Pursuant to the Law on Cadres and Civil Servants No. 22/2008/QH12 dated November 13, 2008;
Pursuant to Regulation No. 89-QD/TW dated August 4, 2017 of the Politburo on the Framework for Position Standards and Guidelines for Criteria for Evaluating Cadres at All Levels;
Pursuant to Regulation No. 105-QD/TW dated December 19, 2017 of the Politburo on Delegation of Authority in Cadre Management and Nomination for Candidacy;
Pursuant to Decree No. 24/2010/ND-CP dated March 15, 2010 of the Government on Recruitment, Employment, and Management of Civil Servants;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 538/QD-BTC dated March 24, 2017 of the Minister of Finance on Delegation of Authority in Civil Servant and Public Official Management at Units under and Subordinate to the Ministry of Finance;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1.
This Decision promulgates standards for leadership titles at the General Department level and equivalents under the Ministry of Finance.
Article 2.
This Decision replaces Decision No. 2159/QD-BTC dated September 9, 2009 of the Minister of Finance on the Issuance of Standards for Leadership Titles at the General Department Level and Equivalents Under the Ministry of Finance.
Article 3.
This Decision takes effect from the date of signature. The Director of the Office of the Ministry of Finance, Heads of the Cadre Organization Department, and Heads of units and organizations are responsible for implementing this Decision.

REGULATIONS
STANDARDS FOR LEADERSHIP TITLES AT THE GENERAL DEPARTMENT LEVEL AND EQUIVALENTS UNDER THE MINISTRY OF FINANCE

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
General Departments under the Ministry of Finance include the General Department of Taxation, the General Department of Customs, the State General Reserve Corporation, the National Treasury, and the Securities Commission (hereinafter referred to collectively as General Departments).
Leadership positions at the General Department level and equivalents within the authority of the Minister of Finance include:
1. Director of the General Department of Taxation, Director of the General Department of Customs, Director of the State General Reserve Corporation, General Director of the National Treasury, Chairman of the Securities Commission (hereinafter referred to collectively as Directors).
2. Deputy Director of the General Department of Taxation, Deputy Director of the General Department of Customs, Deputy Director of the State General Reserve Corporation, Deputy General Director of the National Treasury, Deputy Chairman of the Securities Commission (hereinafter referred to collectively as Deputy Directors).
Article 2. Purpose of the standards:
1. To serve as a basis for the appointment, reappointment, transfer, removal, and evaluation of cadres in leadership positions at the General Department level.
2. To provide a foundation for developing training programs and plans to cultivate a cadre pool for leadership positions at the General Department level.
Article 3. Common Standards
1. Political Ideological Standards:
a. Loyalty to the interests of the Party, the nation, and the people; firm commitment to Marxism-Leninism and Ho Chi Minh Thought, the ideals of national independence, socialism, and the Party's policies. Possessing a strong political stance, viewpoint, and resolve to defend the Party's Program, the Constitution, and state laws. Prioritizing the interests of the Party, the nation, and the people over personal interests. Strictly adhering to organizational assignments and completing all tasks assigned.
b. Must be concluded by competent authorities to meet political standards for appointment according to regulations set by the Politburo and the Central Committee regarding internal political protection.
2. Moral and Lifestyle Standards: Possessing a clear moral character, honest, modest, sincere, simple lifestyle; being thrifty, honest, impartial, and dedicated. Not engaging in corruption, bureaucracy, opportunism, or self-interest; firmly opposing bureaucracy, favoritism, corruption, waste, individualism, opportunistic lifestyles, factionalism, group interests, and inconsistency between words and actions; being fair, upright, and valuing talent. Leading by example in implementing the Party's policies and state laws, not abusing power or allowing relatives to misuse power for personal gain; fostering unity, maintaining internal solidarity, building a strong collective, loving comrades and colleagues.
3. Organizational Discipline Standards: Adhering strictly to and implementing the principles of organizational discipline of the Party, especially the principle of democratic centralism, self-criticism, and criticism; having a high sense of responsibility and organizational discipline; strictly following the rules of the agency, conduct guidelines, professional ethics, and administrative service.
4. Knowledge and Understanding Standards:
a. Being aware and capable of studying and understanding the political, economic, cultural, social, security, defense, and foreign relations situation of the state; grasping the relationships within the political system's work; possessing knowledge of leadership science and management;
b. Having basic professional and vocational training, practical knowledge about the industry or field.
5. Competence and Reputation Standards:
a. Possessing innovative thinking, vision, development orientation, scientific working methods; having the ability to synthesize, analyze, and forecast. Capable of identifying new, difficult issues, and limitations or inadequacies in practice; being resolute in executing tasks, proposing feasible and effective solutions to promote or resolve emerging issues. Having practical capabilities, understanding the basic situation to advise competent authorities to effectively implement and organize the implementation of the Party's policies and state laws in the assigned sector or area. Having leadership and directive abilities to build and organize the implementation of industry development strategies, effectively organizing scientific research activities serving state administration; formulating strategic policies for the industry or field; properly implementing democratic principles, conduct guidelines, and professional ethics for civil servants working in subordinate agencies of the Ministry of Finance; being dynamic, creative, daring to think, act, and take responsibility.
b. Possesses the ability to unite, gather, and mobilize collective and individual strength, trusted and supported by cadres, party members, and the people; organizes coordination with relevant agencies, organizations, and individuals to effectively perform assigned tasks;
c. Has been evaluated and classified as having satisfactorily completed tasks or better for the last three years up to the time of consideration for appointment;
6. Health and age criteria: Must have sufficient health to perform assigned tasks, ensuring that the age at the time of appointment is at least sufficient for one term (five years) as stipulated. In special cases, this will be reviewed and decided by the competent authority;
7. Planning criteria: A civil servant being appointed for the first time must be planned for the position of General Director of the Department or an equivalent leadership position within the Department anticipated to be appointed;
Chapter II
SPECIFIC CRITERIA
Article 4. Criteria for the position of General Director
1. Position and responsibilities: The position of General Director is a leadership and management post under the Ministry of Finance and is the head of the Department, responsible for assisting the Minister of Finance in state management and enforcement of specialized laws and regulations throughout the country according to the division of labor, delegation, and authorization by the Minister of Finance; accountable to the Minister and the law for all activities of the Department;
2. Tasks:
a. Leads and directs all levels of units within the Department in organizing and implementing the functions and tasks of the Department as prescribed by law;
b. Organizes the assignment of duties among Deputy General Directors; determines working mechanisms and cooperation relationships between Department leaders to ensure effective completion of assigned tasks;
c. Proposes policies and measures to the Ministry of Finance and competent state agencies to effectively implement tasks within the Department's jurisdiction;
d. Takes the lead in coordinating with functional agencies to handle and resolve issues arising in management work, maintaining regular working relations with units under the Ministry of Finance, local Party committees, and governments during the performance of assigned tasks;
e. Manages civil servants, public officials, employees, and assets of the Department in accordance with the law and the delegation of the Minister of Finance;
f. Performs other tasks as delegated by the Minister of Finance;
3. Leadership and management experience criteria: Must have worked in the finance sector for a minimum of seven years, including a minimum of five years in the specialized field assigned (except for cases where cadres are transferred from other places according to the policy of the competent authority); must have held the position of Deputy General Director or equivalent leadership positions within the Ministry for a minimum of three years;
4. Professional qualifications criteria
a. Graduated from a full-time university program or holds a master’s or doctoral degree in a relevant field corresponding to the assigned specialized area. For cases where degrees are obtained from foreign institutions, they must be recognized by the competent state agency as prescribed;
b. Currently holding the rank of Senior Specialist or equivalent, or a corresponding professional title;
c. Holds a high-level political theory certificate or equivalent; a State Management Certificate for Senior Specialists;
d. Other training certificates required by the Party and State for the appointed leadership position must be completed within five years from the date of the appointment decision.
Article 5. Criteria for the Deputy Director-General Position
1. Position and Responsibilities: The Deputy Director-General position is a leadership and management post under the Ministry, subordinate to the Director-General, assisting the Director-General in overseeing, directing, and managing one or more areas of work within the General Department's functions and tasks as assigned by the Director-General; being responsible before the Director-General and the law for the duties and tasks entrusted.
2. Tasks:
a. Organizing the implementation of specialized and professional tasks as assigned or delegated by the Director-General;
b. Directing, inspecting, and urging units under and directly subordinate to the General Department to fulfill their assigned tasks;
c. Coordinating with other Deputy Directors-General during the process of handling work, managing civil servants, officials, employees, and assets of the General Department;
d. Advising the Director-General on policies and measures for state management related to the assigned area and other areas under the General Department's jurisdiction;
e. Reporting and proposing solutions to the Director-General for issues arising and beyond the authority to resolve in the assigned area;
f. Performing other tasks as assigned by the Director-General.
3. Leadership and Management Experience Standards: Having at least seven years of work experience in the Finance sector, including at least five years in the assigned professional field (except for cases where cadres are transferred from other places according to the policy of the competent authority); having at least two years of experience holding the position of Department Head or equivalent within the General Department or leading a Department or equivalent within the Ministry.
4. Professional qualifications criteria
a. Graduating from a regular university program or obtaining a master’s or doctoral degree in a relevant field corresponding to the assigned professional field. For cases where degrees are obtained from foreign institutions, they must be recognized by the competent state agency as prescribed.
b. Currently holding the rank of Senior Specialist or equivalent, or a corresponding professional title;
c. Holds a high-level political theory certificate or equivalent; a State Management Certificate for Senior Specialists;
d. Other training certificates required by the Party and State for the appointed leadership position must be completed within five years from the date of the appointment decision.
Chapter III
IMPLEMENTATION
Article 6. Transitional Provisions:
1. In cases where individuals have been appointed to the positions of Director-General or Deputy Director-General prior to this Decision taking effect, if they lack the criteria stipulated in this Decision, the heads of units shall require such individuals to complete the missing criteria within five years (60 months) from the date this Decision takes effect; if the leadership position criteria are not met by the end of the five-year period, reappointment will not be allowed.
2. Before the five-year period from the date this Decision takes effect, if the criteria for reappointment to leadership positions have not been completed by the time of reappointment, reappointment may still occur. By the end of the five-year period from the date this Decision takes effect, those who have been reappointed but have not yet completed the leadership position criteria will be relieved of their positions due to non-compliance with the conditions and criteria as prescribed.
3. In cases where individuals are transferred or appointed by the competent authority without meeting the conditions and criteria stipulated in this Decision, they must complete the missing criteria within five years from the date of the transfer or appointment decision; if the leadership position criteria are not met by the end of the five-year period, reappointment will not be allowed.
Article 7. Responsibility for Implementation
1. Responsibilities of the Cadre Organization Department:
a. Guiding General Departments to implement reviews of senior civil servants appointed before the effective date of this Decision;
b. Announcing plans for training classes and grade promotion exams for unit heads to arrange participation by General Department leaders;
c. Advising and reporting to the Ministry's Leadership and the Party Committee of the Ministry of Finance to decide on the appointment of individuals meeting the prescribed conditions and qualifications.
2. Responsibilities of the Director-General:
a. Conducting reviews of General Department leaders appointed before the effective date of this Decision to compile and report to the Ministry;
b. Developing plans and organizing training and development for cadres within the planning scope to create sources of General Department leaders;
c. General Department leaders are responsible for participating in training and development courses and grade promotion exams to meet the required qualifications, certificates, and grades as stipulated in this Decision.
d. Establishing criteria for leadership positions at the department and branch level and equivalents within the General Department and local bureaus.
3. During the implementation of these criteria, if any issues arise or difficulties are encountered, General Departments are requested to report them to the Ministry (through the Cadre Organization Department) for compilation and reporting to the Minister for consideration and decision.
