Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State-Owned Enterprises dated November 26, 2003;
Pursuant to Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises and independent accounting subsidiaries of state-owned corporations;
Considering the proposal of the People's Committee of Phú Yên Province.

Article 1. Approves the adjustment of the Plan for restructuring and modernizing certain state-owned enterprises directly under the People's Committee of Phú Yên Province as follows:
1. Convert the following companies into limited liability companies with one member (to be implemented in 2006):
- Dong Cam Irrigation Company;
- Phu Yen General Supplies Company;
- Phu Yen Investment and Industrial Zone Development Company.
2. Privatize, with the State retaining a low percentage of shares or no shares at all (to be implemented in 2006):
Phu Yen Sea Transport Company (after transferring Vung Ro Port to the Phú Yên Provincial Department of Transportation Management).
Article 2. The Chairman of the People's Committee of Phú Yên Province directs the implementation of the restructuring and modernization of state-owned enterprises directly under its jurisdiction according to the approved content and schedule. Any adjustments or supplements must be approved by the Prime Minister.
Article 3. The Ministries of Finance, Planning and Investment, Labor, Invalids and Social Affairs, and related agencies shall cooperate with the People's Committee of Phú Yên Province in implementing the aforementioned Plan.
Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette.
The Chairman of the People's Committee of Phú Yên Province and heads of relevant agencies are responsible for enforcing this Decision.
