Guidelines for the management, allocation, and settlement of budget expenses for the comprehensive land inventory and construction of current land use maps up to the year 2000.

Pursuant to Article 35 of the Law Amending and Supplementing Certain Provisions of the Land Law 1998;

Pursuant to Directive No. 24/1999/CT-TTg dated August 18, 1999 of the Prime Minister on the comprehensive land inventory in 2000;

Pursuant to Circular Joint No. 113/1999/TTLT-BTC-TCĐC dated September 23, 1999 of the Ministry of Finance - General Department of Land Administration guiding the division of authority, management, allocation, and settlement of budget expenses for land survey mapping and land administration;

The Ministry of Finance and the General Department of Land Administration guide the management, allocation, and settlement of budget expenses for the comprehensive land inventory and construction of current land use maps up to the year 2000 as follows:

I. GENERAL PROVISIONS

1. This circular guides the management, allocation, and settlement of budget expenses for implementing the comprehensive land inventory and construction of current land use maps up to the year 2000.

2. The budget expenses for implementing the comprehensive land inventory and construction of current land use maps up to the year 2000, which are carried out by the General Department of Land Administration, shall be guaranteed by the central government budget.

The budget expenses for implementing the comprehensive land inventory and construction of current land use maps up to the year 2000 at localities shall be guaranteed by the local government budget.

II. SPECIFIC PROVISIONS

1. Content of expenditure.

a. Content of expenditure from the central government budget:

- Developing the plan for the comprehensive land inventory and construction of current land use maps up to the year 2000 nationwide.

- Drafting, printing, and issuing documents and forms serving training and guidance for inventory.

- Providing aerial photographs and remote sensing images.

- Programming statistical software for data compilation and aggregation.

- Information dissemination and publicity.

- Training staff at provincial level on land inventory and construction of current land use maps up to the year 2000.

- Directing and supervising the implementation of land inventory and construction of current land use maps up to the year 2000 in localities.

- Aggregating and processing land inventory data and construction of current land use maps up to the year 2000 nationwide.

- Printing materials for land inventory and current land use maps up to the year 2000 nationwide to report to the Government and submit for archival storage according to regulations.

b. Content of expenditure from the provincial and centrally-administered city budgets:

- Developing plans and programs for implementation within their respective jurisdictions.

- Conducting specialized training and disseminating policies for the comprehensive land inventory at the local level.

- Printing forms, materials, and maps serving inventory and construction of current land use maps. (In cases where localities lack the capability to print base maps for inventory work, they should contact the General Department of Land Administration for provision; all costs for providing base maps shall be borne by the locality).

- Organizing field surveys and investigations.

- Supervising and directing implementation.

- Aggregating and processing land inventory data and construction of current land use maps up to the year 2000.

- Printing materials for land inventory and current land use maps up to the year 2000 within the locality to submit to various levels of People's Committees; reporting to higher-level land administration authorities and submitting for archival storage.

Based on the guidance materials for inventory and creation of current land use maps provided by the General Department of Land Administration, localities shall define specific tasks for each level of budget.

2. Expenditure rates.

- Expenses related to travel allowances, conference fees, overtime pay, etc., shall be in accordance with current regulations.

- Printing of forms, materials, and maps shall be calculated based on offset printing or photocopying costs at local prices. Office supplies shall be priced according to market conditions at the time of implementation.

- Payments for contractual labor wages shall be based on the general labor wage rate in the locality as stipulated by the Provincial Department of Finance and Price Control and the Provincial Department of Labor, Invalids, and Social Affairs.

All expenditures must be supported by valid receipts in accordance with current regulations.

3. Preparation and adherence to the budget for land inventory.

The preparation and adherence to the budget for the comprehensive land inventory and construction of current land use maps up to the year 2000 shall be carried out in accordance with Circular No. 103/1998/TT-BTC dated July 18, 1998 of the Ministry of Finance on "Guidelines for Division of Authority, Preparation, Adherence, and Settlement of State Budget" and other current regulations of the State.

The General Department of Land Administration, based on the volume of inventory work, the expenditure items specified in this circular, and the current financial expenditure system, shall prepare a budget for the comprehensive land inventory and construction of current land use maps (for the portion of work carried out by the General Department of Land Administration) and send it to the Ministry of Finance.

Local land administration agencies shall, based on the methods, organizational forms, and technical solutions suitable to local realities as guided by the General Department of Land Administration, determine the volume of work, expenditure items, and the current financial expenditure system to prepare a budget for the comprehensive land inventory and construction of current land use maps and submit it to the local finance agency for inclusion in the local budget according to regulations.

Allocation of budget expenses:

Basis for allocation:

- Announced annual budget estimates;

- Detailed budget approved by the competent authority;

- Progress of work implementation;

The State Treasury shall, based on the budget estimates announced by the finance agency, the progress of inventory work, the payment order issued by the head of the unit, and valid expenditure receipts, allocate provisional payments or settle accounts with units in accordance with Circular No. 40/1998/TT-BTC dated March 31, 1998 of the Ministry of Finance on "Guidelines for Management, Allocation, and Settlement of State Budget Expenditures through the State Treasury."

4. Management, inspection, and settlement of budget expenses.:

Financial agencies at all levels shall be responsible for organizing inspections to ensure that budget expenses for the comprehensive land inventory and construction of current land use maps are used for their intended purposes and in compliance with current financial expenditure standards.

Upon completion of the comprehensive land inventory, land administration agencies at all levels shall be responsible for summarizing and settling the budget expenses used and submitting them to the same-level finance agency; finance agencies at all levels shall be responsible for reviewing and approving the settlement in accordance with current regulations.

III. IMPLEMENTATION PROVISIONS

This Circular takes effect fifteen days from the date of signature and shall apply only to the General Land Inventory and the creation of land use status maps up to the year 2000.

During implementation, any difficulties should be reported to the Ministry of Finance and the General Department of Land Administration for resolution.
