THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Education Law dated June 14, 2005;

Considering the proposal of the Minister of Education and Training,

DECREE:

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the objects, criteria for enjoying the recruitment system, the organization and implementation of the recruitment system, and the reimbursement of scholarships and training costs for those recruited to universities, colleges, vocational colleges, and intermediate specialized colleges.

Article 2. Recruitment System

1. Recruitment without examination is the process of admitting students to universities, colleges, and intermediate levels to train civil servants, public officials, and employees for regions with particularly difficult socio-economic conditions and ethnic minorities that have few or no cadres with university, college, or intermediate qualifications.

2. The recruitment system prescribed in this Decree includes: admissions; organization and training funding; job assignment for those sent to study after graduation; reimbursement of scholarships and training costs for those who do not comply with job assignments after graduation under the recruitment system.

Article 3. Principles of Recruitment

Implementing the recruitment system must ensure the following principles:

1. Correct purpose, object, and criteria as prescribed.

2. Objective, fair, transparent, and open.

3. The agency sending people to study under the recruitment system has the responsibility to accept and assign jobs to those sent to study after graduation.

Article 4. Rights and Obligations of Students Under the Recruitment System

1. Students under the quota system have the following rights:

a) To be provided with full information about the quota system;

b) To receive scholarships, exemption from tuition fees, and other preferential benefits as prescribed by the State during their training period;

c) To be accepted and assigned work after graduation.

2. Students under the quota system have the following obligations:

a) Commit before being recruited and comply with the commitment made to the sending agency regarding job assignment after graduation;

b) Comply with laws and internal regulations of educational institutions; complete the training program assigned by the sending agency;

c) Must reimburse scholarships and training costs according to the provisions of Article 13 of this Decree if they fall into one of the cases specified in Article 12 of this Decree.

Chapter II
OBJECTS, CRITERIA, SELECTION ORGANIZATION,
TRAINING ORGANIZATION AND COSTS

Article 5. Objects and Quotas for Recruitment

1. Recruitment Objects

a) Vietnamese citizens belonging to ethnic groups residing continuously for five years or more in areas with particularly difficult socio-economic conditions up to the year of admission, prioritizing ethnic minority candidates. The proportion of Kinh people recruited shall not exceed 15% of the total quota allocated.

b) Vietnamese citizens who are members of ethnic minorities that have few or no cadres with university, college, or intermediate qualifications compared to their population in the province or centrally-administered city, residing continuously for five years or more in Zone III, II (may also consider candidates from Zone I if the ethnic minority has very few cadres with university, college, or intermediate qualifications compared to their population nationwide or if the recruitment of such candidates in Zones III, II does not meet the annual quota).

The zones mentioned above are determined according to the regulations on the division of ethnic minority and mountainous regions by the Prime Minister.

2. Recruitment Quotas

a) Recruitment quotas are determined annually within the national plan for university, college, and intermediate-level admissions and are assigned by competent authorities for each profession and training level;

b) Recruitment quotas for the objects specified in Point 6 Clause 1 of this Article must be allocated separately within the annual recruitment quota assigned to localities, the Ministry of National Defense, and the Ministry of Public Security.

Article 6. Criteria for enjoying the recruitment system benefits

The criteria for individuals to enjoy the recruitment system benefits include:

1. Graduating from high school (or vocational college) for those recruited to universities and colleges, and graduating from junior high school or high school for those recruited to vocational colleges; having a good conduct rating in the final year of study (or training program); having a passing grade in academic performance in the final year of study (or training program), with ethnic minorities achieving at least a satisfactory grade and Han Chinese achieving at least a good grade.

2. Meeting preliminary selection standards for fields and trades that require such standards.

3. Not exceeding 25 years old at the time of enrollment; possessing adequate health according to current regulations.

4. Not being part of the state civil service establishment.

Article 7. Recruitment Organization (excluding recruitment into educational institutions under the Ministry of National Defense and the Ministry of Public Security)

1. Recruitment organization process:

a) Provincial People's Committees (hereinafter referred to as provincial-level People's Committees) base on economic and social development orientations and local needs to propose recruitment quotas by profession and education level to the Ministry of Planning and Investment, the Ministry of Education and Training, and the Ministry of Labor, Invalids, and Social Affairs;

b) The Ministry of Education and Training, the Ministry of Labor, Invalids, and Social Affairs, within their respective authorities, take the lead and coordinate with the Ministry of Home Affairs, the Ministry of Planning and Investment, the Ministry of Finance, and the Committee for Ethnic Minorities to examine and allocate recruitment quotas to provincial-level People's Committees in accordance with Clause 2 of Article 5 of this Decree.

c) Provincial-level People's Committees organize the selection process, place orders for training under the recruitment system with educational institutions, decide to send people to study according to the specified targets, standards, and quotas, and report the results of recruitment to the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs.

Each year, provincial-level People's Committees establish an Admissions Council to assist in implementing the recruitment work. The members of the Admissions Council include:

The Chairman of the Council is the Chairman or Vice-Chairman of the provincial-level People's Committee;

The Deputy Chairman of the Council is the Director of the Department of Education and Training;

Other members include representatives from the Department of Labor, Invalids, and Social Affairs, the Department of Home Affairs, the Ethnic Minority Committee, the Department of Planning and Investment, the Department of Finance; the Head of the Professional Education Division of the Department of Education and Training, and the Head of the Vocational Training Management Division of the Department of Labor, Invalids, and Social Affairs.

2. The Minister of Education and Training and the Minister of Labor, Invalids, and Social Affairs, within their respective authorities, stipulate procedures and application forms for registering to study under the recruitment system.

Article 8. Training Organization

1. Preparatory university and college training

a) Individuals recruited for university and college training must complete one year of preparatory studies. The organization of preparatory training and admission to formal studies at educational institutions shall be carried out in accordance with the regulations of the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs;

b) After completing one year of preparatory studies, if the student does not meet the conditions for admission to formal studies at educational institutions, they may repeat the preparatory year for no more than one year. During the preparatory year, the student enjoys the rights and fulfills the obligations as in the first year.

2. Formal training

a) When studying formally at educational institutions, students under the recruitment system are trained within the regular education system and are placed alongside other students of the same field of study as arranged by the provincial-level People's Committee with educational institutions;

b) The organization of training, recognition of graduation, and issuance of diplomas are carried out in accordance with current regulations of the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs.

Article 9. Training Expenses for Selected Students

1. The training expenses for students selected under the quota system shall be allocated in the state budget estimate for education and training annually according to current regulations.

Scholarships for students selected under the quota system shall be guaranteed by local budgets and directly provided to students according to the national scholarship policy.

2. Training expenses for students selected under the quota system shall be paid directly by provincial People's Committees, the Ministry of National Defense, and the Ministry of Public Security to educational institutions under the government procurement mechanism.

Article 10. Selection for Educational Institutions Under the Ministry of National Defense and the Ministry of Public Security

1. Based on the provisions of this Decree, the Ministry of National Defense shall take the lead and coordinate with the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance to guide the organization of selection, training, and allocation of training expenses for eligible candidates as stipulated in Article 5, who meet the criteria set forth in Articles 5 and 6 of this Decree, for higher education, college, vocational college, intermediate specialized college, and intermediate vocational college institutions managed by the Ministry of National Defense to train officers and technical staff for the Ministry of National Defense.

2. Based on the provisions of this Decree, the Ministry of Public Security shall take the lead and coordinate with the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance to guide the organization of selection, training, and allocation of training expenses for eligible candidates as stipulated in Article 5, who meet the criteria set forth in Article 6 of this Decree, for higher education, college, vocational college, intermediate specialized college, and intermediate vocational college institutions managed by the Ministry of Public Security to train officers and technical staff for the Ministry of Public Security.

Chapter III
ACCEPTANCE, ASSIGNMENT OF WORK AND REIMBURSEMENT OF SCHOLARSHIPS AND TRAINING COSTS
AND REIMBURSEMENT OF SCHOLARSHIPS AND TRAINING COSTS

Article 11. Acceptance and Assignment of Work for Selected Students After Graduation

1. Annually, educational institutions shall submit lists, transfer files, and graduation certificates of selected students who have graduated to the provincial People's Committee.

2. The provincial People's Committee shall organize the acceptance and assignment of work for selected students after graduation.

3. The maximum period for selected students to wait for work assignment as stipulated in Clause 2 of this Article is six months from the date of graduation recognition. If they do not receive work assignment within six months as prescribed by this Decree, selected students have the right to seek employment independently without having to reimburse scholarships and training costs.

Article 12. Cases Requiring Repayment of Scholarships and Training Costs

Selected students falling into any of the following cases must repay scholarships and training costs:

1. Those who are disciplined with compulsory withdrawal or voluntary withdrawal but without justifiable reasons approved by the dispatching agency.

2. Those who do not comply with work assignments as prescribed by this Decree after graduation.

3. Those who have worked for less than sixty months (for university and college level students) and less than thirty-six months (for intermediate level students) according to the work assignments of the provincial People's Committee.

4. Those who are disciplined and not assigned work after graduation or dismissed during the period of compliance with work assignments.

Article 13. Amount of compensation, method for calculating scholarship and training cost compensation

1. The amount of compensation includes policy scholarships for students and training costs that have been funded by the state budget. The compensation amount shall be paid into the state budget.

2. Method for calculating compensation

a) For cases stipulated in Clause 1 and 2, Article 12 of this Decree, the method for calculating compensation is determined as follows:

Where TS is the total amount to be compensated; HB is the policy scholarship received by the student in one year; CF is the training cost for the student in one year; n is the number of years the student has studied under the quota system.

b) For cases stipulated in Clause 3 and Clause 4, Article 12 of this Decree, the method for calculating compensation is determined as follows:

For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.

Where T is the time the person selected must fulfill their job assignment; t is the time the person selected has fulfilled their job assignment; symbols TS, HB, CF, and n are defined according to the provisions in point a of this clause.

Article 14. Acceptance, job assignment, and compensation for scholarship and training costs for students studying under the quota system at educational institutions under the Ministry of Public Security and the Ministry of National Defense.

The Ministry of Public Security and the Ministry of National Defense, based on the provisions of this Decree, shall specify in detail the procedures for acceptance, job assignment, and compensation for scholarship and training costs for students studying under the quota system at universities, colleges, vocational colleges, specialized secondary schools, and vocational secondary schools managed by the Ministry of Public Security and the Ministry of National Defense.

Chapter IV
IMPLEMENTATION

Article 15. Responsibilities of Ministries

1. The Ministry of Education and Training shall uniformly direct the selection, training, and implementation of policies for students studying under the quota system at higher education institutions and specialized secondary schools.

2. The Ministry of Labor, Invalids and Social Affairs shall uniformly direct the selection, training, and implementation of policies for students studying under the quota system at vocational colleges and vocational secondary schools.

3. The Ministry of Public Security and the Ministry of National Defense, within their respective authorities, shall uniformly direct the selection, training, acceptance, job assignment, and implementation of policies for students studying under the quota system at educational institutions under the Ministry of Public Security and the Ministry of National Defense.

4. The Ministry of Finance shall take the lead in guiding and supporting the budget to implement the quota system as prescribed in this Decree.

5. The Ministry of Home Affairs shall guide the construction of training plans for cadres in localities to ensure the quota system achieves its intended purpose and requirements.

6. The Committee for Ethnic Minorities shall take the lead and coordinate with relevant agencies to guide localities in determining the scope and extent of ethnic minority groups lacking or having very few cadres with university, college, and secondary level qualifications, and the division of regions as prescribed in Article 5 of this Decree.

7. The Ministry of Planning and Investment shall take the lead in compiling the quota targets proposed by ministries, sectors, and localities to include in the annual and five-year plans and submit them for approval by the Prime Minister.

Article 16. Responsibilities of Provincial People's Committees

1. Propose quota targets, allocate quota targets by profession in accordance with human resource needs and socio-economic development orientations of the locality, organize selection and send people to study in accordance with regulations.

2. Enter into training contracts with educational institutions to implement the quota system and allocate the budget as prescribed in this Decree.

3. Coordinate with educational institutions to manage students studying under the quota system during the training period.

4. Accept and assign jobs to students studying under the quota system after graduation.

5. Shall be responsible for recovering scholarship and training cost compensation from cases required to compensate as stipulated in Article 12 of this Decree and handle cases where compensation is not carried out.

6. Annually report the results of implementing the quota system in the locality to the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs.

7. Develop policies to create sources of admissions for candidates specified in point b, Clause 1, Article 5, based on creating favorable conditions for students of these ethnic groups to study at boarding schools for ethnic minorities.

Article 17. Responsibilities of educational institutions

1. Admit students under the quota system and fully implement all regulations and policies for such students as prescribed.

2. Annually report to the dispatching agency on the academic performance and discipline of students under the quota system, and the graduation time for final-year students.

3. Transfer the student's file to the dispatching agency after the student graduates or withdraws from the program.

4. Annually report the results of quota training to the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs.

Article 18. Inspection and Supervision

Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and educational institutions shall inspect and supervise the implementation of the quota system within their respective jurisdictions.

Chapter V

IMPLEMENTING PROVISIONS

Article 19. Effective Date

This Decree takes effect fifteen days after its publication in the Official Gazette. All previous provisions that conflict with this Decree are hereby abolished.

Article 20. Guidance on Implementation

The Ministry of Education and Training, the Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Home Affairs, the Ministry of Finance, and the Committee for Ethnic Minorities to guide the implementation of this Decree.

Article 21. Responsibility for Implementation

Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decree./.
