CIRCULAR
GUIDELINES ON THE TASKS, LIMITS AND ORGANIZATIONAL STRUCTURE OF THE FINANCIAL MANAGEMENT INVESTMENT DEPARTMENT OF THE PROVINCE'S DEPARTMENT OF FINANCE - PRICES ISSUED BY THE MINISTRY OF FINANCE UNDER DECREE NO. 138/1999/TT-BTC ON NOVEMBER 26, 1999
Pursuant to Decree No. 145/1999/NĐ-CP dated September 20, 1999 of the Government on restructuring the General Department of Investment Development, the Ministry of Finance issues guidelines on the tasks, limits and organizational structure of the financial management investment department of the provincial Department of Finance - Prices (hereinafter referred to as province) as follows:
I. TASKS:
1. Assist the People's Committee of the province and the Minister of Finance in performing state management tasks related to financial investment:
1.1. Guide, organize, and inspect the implementation of state policies and regulations on financial management in the field of development investment within the province.
1.2. Participate in providing opinions and proposals to the Ministry of Finance and the People's Committee of the province regarding issues related to policies and regulations on financial management of development investment that need supplementation and amendment.
1.3. Participate in building plans, programs, and orientations for development investment in each period at the local level and in various sectors within the province; provide information on relevant issues to serve as a basis for constructing and appraising projects supported by state investment.
1.4. Guide financial agencies at the district, city, and town levels (hereinafter collectively referred to as districts) and financial agencies at the commune and ward levels (hereinafter collectively referred to as communes) in managing, allocating, and controlling payments of capital for basic construction projects from district and commune budgets according to the regulations of the Ministry of Finance.
1.5. Guide, direct, and inspect project sponsors in implementing investment plans, ensuring progress and repayment of loans according to the commitments of credit contracts, receiving and using investment funds for their intended purposes and in accordance with state regulations.
1.6. Guide, inspect, and urge project sponsors to complete final accounts of investment capital according to the content, requirements, and timeframes stipulated by the state, resolve any difficulties arising during the preparation of final account reports.
1.7 Guide and inspect the review and approval of final accounts for investment projects of the locality which have been delegated by the Chairman of the People's Committee of the province to decide on investment.
2. Implement financial management of investment:
2.1. Participate in investment policies, financial plans, and economic-financial effectiveness of investment projects managed by the province; participate in tendering for projects under the authority of the Provincial People's Committee.
2.2. Guide sponsors to prepare annual investment capital plans in accordance with the State Budget Law; coordinate with the Department of Planning and Investment to allocate investment capital plans and project lists using provincial budget funds according to investment and construction management regulations, adjust and supplement investment capital plans for projects funded by provincial investment sources.
2.3. Uniformly manage local funds borrowed and received as aid for development investment.
2.4. Based on approved investment capital allocation plans and schedules, the plan of the State Treasury, and the provincial budget balance, transfer quarterly investment capital to the State Treasury for it to control payments according to the regulations of the Ministry of Finance.
2.5. Inspect the implementation of investment capital plans, the management and use of investment capital, the control and settlement of investment capital under the local budget of sponsors, the State Treasury at the provincial, district, and commune levels.
2.6. Organize the review of completed investment projects for approval by the Chairman of the People's Committee of the province (for projects decided on by the Chairman of the People's Committee of the province).
Review and approve the final accounts of investment projects funded by local public funds according to regulations.
2.7. Summarize and settle investment capital, analyze the situation of raising and using investment capital, investment capital plans, evaluate the efficiency of managing and using investment capital in the locality, report to the Ministry of Finance and the People's Committee of the province as prescribed.
2.8. Coordinate with the Branch of the Development Assistance Fund to address consequences of projects (within the scope of responsibility of the locality) suspended and unable to repay loans according to the law.
2.9. Inspect, comment, and confirm the final account figures of the State Treasury for provincial budget investment capital to report to the People's Committee of the province.
2.10. Report to the Ministry of Finance on the implementation of investment capital plans, the implementation of projects allocated investment capital plans, the structure of investment capital, compliance with state regulations on managing development investment capital within the locality.
3. Perform other tasks related to financial management of investment as prescribed by the state.
II. LIMITS:
To perform the above tasks, the Department of Finance - Prices has the following powers and responsibilities:
1. Has the right to request sponsors, provincial and district State Treasury agencies, and other investment construction management agencies to provide necessary documents related to the compilation of investment capital plans, management and final accounts of investment capital, implement necessary management measures according to current regulations to ensure the effective use of state investment capital.
2. Sign notices transferring provincial budget investment capital to the State Treasury for control and payment; sign guiding and explanatory documents on regulations related to the management of investment capital from local budgets.
III. ORGANIZATIONAL STRUCTURE:
The Department of Finance - Prices has an Investment Division to assist the Department in performing the above tasks.
The staffing of the Investment Division is part of the staffing of the Department of Finance - Prices.
Based on these guidelines, the People's Committee of the province directs the Department of Finance - Prices and the Civil Service Organization Board to implement the organizational structure for the financial management investment department of the Department of Finance - Prices to begin operations from January 1, 2000. During the implementation process, if there are any difficulties, please reflect them to the Ministry of Finance for research and resolution.
