Pursuant to the Inspection Law 2010;

Pursuant to the Law on Petitioning 2011; the Law on Accusation 2011;

Pursuant to the Law on Prevention and Combating Corruption 2005, amended and supplemented in 2007 and 2012;

Pursuant to the Law on Press 1989, amended and supplemented in 1999;

Pursuant to Decree No. 51/2002/NĐ-CP dated April 26, 2002 of the Government detailing the implementation of the Press Law and the Law Amending and Supplementing Certain Provisions of the Press Law;

Pursuant to Decree No. 83/2012/NĐ-CP dated October 9, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decision No. 25/2013/QĐ-TTg dated May 4, 2013 of the Prime Minister promulgated along with the Press Spokesperson and Information Provision Regulations;

Pursuant to Decision No. 38/QĐ-TTCP dated January 7, 2013 of the Chief Inspector General of the Government stipulating the functions, tasks, powers, and organization and operation of the Department of Planning, Finance and Synthesis;

Considering the proposal of the Head of the Department of Planning, Finance and Synthesis of the Government Inspectorate,

DECISION:

Article 1. Issuing along with this Decision the "Press Spokesperson and Information Provision Regulations for the Government Inspectorate".

Article 2. This Decision replaces Decision No. 2016/2007/QĐ-TTCP dated September 26, 2007 and shall take effect fifteen days from the date of signature.

Article 3. The Heads of the Department of Planning, Finance and Synthesis, the Director of the Office, the Heads of Departments, the Directors of Bureaus, the Heads of units under the Government Inspectorate, the Heads of Inspectors of Ministries, agencies at the level of ministries, the Heads of Inspectors of provinces and centrally governed cities are responsible for implementing this Decision./.

REGULATIONS

PRESS SPEAKERSHIP AND INFORMATION PROVISION FOR THE MEDIA OF THE GOVERNMENT INSPECTORATE
(Issued along with Decision No. 1358/QĐ-TTCPdated June 20, 2013 of the Chief Inspector General of the Government)

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of Press Spokeship and Information Provision

These regulations govern the press spokesperson system and information provision for the media of the Government Inspectorate according to the laws on press and inspection, petitioning, accusation, and prevention and combating corruption, and other relevant laws.

Article 2. Press Spokesperson and Information Provider for the Media of the Government Inspectorate1. The Chief Inspector General of the Government is the authorized spokesperson of the Government Inspectorate, providing information to the media or appointing someone to provide information to the media (hereinafter referred to as the Spokesperson) in accordance with the law.

2. The Head of the Department of Planning, Finance and Synthesis is the official spokesperson, regularly providing information for the Government Inspectorate.

In cases of necessity, the Chief Inspector General of the Government may delegate authority to the Deputy Chief Inspector General of the Government to act on behalf of the Chief Inspector General of the Government in press spokespersonship and information provision for the media.

3. The spokesperson of the Government Inspectorate represents the Government Inspectorate in press spokespersonship and information provision for the media.

4. Information provided by the spokesperson or the person delegated by the Government Inspectorate to speak on its behalf is considered official information of the Government Inspectorate.

5. Staff members of the Government Inspectorate who have not been assigned tasks or delegated authority to be spokespersons or information providers for the media shall not represent the Government Inspectorate in press spokespersonship and information provision for the media.

6. In cases where staff members of the Government Inspectorate are requested by the media to give interviews, the person requested must report to the Chief Inspector General of the Government (in writing), clearly stating the interview content and can only give the interview after receiving approval from the Chief Inspector General of the Government.

6. In the case where officials, civil servants, or employees of the Government Inspectorate are invited for an interview by the press, the person invited for the interview must report to the Chief Inspector General (in writing), specifying the content of the interview, and may only give the interview after receiving the approval of the Chief Inspector General.

ChươChapter 2.

PUBLIC STATEMENTS AND PROVISION OF INFORMATION TO THE PRESS

Article 3. Public Statements and Regular Information Provision

1. Monthly, the Government Inspectorate provides regular information on the inspection activities of the Government Inspectorate on its official website "address: http://thanhtra.gov.vn".

2. Every three months once, the Government Inspectorate organizes press conferences to provide information about the activities of the Government Inspectorate to the media. The specific time is decided by the Chief Inspector General.

At the press conference, the spokesperson of the Government Inspectorate provides the following information to the media:

a) Main activities of the Government Inspectorate leadership;

b) The situation and results of the activities of the Government Inspectorate and the Inspection sector, including:

- Work on drafting normative legal documents, promoting and educating the law on inspections, handling complaints and denunciations, and preventing corruption;

- Inspection activities; results of implementing conclusions, recommendations, and decisions on inspections;

- Citizen reception work, handling letters and complaints;

- Anti-corruption work in accordance with the law on anti-corruption;

3. At the press conference, the spokesperson of the Government Inspectorate is responsible for answering journalists' interviews. In cases where the spokesperson finds that the interview content does not have sufficient information to answer immediately or contains sensitive content, they may choose not to answer directly at the press conference but respond at a suitable time.

4. The content of documents and reports provided at the press conference will be fully published on the official website of the Government Inspectorate.

Article 4. Public Statements and Information Provision in Emergency Situations

1. During the period between two press conferences, when there are necessary information that need to be promptly published in the media, the Government Inspectorate will organize emergency press conferences or send documents and provide information to the media.

2. In cases where incidents occur requiring immediate initial statements from the Government Inspectorate, the spokesperson of the Government Inspectorate is responsible for proactively making public statements and providing timely and accurate information about related events and issues to the media.

3. When the media agencies or state management agencies for the media request the Government Inspectorate to make public statements and provide information about events and issues related to the Government Inspectorate or within the scope of its management.

Article 5. Cases Where the Spokesperson Has the Right to Refuse to Make Public Statements and Provide Information to the Media

1. Issues belonging to the list of state secrets, secrets of the Inspection sector, and those related to national security, issues involving Party principles and regulations, and issues beyond the spokesperson's authority.

2. Cases under investigation, inspection, and resolution; inspection conclusions and reports on the results of verification of complaints and denunciations of the Government Inspectorate, which are prohibited by law or before receiving instructions from the Prime Minister.

3. Information and documents outside the functions, tasks, and authorities of the Government Inspectorate.

4. Other cases as stipulated by law.

Article 6. Preparation of Content and Organization of Information Provision

1. The Director of the Planning, Finance and General Affairs Department shall take the lead and coordinate with the Director of the Office, Directors of Departments and Bureaus, and heads of units under the Government Inspectorate to prepare the content for press conferences, responses to issues requested by the media, and other contents as directed by the Chief Inspector.

2. Departments, bureaus, and units shall be responsible for providing complete, accurate, and timely information to serve press conferences and information provision as required by the Spokesperson.

3. The content of statements and information provided to the media must be reviewed by the Chief Inspector before publication.

Article 7. Authority, Responsibilities, and Obligations of the Spokesperson

The spokesperson of the Government Inspectorate has the following authority, responsibilities:

1. Requesting departments, bureaus, and units under the Government Inspectorate to provide information, receive information, compile information, and organize regular and ad hoc information provision according to Articles 3 and 4 of this Regulation.

2. When receiving opinions and suggestions published or broadcast on the media related to the activities of the Government Inspectorate, the spokesperson has the right to request departments, bureaus, and units under the Government Inspectorate to provide information to respond to the media in accordance with the provisions of the Press Law.

3. Requesting news agencies to correct false or inaccurate articles or reports related to the activities of the Government Inspectorate and the Inspection sector.

4. Being accountable under the law and to the Chief Inspector for the content of statements and information provided to the media.

Chapter 3.

IMPLEMENTATION

Article 8. Implementation clause

1. Civil servants and officials of the Government Inspectorate who violate the provisions of this Regulation shall be subject to examination and disciplinary action according to current regulations depending on the nature, degree, and consequences caused.

2. Inspectors of Ministries, agencies at the ministerial level, and provincial and centrally-administered city inspectors shall base this Regulation to establish their own Regulations on Statements and Information Provision for relevant organizations, units, and individuals.

3. The Director of the Planning, Finance and General Affairs Department shall be responsible for inspecting, reporting to the Chief Inspector on the implementation, and proposing amendments and supplements to the Regulation in line with requirements and actual circumstances.
