PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State-Owned Enterprises dated November 26, 2003;
Pursuant to Decision No. 38/2007/QD-TTg dated March 20, 2007 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises with 100% state capital;
Considering the proposal of the People's Committee of Yen Bai Province,
DECISION:
Article 1. Approves the restructuring and modernization plan for state-owned enterprises directly under the People's Committee of Yen Bai Province for the period 2007-2010 as follows:
1. Maintain the status quo for the following limited liability companies:
- Yen Bai Lottery Company.
2. Implement shareholding reform:
In 2007:
- Highway Construction and Management Company I.
- Highway Construction and Management Company II.
- Urban Works and Environment Company.
- Water Supply Company.
In 2008:
- Nghia Lo Water Supply and Drainage Limited Liability Company.
- Muong Lo Market Limited Liability Company.
3. Temporarily maintain the status quo and will restructure later:
- Nghia Van Irrigation Limited Liability Company.
- Tan Phu Irrigation Limited Liability Company.
4. Transfer management to other agencies:
- Thac Ba Tourism Hotel to the Vietnam General Confederation of Labor.
- Agricultural Supplies Company to become a member of the Vietnam Shipbuilding Industry Group.
Article 2.
1. The Chairman of the People's Committee of Yen Bai Province:
- Directs the implementation of the restructuring and modernization of state-owned enterprises under its jurisdiction according to the approved content.
- Referring to the provisions of Decision No. 38/2007/QD-TTg dated March 20, 2007 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises with 100% state capital, decides the proportion of shares held by the State when implementing shareholding reforms for the state-owned enterprises mentioned in this Decision.
2. Ministries of Finance, Planning and Investment, Home Affairs, Labor, Invalids and Social Affairs, and related agencies shall cooperate with the People's Committee of Yen Bai Province in implementing the above plan.
The Steering Committee for Enterprise Reform and Development is responsible for urging, guiding, and monitoring the implementation.
Article 3. This Decision takes effect from the date of issuance.
The Chairman of the People's Committee of Yen Bai Province and heads of relevant agencies are responsible for enforcing this Decision./.
