Pursuant to the Law on Prevention and Combating Corruption 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Prevention and Combating Corruption 2007;

Pursuant to Resolution No. 294A/2007/UBTVQH12 dated September 27, 2007 of the Standing Committee of the National Assembly on the organization, tasks, powers, and operational regulations of the Provincial Steering Committee for Preventing and Combating Corruption under the central city and the opinions of the Standing Committee of the National Assembly in Document No. 253/UBTVQH12 dated June 26, 2009;

Considering the proposal of the Director of the Office of the Central Steering Committee for Preventing and Combating Corruption.

Article 1. Name and functions of the office assisting the Provincial Steering Committee for Preventing and Combating Corruption

1. The office assisting the Provincial Steering Committee for Preventing and Combating Corruption shall be called the Office of the Provincial Steering Committee for Preventing and Combating Corruption (hereinafter referred to as the Office of the Provincial Steering Committee).

2. The Office of the Provincial Steering Committee operates on a dedicated basis, with the function of advising and assisting the Provincial Steering Committee for Preventing and Combating Corruption (hereinafter referred to as the Provincial Steering Committee) and the Chairman of the Provincial Steering Committee for Preventing and Combating Corruption (hereinafter referred to as the Chairman of the Provincial Steering Committee), responsible for organizing services for the activities of the Provincial Steering Committee and the Chairman of the Provincial Steering Committee.

3. The Office of the Provincial Steering Committee may use its own seal in accordance with the provisions of the law.

Article 2. Tasks of the Office of the Provincial Steering Committee

The Office of the Provincial Steering Committee shall perform the following tasks:

1. Based on the actual situation of the locality and the work program of the Central Steering Committee for Preventing and Combating Corruption, it shall draft and submit to the Chairman of the Provincial Steering Committee the work program, plan, and tasks of the Provincial Steering Committee for Preventing and Combating Corruption on a monthly, quarterly, semi-annual, and annual basis.

2. It shall draft and submit to the Provincial Steering Committee and the Chairman of the Provincial Steering Committee periodic and ad hoc reports to the Provincial Party Committee, Municipal Party Committee, Provincial People's Council, Provincial People's Committee, and the Central Steering Committee for Preventing and Combating Corruption regarding the situation and results of anti-corruption efforts in the locality and the activities of the Provincial Steering Committee in accordance with the functions and responsibilities of the Provincial Steering Committee.

3. It shall prepare the content, organize, and serve meetings and working sessions of the Provincial Steering Committee and the Chairman of the Provincial Steering Committee; notify the directives, conclusions of the Provincial Steering Committee and the Chairman of the Provincial Steering Committee, and monitor, inspect, and urge implementation.

4. It shall study and propose to the Provincial Steering Committee and the Chairman of the Provincial Steering Committee preventive measures against corruption; participate in drafting legal normative documents on preventing and combating corruption within the jurisdiction of the province.

5. It shall advise and assist the Provincial Steering Committee and the Chairman of the Provincial Steering Committee in performing the tasks, powers, and responsibilities stipulated in Articles 4, 5, and 14 of Resolution No. 294A/2007/UBTVQH12 of the Standing Committee of the National Assembly.

6. It shall carry out administrative, archival, and record-keeping work for the Provincial Steering Committee and the Office of the Provincial Steering Committee.

7. It shall manage and utilize the financial resources and assets assigned; ensure material and technical conditions for the activities of the Provincial Steering Committee and the Chairman of the Provincial Steering Committee.

8. It shall perform other tasks assigned by the Provincial Steering Committee and the Chairman of the Provincial Steering Committee.

Article 3. Working regime and working relationship of the Office of the Provincial Steering Committee

1. The Office of the Provincial Steering Committee operates under the head system, combined with the specialist system, based on the principle of democratic centralism.

2. Weekly meetings; monthly, quarterly, semi-annual, and annual reports on the activities of the Office of the Provincial Steering Committee to the Steering Committee and the Head of the Provincial Steering Committee.

3. The Director of the Office of the Provincial Steering Committee may be invited to attend meetings of the People's Council and People's Committee at the provincial level, and meetings and work sessions of the People's Council and People's Committee with agencies, organizations, units, or individuals regarding matters related to anti-corruption work in the locality.

4. The Office of the Provincial Steering Committee may be invited to attend meetings and receive documents as a direct subordinate of the province; authorized by the Provincial Steering Committee to request agencies, organizations, units, and competent authorities to provide information and documents on corruption situations and anti-corruption results within their own agencies, organizations, and units according to regulations; authorized to request notifications of specific corruption case handling, complaints and denunciations resolution, and corruption-related information processing.

5. Cooperate with Inspection, Police, People's Procuracy, People's Court, Departments, sectors, provincial-level agencies, People's Committees of districts, towns, cities under provinces, and central agencies located in the locality to exchange information, monitor, and urge anti-corruption work in these agencies, organizations, and units, and other coordinated activities as required by anti-corruption work.

6. Cooperate with the Office of the Provincial Party Committee, City Party Committee, Office of the Delegation of the National Assembly and People's Council, and Office of the People's Committee of provinces and centrally-administered cities in activities involving information and document exchange on corruption situations and anti-corruption work.

Article 4. Organization of the Office of the Provincial Steering Committee

1. The Office of the Provincial Steering Committee has a Director and Deputy Directors. In some large centrally-administered cities, if deemed necessary, two Deputy Directors may be appointed.

a) The Deputy Head of the Provincial Steering Committee concurrently serves as the Director of the Office of the Provincial Steering Committee; the Director of the Office of the Provincial Steering Committee is the head of the Office of the Provincial Steering Committee, managing, directing, and being responsible before the Steering Committee and the Head of the Provincial Steering Committee for all activities of the Office of the Provincial Steering Committee;

b) The Deputy Director of the Office of the Provincial Steering Committee is equivalent to a Deputy Director of a department; assists the Director in implementing certain areas of work and is responsible before the Director and the law for assigned tasks.

2. Based on the requirements and tasks of anti-corruption work, the Chairman of the People's Committee of provinces and centrally-administered cities shall be responsible for:

a) Deciding on the administrative staffing of the Office of the Provincial Steering Committee according to Resolution No. 294A/2007/UBTVQH12 of the Standing Committee of the National Assembly, not exceeding five cadres and specialists (excluding the Deputy Head of the Provincial Steering Committee), and arranging service staff according to the needs of the Office of the Provincial Steering Committee;

b) Selecting and deciding on appropriate forms to ensure material conditions for the operation of the Steering Committee and the Office of the Provincial Steering Committee.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from February 1, 2010.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-administered cities, Provincial Steering Committees on anti-corruption, and relevant agencies, organizations, units, and individuals are responsible for implementing this Decision.

3. The Office of the Central Steering Committee on anti-corruption is responsible for monitoring and urging implementation; during the implementation process, if difficulties arise, they should be compiled and reported. The Prime Minister will consider and decide./.
