Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government stipulating the application of information technology in state agencies;

Considering the proposal of the Director of the Information Center and the Head of the Organization and Cadres Department,

DECISION:

Article 1. This Decision promulgates the "Provision on functions, tasks, powers, and organization and operation of the Information Center" attached hereto.

Article 2. This Decision takes effect from the date of issuance and replaces Decision No. 1593/2008/QĐ-TTCP dated August 6, 2008 of the General Inspector regarding the issuance of regulations on functions, tasks, powers, and organization and operation of the Information Center.

Article 3. The Heads of the Office, the Head of the Organization and Cadres Department, the Director of the Information Center, the Heads of departments, bureaus, and units under the Government Inspectorate shall be responsible for implementing this Decision.

FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE INFORMATION CENTER

PART I

FUNCTIONS, TASKS, AUTHORITIES, AND WORKING PRINCIPLES

Article 1. Position and Functions

The Information Center is a specialized unit under the Government Inspectorate responsible for building, developing, and organizing the implementation of the application of information technology to serve management, direction, and operational activities of the Government Inspectorate and the inspection sector; exploiting, storing, providing, and synthesizing information according to the directives of the General Inspector.

The Information Center has its own seal; its main office is located in Hanoi.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Proposing, building, and organizing the implementation of five-year plans and annual plans and other programs and plans concerning the application and development of information technology to serve management, direction, and operational activities of the Government Inspectorate and the inspection sector.

2. Building and submitting to the General Inspector for issuance regulations and rules on the organization and operation of the application of information technology, management of information systems, exploitation and use of common software, ensuring the safety and security of information systems and electronic information databases of the Government Inspectorate.

3. Collecting, processing, storing, exploiting, providing, and synthesizing electronic information to serve the direction and management of the leadership of the Government Inspectorate; building and managing electronic information databases on areas within the scope of state management of the Government Inspectorate.

4. Managing, operating, and guiding the use of technical infrastructure for information technology to serve the direction, management, and operational activities of the Government Inspectorate and the inspection sector; implementing the design, construction, and installation of IT equipment systems according to approved plans for units under the Government Inspectorate.

5. Managing internal networks and wide area networks of the Government Inspectorate; serving as the connection point for the government's information network, ministries, localities, and related agencies.

6. Building and maintaining the operation of the Government Inspectorate’s electronic information portal; updating information on the portal according to the provisions of the General Inspector.

7. Organizing the design, construction (self-design, hire, purchase), and guidance on the use of specialized application software in the fields of state management of the Government Inspectorate.

8. Organizing the maintenance and repair of computer systems and information network equipment of the Government Inspectorate; repairing and resolving technical issues of network equipment systems to ensure continuous, smooth, safe, and secure operation of the system.

9. Cooperating with the Organization and Cadres Department, the Inspection Cadre School, and related units to organize training and capacity building in information technology and computing for cadres, civil servants, and employees under the Government Inspectorate and the inspection sector.

10. Implementing administrative reform and international cooperation in information technology according to the assignment of the General Inspector.

11. Managing cadres, civil servants, and employees of the Information Center according to the law and the delegation of the General Inspector.

12. Managing and using assets and finances allocated according to the provisions of the General Inspector and other laws.

13. Performing other tasks assigned by the General Inspector.

Article 3. Principles of Operation

The Information Center operates under a directorship system, ensuring the principles of centralized democracy, transparency, and openness in accordance with the law; emphasizing individual responsibility and discipline, promoting the capabilities, strengths, initiative, and creativity of cadres and employees, and enhancing the effectiveness of the center's operations.

Chapter II

ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING

Article 4. Organizational Structure and Staffing

1. Leadership of the Information Center includes the Director and Deputy Directors.

2. Subordinate organizations of the Information Center include:

a) Technical Department;

b) Information Publishing Department.

Specific tasks and powers of the departments under the Information Center are defined by the Director based on the assigned functions and tasks.

3. The staffing of the Information Center is decided by the General Inspector based on the proposal of the Director of the Information Center and the Head of the Organization and Cadres Department.

1. Represents the Project Management Board legally, bears responsibility before the law and before the Government Inspector General for the results of assigned tasks.

1. Leading, directing, and organizing the implementation of the tasks of the Information Center as stipulated in Article 2 of this Regulation; being responsible before the law and the leadership of the Government Inspectorate for the results of the Information Center's tasks.

2. Directly directing the advisory work to assist the leadership of the Government Inspectorate in building programs, plans, regulations, and rules on the application of information technology.

3. Organizing and directing the implementation of the work plans of the Information Center. Participating in directing cooperative work with other state agencies in the construction and implementation of inter-sectoral information technology applications when assigned by the General Inspector.

4. Assigning tasks, coordinating activities, and supervising the implementation of tasks by Deputy Directors and staff members of the Information Center. Maintaining work discipline, managing, evaluating, and implementing commendation and reward activities for staff members; building and implementing cadre planning and training plans for the Information Center.

5. Cooperate with the heads of units under the Government Inspectorate to handle issues related to the functions and tasks of the Information Center and to perform the common tasks of the agency as prescribed in the Working Regulations of the Government Inspectorate.

6. Be responsible for managing and using the seal of the Information Center.

7. Implement information and reporting systems in accordance with the law and regulations of the Government Inspectorate.

8. Perform other tasks assigned by the Chief Inspector.

1. Assists the Director in managing and overseeing the Project Management Board's operations; directly manages certain areas of work as delegated by the Director. Bears responsibility before the Director, Inspector General leadership, and the law for the results of assigned tasks.

1. Assist the Director in managing and directing the work of the Information Center; directly manage certain areas of work as delegated by the Director of the Information Center.

2. Carry out duties and powers within the scope delegated and authorized by the Director. Report to the Director on the situation and results of the tasks delegated and authorized.

3. Personally bear responsibility before the Director, leadership of the Government Inspectorate, and the law regarding proposals, progress, quality, effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

4. Sign on behalf of the Director for documents authorized by the Director.

Article 7. Responsibilities and Scope of Work of Staff Members of the Information Center

1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Information Center.

2. Proactively study and advise on the specialized fields assigned; resolve assigned tasks according to prescribed procedures, deadlines. Timely report to the direct supervisor when encountering difficulties or new issues during task execution.

3. Adhere to speaking discipline, Conduct Code of Inspectors and Civil Servants, Working Rules, Office Culture Regulations of the Government Inspectorate, and other regulations concerning staff members; implement reporting systems and file management as stipulated by the Government Inspectorate.

4. Personally bear responsibility before the leadership of the Information Center, leadership of the Government Inspectorate, and the law regarding proposals, progress, quality, effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

Chapter III

WORK RELATIONSHIPS

Article 8. Implementation of Leadership Directives

The Information Center is subject to leadership and directives from the Chief Inspector and Deputy Chief Inspectors; it must strictly fulfill assigned tasks, promptly report to the leadership of the Government Inspectorate on the results of task implementation as prescribed; when necessary, propose recommendations to the leadership of the Government Inspectorate on issues that need resolution during task execution.

Article 9. Relations with Departments, Bureaus, and Units under the Government Inspectorate

1. Relations between the Information Center and departments, bureaus, and units under the Government Inspectorate are cooperative, exchange, and mutual support relations to complete tasks.

2. Cooperation with departments, bureaus, and units during task execution shall be carried out in accordance with the Working Regulations of the Government Inspectorate.

Article 10. Relations with the Ministry of Information and Communications and other competent authorities

The Information Center shall be responsible for assisting the Inspector General in establishing and protecting programs and plans for the application and development of information technology and administrative management informatization, implementing information and reporting systems to the Ministry of Information and Communications and other competent authorities as prescribed by law.

Article 11. Relations with Party Committees and mass organizations

1. The leadership of the Information Center shall create conditions for the Party organization and mass organizations to operate according to their charters, purposes, and objectives; coordinate with the Party Committee and mass organization leaders to create conditions for Information Center Party members, officials, and staff to study and improve their political, professional, and vocational competence, work effectively; ensure the implementation of democratic regulations at the grassroots level in the activities of the Information Center, build cultural and disciplinary norms within the agency.

2. The leadership of the Information Center shall be responsible for providing timely and comprehensive information about the activities of the Information Center and the rights of its officials and staff to the Party Committee and mass organization leaders; seek the opinions of the Party Committee and mass organization leaders before making decisions on organizational and personnel matters of the Information Center, measures for joint leadership in political education, internal protection, consolidation of unity, and care for the living standards of officials and staff within the Information Center.

Chapter IV

IMPLEMENTATION

Article 12. Responsibility for Implementation

1. The Director, Deputy Directors, and all officials, staff, and contractual workers of the Information Center shall be responsible for implementing this Regulation.

2. Matters related to the functions, tasks, powers, and organization and operation of the Information Center that are not covered in this Regulation shall be implemented in accordance with the Working Regulations of the Government Inspectorate and current laws and legal documents.

3. Based on current regulations and this Regulation, the Director of the Information Center shall be responsible for developing the unit's Working Regulations to fulfill assigned functions and tasks.

Article 13. Amendment and Supplement to the Regulation

The Director of the Information Center and the Head of the Cadre and Civil Servant Organization Department shall be responsible for monitoring, inspecting, and urging the implementation of this Regulation; compiling feedback opinions and promptly researching proposals for supplementing and amending the Regulation in accordance with the operational requirements of the Information Center and the Government Inspectorate./.
