OF THE MINISTRY OF FINANCE NUMBER 1360-TC/KBNN DATED JULY 27, 1992 ON THE REGULATIONS FOR LOANS FROM THE NATIONAL FUND FOR JOB CREATION

Implementing Resolution 120-HĐBT dated April 11, 1992 of the Council of Ministers on the policy, direction, and measures for job creation in the coming years, Decision No. 259/CT dated July 13, 1992 of the Chairman of the Council of Ministers, and Circular Jointly Issued by the Ministry of Labor, Invalids and Social Affairs, Ministry of Finance, and State Planning Commission No. 10/TT-LB dated July 24, 1992.

After obtaining the agreement of the Ministry of Labor, Invalids and Social Affairs, State Planning Commission, the Ministry of Finance hereby promulgates the regulations for loans from the National Fund for Job Creation as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. The purpose of loans from the National Fund for Job Creation is to fully utilize all existing potential, exploit natural resources, land, machinery, equipment, technology, and production experience to the maximum extent possible to create new jobs, attract additional labor, and increase income for workers.

2. The loan capital from the National Fund for Job Creation includes the annual budget funds allocated from the State Budget (Central Budget) and the recovered loan capital directly managed by the State Treasury, which is lent out according to the provisions set forth in Circular Jointly Issued by the Ministry of Labor, Invalids and Social Affairs, Ministry of Finance, and State Planning Commission No. 10/TT-LB dated July 24, 1992, and the bases stipulated in these regulations.

3. The State Treasury shall only provide loans for projects that have been approved by competent authorities within the scope of the loan capital it has received. The State Treasury is responsible for inspecting and supervising before, during, and after the provision of loans to each borrower to ensure full recovery of both principal and interest on the loans.

4. Borrowers eligible for loans from the National Fund for Job Creation include:

- Individuals, households, family groups, cooperatives, small non-state enterprises (collectively referred to as business operators) with projects creating new jobs and attracting new labor.

- Members of mass organizations, people's organizations, and professional associations who need employment and are included in employment programs and projects by their respective organizations to create jobs for themselves.

- Private households and families located in areas planned and organized by local People's Committees to attract labor and solve employment issues.

- Private households and families who have moved to new economic zones according to plans and require loans to develop household economies, which are consolidated into loan projects by the project managers.

- Families of military personnel and public security forces who have moved to new economic zones and require loans to develop household economies, which are consolidated into loan projects by the Ministry of Defense and the Ministry of Public Security.

5. Interest rate for loans: The State Treasury will implement loans at a low interest rate and loan fee (lower than the bank loan interest rate). The specific interest rate will be determined by the Joint Ministry of Finance, Ministry of Labor, Invalids and Social Affairs, and State Planning Commission according to each borrowing period. Borrowers must directly benefit from this preferential interest rate. It is strictly prohibited to add any other charges to the loan interest rate. The interest collected will be used to supplement the loan capital of the National Fund for Job Creation and cover the operational expenses of the State Treasury.

II. SPECIFIC PROVISIONS

1. Principles for lending:

- Loans must be provided to the correct borrowers and locations according to approved projects and in accordance with the production schedule and labor absorption schedule.

- Loan capital must be used for the purposes specified in the approved project; at the same time, it must ensure full repayment of principal and interest according to the terms stated in the loan agreement.

- Loans must be secured by collateral or credit guarantee.

2. Conditions for obtaining loans: Borrowers eligible for loans from the National Fund for Job Creation must meet the following procedures and conditions when applying for loans:

- They must have a project approved by competent authorities and must register for loans with the State Treasury where they intend to borrow.

- They must submit complete loan application documents and must be reviewed and examined by the State Treasury before being granted a loan. The loan application documents include:

+ An approved job creation project

+ A loan application form (Form 01/KBCV)

+ A loan collateral declaration form (Form 02/KBCV)

+ A guarantor letter (if the borrower does not have sufficient collateral) (Form 2a/KBCV).

+ An appraisal form (Form 03/KBCV)

+ A loan agreement (Form 04/KBCV)

- They must have collateral or credit guarantee: In all cases, borrowers must provide collateral. Business operators (individuals, households, family groups, cooperatives, small non-state enterprises) must provide collateral from their legally owned assets to obtain a loan. For private households, families, members of mass organizations, people's organizations, and professional associations without collateral, they must be guaranteed by legitimate local authorities, organizations, or associations using their assets or budgets with the State Treasury. If the borrower cannot repay the debt, the State Treasury has the right to auction the collateral or deduct from the guarantor's budget to recover the debt.

- The person named as the borrower is responsible for fully repaying the debt (principal and interest) to the State Treasury. When the borrower changes residence, goes missing, or is incarcerated, the legal heir must assume responsibility for repaying the debt to the State Treasury.

3. Loan term and capital recovery

The loan term is determined based on the production cycle, not exceeding 12 months. Special cases for long-term forestry and industrial tree planting projects may extend up to 36 months.

The term for recovering capital and interest: Loan capital will be recovered gradually according to the type of production and production cycles recorded in the loan agreement. Loan interest will be collected once at the end of the loan term.

In case the borrower fails to repay the debt upon maturity and is not granted an extension by competent authorities, the debt will become overdue and the borrower must pay interest at 1.5 times the prescribed rate.

If the borrower still fails to repay the debt three months after the due date, the State Treasury will take necessary actions to freeze and auction the collateral to recover the debt.

4. The interest rate for loans with various terms shall be applied according to the Decision of the Joint Ministry of Finance - Ministry of Labor, War Invalids and Social Affairs - State Planning Committee, and adjusted appropriately for each loan period.

III. IMPLEMENTATION

1. The Department of Finance and Prices, the Planning Commission, the Department of Labor, War Invalids and Social Affairs, and the National Treasury Branches in provinces and cities shall be responsible for coordinating with relevant departments and sectors to guide project owners in building loan projects.

2. National Treasury units shall be responsible for receiving and re-evaluating loan applications, implementing loans according to the prescribed recipients and regulations stipulated in Circular No. 10/TT-LB dated July 24, 1992 issued jointly by the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Finance, and the State Planning Committee, and other provisions in this document. They shall conduct inspections and controls to ensure that borrowed funds are used for their intended purposes. In cases where misuse of funds is discovered, the National Treasury has the authority to temporarily suspend or recover the loan and report to the Joint Ministries for review and resolution.

3. The National Treasury Bureau shall be responsible for managing and promptly distributing funds to the National Treasury Branches to implement loans; guiding the management, accounting, and bookkeeping of lending operations and loan repayments (both principal and interest) within the National Treasury system. This regulation shall take effect from the date of signature. During implementation, if any difficulties arise, they should be reported promptly to the Ministry of Finance for study and resolution.
