Guidelines for Implementing Decree No. 119/2004/NĐ-CP of the Government on Improving the Organizational System and Arranging Personnel, Civil Servants, and Military Officers Detached to Work on National Defense at Ministries, Agencies, and Localities
Pursuant to Decree No. 119/2004/NĐ-CP dated May 11, 2005 of the Government on national defense work at ministries, agencies equivalent to ministries, government agencies, and localities (hereinafter referred to as Decree No. 119/CP);
Pursuant to Decree No. 30/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
To implement the tasks and powers regarding national defense work prescribed in Article 4 and Article 5 of Decree No. 119/CP, the Joint Ministries of National Defense and Home Affairs hereby guide the improvement of organizational structures and the arrangement of personnel, civil servants, and military officers detached to work on national defense at ministries, agencies equivalent to ministries, government agencies, state-owned corporations, and localities as follows:
I. Organization of Bodies Implementing National Defense Work at Ministries, Agencies Equivalent to Ministries, Government Agencies, State-Owned Corporations, Central Party Office, Some Party Committees, and Central Agencies of Political-Social Organizations (hereinafter collectively referred to as Ministries and Agencies)
1. Ministries that have been established by the Government with Departments to advise the Minister on national defense work include:
- The Ministry of Planning and Investment has the Department of National Defense and Security;
- The Office of the Government has the Internal Affairs Department;
- The Ministry of Education and Training has the Department of National Defense Education;
- The Ministry of Finance has Department I.
2. Ministries that have offices for national defense work to advise the Minister on national defense work include:
- The Ministry of Health.
- The Ministry of Industry.
3. At the Ministry of National Defense: The People's Militia Mobilization Department under the General Staff is the permanent body assisting the Minister of National Defense in overseeing and directing national defense work at ministries, agencies, and localities.
II. Ministries and Agencies Arranging Military Officers Detached to Work on National Defense
1. Ministries and agencies equivalent to ministries that have arranged military officers detached to work on national defense shall maintain the status quo; if not yet arranged, they shall consult and reach agreement with the Ministry of National Defense to submit a proposal to the Prime Minister for a decision to arrange military officers detached to work on national defense, including:
- The Ministry of Planning and Investment.
- The Office of the Government.
- The Ministry of Education and Training.
- The Ministry of Health.
- The Ministry of Natural Resources and Environment.
- The Ministry of Industry.
- The Ministry of Transport.
- The Ministry of Posts and Telecommunications.
- The Ministry of Fisheries.
- The Ministry of Agriculture and Rural Development.
- The Ministry of Construction.
- Vietnam Railway Corporation.
III. Ministries, Agencies Equivalent to Ministries, Government Agencies, and State-Owned Corporations Arranging Personnel within the Establishment of Specialized Agencies for National Defense Work
1. The Ministry of Finance.
2. The Ministry of Foreign Affairs.
3. The Ministry of Justice.
4. The Ministry of Science and Technology.
5. The Ministry of Culture, Sports and Tourism.
6. The Ministry of Labor, Invalids and Social Affairs.
7. The Ministry of Trade.
8. The Government Inspectorate.
9. The Committee for Ethnic Minorities.
10. The Committee for Physical Culture and Sports.
11. Vietnam Steel Corporation.
12. Vietnam Textile and Garment Corporation.
13. Vietnam Paper Corporation.
14. Vietnam Cement Corporation.
15. Vietnam Rubber Corporation.
16. Vietnam Coal Corporation.
17. Vietnam Post and Telecommunications Corporation.
18. Vietnam Shipbuilding Industry Corporation.
19. Vietnam Chemical Corporation.
20. Vietnam Maritime Corporation.
21. Vietnam Electricity Corporation.
22. Vietnam Oil and Gas Corporation.
23. Vietnam National Airlines Corporation.
Agencies equivalent to ministries, government agencies, and state-owned corporations not listed above shall arrange personnel within their establishment to concurrently perform national defense work.
IV. Organization of Bodies and Arrangement of Personnel for National Defense Work at Provinces and Municipalities Directly Under the Central Government
1. The Chairperson of the Provincial People's Committee directly under the central government shall decide specifically on the arrangement of specialized personnel for national defense work at the Departments of Education and Training, and Planning and Investment based on the characteristics and actual conditions of the locality.
2. Other departments and agencies under the Provincial People's Committee directly under the central government shall arrange personnel within their establishment to concurrently perform national defense work.
V. Implementation
1. Based on this Circular, ministries, agencies, and localities shall arrange specialized and concurrent personnel for national defense work and submit the list to the Ministry of National Defense (through the People's Militia Mobilization Department / General Staff).
2. This Circular takes effect 15 days from the date of publication in the Official Gazette and revokes Circular No. 93/TT-LB dated January 16, 1995 of the Ministry of National Defense and the Government Cadre Management Board guiding the organization and personnel for national defense work at ministries, agencies equivalent to ministries, government agencies, and localities, and previous regulations and guidelines inconsistent with this Circular.
In the process of implementation, if there are difficulties, ministries, agencies, and localities are requested to promptly reflect them to the Ministry of National Defense and the Ministry of Home Affairs for consideration and coordination in resolving them./.
