DECISION OF THE PRIME MINISTER
Regarding the consolidation of the settlement project, the special supportproject for ethnic minorities, and the mountainous commune center constructionprogram into the Program

PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Resolution No. 31/1999/QH10 of the National Assembly, SessionX, Sixth Meeting concerning Tasks for 2000;
Pursuant to Decision No. 135/1998/QĐ-TTg dated July 31, 1998 of the PrimeMinister approving the Program to develop the economy and society of particularlydifficult communes in mountainous areas, remote and far-flung regions;
Considering the proposal of the Minister, Chairman of the Committee for EthnicMinorities and Mountainous Areas, Ministers of the Ministries of Planning andInvestment, Finance, Labor - Invalids and Social Affairs, Agriculture andRural Development,
DECISION:
Article 1.Consolidate within the provincial territory the settlement project, thespecial support project for ethnic minorities (as stipulated in Decision No.133/1998/QĐ-TTg dated July 23, 1998 of the Prime Minister regarding the approvalof the National Target Program to eliminate poverty and reduce poverty in theperiod 1998-2000), the program to build mountainous commune centers (as stipulatedin Decision No. 35/TTg dated January 13, 1997 of the Prime Minister) into theProgram to develop the economy and society of particularly difficult communes inmountainous areas, remote and far-flung regions (Decision No. 135/1998/QĐ-TTgdated July 31, 1998), including the following contents:
1.Name of the Program: The Program to develop the economy and society ofparticularly difficult communes, ethnic minority communities in mountainousareas, border regions, and remote and far-flung regions (referred to as Program135).
2.Objectives:
General objectives, specific objectives, guiding principles, tasks, mainpolicies, sources of funds and their utilization under the Program shall beimplemented according to the provisions of Articles 1, 2, and 3 of Decision No.135/1998/QĐ-TTg dated July 31, 1998 of the Prime Minister regarding the approvalof the Program to develop the economy and society of particularly difficultcommunes in mountainous areas, remote and far-flung regions.
3.Scope of implementation of the Program: The Program will provide investmentassistance to communes implementing Decision No. 1232/QĐ-TTg dated December 24,1999 of the Prime Minister approving the list of particularly difficult communesand border communes within the scope of the Program to develop the economy andsociety of particularly difficult communes in mountainous areas, remote andfar-flung regions, and decisions of the Prime Minister approving the list ofcommunes implementing the tasks of Program 135.
4.Duration of implementation of the Program: After consolidation, Program 135will be implemented over five years (2001-2005).
5.Program 135 includes the following projects:
a.Infrastructure construction project: Includes the contents stipulated in DecisionNo. 135/1998/QĐ-TTg dated July 31, 1998 and the infrastructure constructioncomponent of the settlement project stipulated in Decision No. 133/1998/QĐ-TTgdated July 23, 1998 of the Prime Minister.
The infrastructure construction component of the settlement project willonly be implemented in communes implementing Decision No. 135/1998/QĐ-TTgdated July 31, 1998 and must be adjusted to fit with the approved planningcontent and the commune infrastructure investment project under Program 135.
b.Mountainous commune center construction project;
c.Population resettlement planning project in necessary locations;
d.Stable production development project in agriculture and forestry linkedwith product processing and consumption;
e.Village cadre training project.
Article 2.Convert the special support project for ethnic minorities (as stipulated inDecision No. 133/1998/QĐ-TTg dated July 23, 1998 of the Prime Minister) intosupport policies for households of ethnic minorities. Entrust the Committee forEthnic Minorities and Mountainous Areas to take charge, coordinate with relevantministries and sectors to determine criteria and formulate support policies forhouseholds of ethnic minorities to submit to the Prime Minister for decision.
Article 3.Implementation organization:
1.The Central Steering Board of Program 135 (after consolidation) is theSteering Board of the Program to develop the economy and society of particularlydifficult communes in mountainous areas, remote and far-flung regions establishedand operating according to functions and tasks already defined in Decision No.13/1998/QĐ-TTg dated January 23, 1998 and Decision No. 01/1999/QĐ-TTg datedJanuary 4, 1999 of the Prime Minister, at the local level according to theprovisions of Decision No. 38/2000/QĐ-TTg dated March 24, 2000 of the PrimeMinister.
2.On organizational management and guidance: The organization and managementof Program 135 will be carried out according to Decision No. 38/2000/QĐ-TTgdated March 24, 2000 of the Prime Minister, and the management and guidance ofthe component projects of the Program will be divided as follows:
The Committee for Ethnic Minorities and Mountainous Areas: As the PermanentAgency assisting the Government in directing the implementation of the Programand directly taking charge, coordinating with ministries, sectors, and localitiesin managing and directing projects such as infrastructure construction, mountainouscommune centers, and village cadre training.
The Ministry of Agriculture and Rural Development: Taking charge,coordinating with ministries, sectors, and localities in directing populationresettlement planning in necessary locations and agricultural and forestrydevelopment projects linked with product processing and consumption in communesunder the Program.
The Ministry of Planning and Investment: Taking charge, coordinating withrelevant ministries in perfecting Circular Joint No. 416/1999/TTLT/BKH-UBDTMN-TC-XD dated April 29, 1999 on guiding investment management and construction ofinfrastructure works in particularly difficult communes in mountainous areas,remote and far-flung regions after consolidating programs and projects.
The responsibilities of relevant ministries and sectors shall be carriedout according to the operational regulations of the Central Steering Board of theProgram issued together with Decision No. 01/1999/QĐ-TTg dated January 4, 1999of the Prime Minister.
The Chairmen of People's Committees of provinces having this program shallbe responsible for directing the consolidation and effectively organizingmanagement on their respective territories.
Article 4.THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
The Head of the Central Steering Board of Program 135, Ministers, Heads ofagencies equivalent to ministries, Heads of agencies under the Government, andChairmen of People's Committees of centrally-administered cities shall berequired to implement this Decision./.
