DECREE

Regarding the establishment of a monthly allowance for senior staff in Ministries

CHAIRMAN OF THE COUNCIL OF MINISTERS OF THE DEMOCRATIC REPUBLIC OF VIETNAM

Pursuant to Decree No. 3 dated May 3, 1946 on the organization of Ministries,

At the proposal of the Ministry of Interior and the Ministry of Finance,

After deliberation by the Standing Committee of the National Assembly and the Council of Ministers,

DECREE:

Article 1

Pursuant to Articles 5 and 9 of Decree No. 3 dated May 3, 1946 on the organization of Ministries, office staff of Ministers and Deputy Ministers, Directors of Departments, and Deputy Directors of Departments in Ministries shall receive allowances or salaries as follows from July 1, 1946.

Article 2

Private individuals appointed to hold such positions who were not previously civil servants shall be entitled, during the performance of their duties, to a fixed monthly allowance as follows:

Director of Department 400 dong per month

Director of Office 400 dong per month

Deputy Director of Department 400 dong per month

Chief of Office 400 dong per month

Deputy Chief of Office 350 dong per month

Secretary 350 dong per month

Assistant to the Chief of Office 350 dong per month

Article 3

Staff members who have a family (with a spouse or two children or more) shall receive an additional family allowance equal to half of the allowance specified in Article 2.

Article 4

Civil servants on regular posts, or working under daily contracts or agreements, appointed to hold any of the aforementioned positions shall be entitled to salaries as follows:

a) When the total salary (basic pay, supplementary pay, and allowances) of the civil servant is higher than the allowance specified in Article 2 if they do not have a family, or in Articles 2 and 3 if they do have a family: their previous salary shall remain unchanged;

b) When the total salary of the civil servant is lower than the allowance specified in Article 2 if they do not have a family, or in Articles 2 and 3 if they do have a family: they shall receive an additional position allowance equal to the allowance specified in Article 2 or in Articles 2 and 3, as applicable, minus their total salary.

Article 5

The Ministers of relevant Ministries are responsible for implementing this Decree.
