DECREE
Regarding important objectives in politics, economy, diplomacy,
science and technology, culture, and society to be guarded and protected by the People's Police Force,
and the responsibilities of relevant agencies and organizations
of the relevant authorities and organizations

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to the Law on People's Police of Vietnam 2005;

Pursuant to the National Security Law 2004;

Pursuant to the Ordinance on Protection of Important Facilities Related to National Security 2007;

Considering the proposal of the Minister of Public Security,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 1. This Decree stipulates important objectives in politics, economy, diplomacy, science and technology, culture, and society to be guarded and protected by the People's Police Force (hereinafter referred to as objectives); the responsibilities of agencies, organizations, and individuals in protecting these objectives.

Article 2. Objectives and subjects for protection as prescribed in the Guarding Ordinance 2005, the Ordinance on Protection of Defense Works and Military Areas 1994, and other objectives managed by the Ministry of National Defense not falling within the scope of this Decree.

Article 2. Principles of Objective Protection

Clause 1. The protection of objectives must comply with legal provisions; ensure absolute safety for all objectives; protect the interests of the State, and the legitimate rights and interests of organizations and individuals.

Clause 2. The protection of objectives shall be integrated with security and public order maintenance work in the locality.

Clause 3. Closely combine the requirements of objective protection with the requirements for economic and social development.

Article 3. Responsibilities of Agencies, Organizations, and Individuals in Objective Protection Work

Clause 1. Strictly implement legal provisions on objective protection and related legal provisions; promptly report any violations of the law; participate and support competent authorities in detecting, preventing, and handling violations of the law concerning objective protection work.

Clause 2. Promote the nationwide movement to protect national security; mobilize the people in the locality to strictly follow the Party's guidelines and policies, the State's policies and laws, actively participate in crime prevention and social evil eradication efforts, contributing to maintaining security, public order, and social safety in areas where objectives are located.

Article 4. Conditions for Determining Objectives

Objectives in politics, economy, diplomacy, science and technology, culture, and society to be guarded and protected by the People's Police Force must meet the following conditions:

Point 1. Types of Objectives

a) Headquarters of some central ministries and agencies and important Party and State agencies at provincial and centrally-administered city levels;

b) Embassies, consular offices of foreign countries, and representative offices of United Nations bodies in Vietnam;

c) Places storing valuable and particularly important documents, assets, and items of the State;

d) Sites storing materials and substances particularly dangerous to humans and the ecological environment;

đ) Sites for receiving and transmitting signals serving information dissemination and propaganda of the Party's guidelines and the State's policies and laws;

e) Important objectives under the management of the Ministry of Public Security;

g) Other important objectives decided by the Prime Minister.

Point 2. Scale and Nature of Objectives

a) Objectives must have independent and separate headquarters;

b) Objectives must be of particular importance and require armed police force protection.

Article 5. Changing and supplementing targets

1. Each year, ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government shall review and propose changes or supplements to important political, economic, diplomatic, scientific and technological, cultural, and social targets that are the responsibility of the People's Police force for armed guarding and protection based on the provisions of Article 4 of this Decree.

2. In cases where changes or supplements to targets are necessary, ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government shall submit the application dossier to the Ministry of Public Security for examination and report. The Prime Minister decides. The application dossier for examination includes:

a) A proposal and relevant documents and materials determining the scale and importance of the target;

b) Requirements for security and safety for the target and other documents proving the necessity for the target to be guarded and protected by the armed People's Police force.

Chapter II

SPECIFIC PROVISIONS

Article 6. List of Targets

The list of important political, economic, diplomatic, scientific and technological, cultural, and social targets that are the responsibility of the People's Police force for armed guarding and protection is hereby promulgated together with this Decree.

Article 7. Responsibilities of the Ministry of Public Security in target protection work

1. Shall be responsible before the Government for state management over the work of protecting important political, economic, diplomatic, scientific and technological, cultural, and social targets that are the responsibility of the People's Police force for armed guarding and protection.

2. Receive dossiers and organize the examination of targets according to the proposed changes and supplements by ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government, and report to the Prime Minister for decision, except for targets that are works within the scope of protection under the Ordinance on Protection of Important Works Related to National Security.

3. Take the lead and coordinate with ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government to implement measures to ensure the safety of targets.

4. Direct and organize the People's Police force for armed guarding, patrolling, and protecting important political, economic, diplomatic, scientific and technological, cultural, and social targets to proactively prevent, detect, stop, and promptly handle acts of harm to the targets.

5. Apply appropriate public security work measures to protect target safety.

6. Inspect, check, and handle violations related to target protection work.

7. Study and equip weapons, means, and supporting tools to serve the work of armed guarding and protecting targets.

8. Staff, train, and instruct the People's Police force for armed guarding and protecting targets.

9. Implement international cooperation in the work of protecting targets.

10. Summarize and evaluate the work of protecting targets.

Article 8. Responsibilities of ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government in the work of protecting targets

1. Proactively coordinate with the Ministry of Public Security and relevant agencies to organize the implementation of legal provisions on target protection for targets within their management authority.

2. Propose changes and supplements to targets within their management authority to the list of important political, economic, diplomatic, scientific and technological, cultural, and social targets that are the responsibility of the People's Police force for armed guarding and protection; submit to the Ministry of Public Security for examination and report

3. Direct subordinate agencies and units under their management with targets allocated the People's Police force for armed guarding and protection to strictly comply with the provisions of this Decree, other relevant laws, and guidelines of the Ministry of Public Security on the work of protecting targets.

4. For headquarters targets of ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government that are the responsibility of the People's Police force for armed guarding and protection, in addition to implementing the provisions of this Article, ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government must also directly assume the responsibilities of agencies with targets allocated the People's Police force for armed guarding and protection as stipulated in Article 9 of this Decree.

5. The Ministry of Foreign Affairs takes the lead and coordinates with the Ministry of Public Security to report and request competent authorities to arrange convenient accommodation for officers and soldiers of the People's Police force for armed guarding and protecting the embassies, consular offices of countries, and representative offices of organizations under the United Nations in Vietnam.

Article 9. Responsibilities of agencies with targets assigned to be guarded by armed People's Police forces

1. Bear primary responsibility for internal security work, asset safety, and order within the target.

2. Identify the main office location of the agency and issue a written request for the armed People's Police force to guard and protect.

3. Proactively coordinate with the directly responsible armed People's Police unit in developing plans, practicing plans, establishing internal protection regulations, cooperation mechanisms, and exchanging relevant situation information.

4. Equip physical infrastructure and protective equipment attached to the target; apply scientific and technological advancements to serve the protection of security and safety of the target.

5. Create necessary living conditions that facilitate the activities of officers and soldiers of the People's Police directly guarding and protecting the target.

6. Strictly implement legal provisions regarding security and safety protection work, creating favorable conditions to assist the People's Police force in preventing, detecting, and stopping harmful acts against the target.

Chapter III

IMPLEMENTING PROVISIONS

Article 10. Effective Date

This Decree takes effect from June 8, 2009, and replaces Decree No. 106/1997/NĐ-CP dated October 27, 1997, which stipulates important political, economic, cultural, and social targets to be guarded and protected by the armed People's Police force.

Article 11. Responsibility for Implementation

1. The Minister of Public Security is responsible for guiding the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees shall be responsible for implementing this Decree./.
