Regulations on the tasks, powers, and organizational structure of the Insurance Department

 THE MINISTER OF FINANCE

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Based on Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Upon the proposal of the Director of the Insurance Department, the Director of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1: The Insurance Department is a unit within the State management machinery of the Ministry of Finance, with the function of assisting the Minister of Finance in uniformly managing the State's affairs concerning insurance business throughout the country.

Article 2: The Insurance Department has the following tasks:

1. Submit to the Minister of Finance strategies, plans, and long-term, five-year, and annual programs, projects, and draft regulatory legal documents in the field of insurance business; participate in building the national financial strategy.

2. Organize the implementation and guide, inspect the execution of strategies, plans, and regulatory legal documents on insurance business after approval; coordinate with the Legal Affairs Department and the Ministry’s Office to organize information dissemination, promotion, and popularization of laws on insurance business.

3. Submit to the Minister of Finance for issuance, approval, and confirmation of completion of registration procedures for insurance rules, terms, and premium rates; guide the implementation of insurance rules, terms, premium rates, and commissions.

4. Submit to the Minister of Finance necessary measures to be applied to ensure that insurance companies meet financial requirements and fulfill commitments to policyholders.

5. Receive and examine applications for issuing, amending, supplementing, and revoking licenses for establishment and operation of domestic insurance companies and insurance brokerage firms; organize requests for opinions from relevant units and organizations under the Ministry, submit to the Minister for decision in accordance with legal regulations.

6. Examine and submit to the Minister of Finance for issuance, amendment, supplementation, and revocation of representative office licenses of foreign insurance companies and foreign insurance brokerage firms in Vietnam.

7. Inspect and supervise the operations of domestic insurance companies and insurance brokerage firms, representative offices of foreign insurance companies and foreign insurance brokerage firms in Vietnam according to legal provisions.

8. Study and propose opinions for the Minister of Finance to request competent state agencies to allow domestic insurance companies and insurance brokerage firms to operate abroad.

9. Propose and implement tasks related to international cooperation and integration in the field of insurance business according to the division of labor of the Ministry.

10. Assist the Minister of Finance in performing tasks and representing the state ownership interest in capital at insurance companies managed by the Ministry of Finance in accordance with legal regulations.

11. Assist the Ministry in managing the activities of associations and non-governmental organizations operating in the field of insurance business.

12. Organize statistical work, analyze and forecast the situation of the Vietnamese insurance market; implement reporting systems as prescribed by the Ministry.

13. Coordinate with the Ministry Inspectorate in developing and implementing inspection plans for insurance business operations; handle complaints, denunciations, and administrative violations in the field of insurance business.

14. Organize scientific research or cooperate in scientific research with units inside and outside the industry according to approved plans and topics.

15. The Director of the Insurance Department has the right:

- To request relevant agencies and units to provide necessary documents and texts for the implementation of assigned tasks.

- To sign guiding documents, explanatory letters, and responses to issues arising from the implementation of regulatory legal documents in the field of insurance business; sign documents registering insurance products, approving training programs for insurance agents, announcing insurance products, etc., as proposed by agencies, organizations, or individuals according to the division of labor of the Ministry.

- To sign notifications approving additional registered capital for subordinate insurance companies according to approved plans.

Article 3: The Insurance Department has a Director and several Deputy Directors.

The Director of the Insurance Department is responsible for comprehensively managing civil servants of the Department in accordance with the Ministry's regulations; organize training and capacity enhancement for civil servants; bear responsibility before the Minister of Finance for the implementation of assigned tasks.

Deputy Directors of the Insurance Department are responsible to the Director for assigned tasks.

The Insurance Department operates under a specialist system.

The Director of the Insurance Department is responsible for organizing work, arranging, scheduling, and assigning tasks to each civil servant in accordance with their position standards, capabilities, and specialized training to complete assigned tasks.

The staffing of the Insurance Department is decided by the Minister of Finance.

Article 4: This Decision takes effect from the date of signature.

The Director of the Insurance Department, the Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry of Finance’s Office, and the heads of units and organizations under the Ministry are responsible for implementing this decision./.
