

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
WHEREAS, Decree No. 79/2008/ND-CP dated July 18, 2008 of the Government stipulates the organizational system for management, inspection, and testing related to food safety;
WHEREAS, the Fisheries Law dated November 26, 2003;
WHEREAS, the Law on Product and Commodities Quality dated November 20, 2007;
WHEREAS, the Food Safety Ordinance dated July 26, 2003, and Decree No. 163/2004/ND-CP dated September 7, 2004 of the Government detailing the implementation of certain provisions of the Food Safety Ordinance;;
AT THE REQUEST OF THE DIRECTOR OF THE DEPARTMENT OF QUALITY MANAGEMENT OF AGRICULTURAL AND FORESTRY PRODUCTS AND FISHERIES,
DECISION:
Article 1. ATTACHED TO THIS DECISION ARE THE REGULATIONS ON SANITARY CONTROL DURING THE HARVEST OF BIVALVE MOLLUSKS.
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF PUBLICATION IN THE OFFICIAL GAZETTE. THIS DECISION REPLACES Decision No. 640/1999/QD-BTS dated September 22, 1999 on the issuance of the Regulations on Sanitary Control During the Harvest of Bivalve Mollusks and Decision No. 863/1999/QD-BTS dated November 30, 1999 on the amendment of the Regulations on Sanitary Control During the Harvest of Bivalve Mollusks issued by the Minister of Fisheries.
Article 3. THE HEAD OF THE MINISTRY'S OFFICE, THE DIRECTOR OF THE DEPARTMENT OF QUALITY MANAGEMENT OF AGRICULTURAL AND FORESTRY PRODUCTS AND FISHERIES, THE HEADS OF MINISTRY AFFILIATED UNITS, AND THE DIRECTORS OF PROVINCE DEPARTMENTS OF AGRICULTURE AND RURAL DEVELOPMENT UNDER THE DIRECT CONTROL OF THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR IMPLEMENTING THIS DECISION./.
