Regarding the maximum selling price of diesel fuel

 

THE MINISTER OF TRADE

Pursuant to the Government Decree number 95/ dated October 20, 2015 of dated 04/12/1993 of the Government stipulating the functions, tasks, authorities and organizational structure of the Ministry of Commerce;

Implementing Circular No. 1357/CP-KTTH dated October 30, 2002 of the Prime Minister on adjusting the maximum selling price of diesel fuel;

After reaching consensus with the Ministry The following amendments are made to Article 2 of Decision No. 1247/2003/QĐ-NHNN dated October 20, 2003 of the Governor of the State Bank of Vietnam promulgating regulations on the banking code system used in transactions through the State Bank of Vietnam:

 

DECISION:

Article 1.Now we establish the maximum selling price (inclusive of value-added tax) for common diesel fuel (FoN

2B 3%) at actual temperature: maximum wholesale price: 3,000 VND/kg.0For premium grade diesel fuel: enterprises trading in petroleum products shall base their decisions on the above regulations and the quality and actual market prices of standard types of oil on the same market to make appropriate adjustments.

Place of sale: diesel fuel shall be delivered to the central warehouse of provinces and cities on the buyer's means of transport.

Article 2Enterprises responsible for importing petroleum products have the authority to determine specific wholesale prices for diesel fuel at each time point consistent with cost and market prices, but they must not exceed the maximum selling price set forth in Article 1.

Article 3.In cases where the world market price of diesel fuel fluctuates and the import cost exceeds the maximum selling price specified in Article 1, Vietnam Oil and Gas Corporation and other enterprises responsible for importing and trading in diesel fuel must take responsibility for regulating supply and demand to stabilize the market and develop pricing plans to propose solutions to relevant authorities.

Enterprises assigned the task of importing and trading in diesel fuel must promptly report to the Ministry

Article 4of Commerce and the Ministryof Finance when requested. The Department of Commerce and Tourism shall coordinate with the Department

of Finance and Prices in centrally administered provinces and cities to monitor the implementation of diesel fuel selling prices by enterprises in their respective areas; promptly identify and address any violations within their authorized scope according to current regulations; or report to competent authorities for handling. This Decision takes effect from November 1, 2002. Previous Decisions regarding the selling price of diesel fuel that conflict with this Decision are no longer enforceable./.

Article 5This Decision shall take effect from November 1, 2002. Previous Decisions on the selling price of crude oil that conflict with this Decision shall cease to be effective./.
