Article 1. Scope of Regulation

Article 2. Applicability

4. Ordering the revocation of examination results, subject assessment results, thesis defense results not in accordance with regulations; re-examining tests, reassessing subject results, re-conducting thesis defenses.

5. Ordering the revocation of printed certificates that do not comply with prescribed content.

6. Transferring qualified admitted students to other educational institutions or revoking admission decisions, refunding tuition fees to students if transfer is not possible for institutions that illegally admit, are dissolved, have their licenses revoked, or are suspended from educational activities.

7. VIOLATIONS, FORMS OF PENALTY, LEVELS OF PENALTY AND MEASURES TO REMEDY CONSEQUENCES

Chapter II

VIOLATIONS OF REGULATIONS ON THE ESTABLISHMENT OF EDUCATIONAL INSTITUTIONS AND ORGANIZATION OF EDUCATIONAL ACTIVITIES

Article 5. Violations concerning the establishment of educational institutions and organizations within such institutions

1. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for intentionally altering, erasing, or falsifying the content in the decision on establishment or permission to establish an educational institution.

2. A fine shall be imposed for forging documents in the application file for establishment or permission to establish an educational institution as follows:development Remedial measures:

a) VND 10,000,000 to VND 20,000,000 for a preschool education institution;

b) VND 15,000,000 to VND 20,000,000 for a general education institution, a continuing education center, a language center, or a computer center;

c) VND 20,000,000 to VND 40,000,000 for a vocational college;

d) VND 40,000,000 to VND 60,000,000 for a college or university.

3. A fine shall be imposed for establishing an educational institution without authorization as follows:

a) VND 10,000,000 to VND 20,000,000 for a preschool education institution;

b) VND 20,000,000 to VND 30,000,000 for a general education institution, a continuing education center, a language center, or a computer center;

c) VND 30,000,000 to VND 50,000,000 for a vocational college;

d) VND 50,000,000 to VND 80,000,000 for a college, university, or academy.

4. A fine shall be imposed for establishing an organization within an educational institution without proper authority as follows:

a) VND 3,000,000 to VND 5,000,000 for an organization within a preschool education institution, a general education institution, or a continuing education center;

b) VND 5,000,000 to VND 10,000,000 for an organization within a vocational college;

c) VND 10,000,000 to VND 20,000,000 for an organization within a higher education institution.

5. Additional sanctions: Revocation BB 1.6of the right to use the decision on establishment or permission to establish for a period of 12 to 24 months for violations stipulated in Clause 2 of this Article.

6. Remedial measures:with respect to vocational secondary education activities;

a) Compelling students who meet admission criteria to transfer to another educational institution or canceling the admission decision and refunding the fees collected from the students if they cannot be transferredpolicieswhen it is not possible to transfer themdevelopmentdue to the circumstances specified in this case;No.Suspend educational activities for 12 tonationalwhere the institution has been established illegally due to the violation of provisions set out in Clauses 2, 3, and 4 of this Article;developmentCompelling the dissolution of the educational institution or organization within such an institution in accordance with the violations stipulated in Clause 3 and Clause 4 of this Article.

b) Article 6. Violations concerning conditions for organizing educational activitiesNo.A fine of VND 5,000,000 to VND 10,000,000

shall be imposed for altering, erasing, or falsifying the content in the decision allowing educational activities.

1. A fine shall be imposed for organizing educational activities outside the permitted location as follows: đVND 3,000,000 to VND 5,000,000 for a preschool education institution;

2. VND 5,000,000 to VND 10,000,000 for a general education institution, a continuing education center, a language center, or a computer center;

a) VND 10,000,000 to VND 20,000,000 for a vocational college;

b) VND 20,000,000 to VND 30,000,000 for a higher education institution.

c) A fine shall be imposed for forging documents in the application for permission to conduct educational activities as follows:

d) VND 5,000,000 to VND 10,000,000 for preschool education activities;

3. VND 10,000,000 to VND 15,000,000 for general education activities, continuing education activities, language activities, or computer activities;

a) VND 15,000,000 to VND 20,000,000 for vocational college education activities;

b) VND 20,000,000 to VND 40,000,000 for higher education activities.

c) A fine shall be imposed for organizing educational activities without permission as follows:24 months for violations stipulated in Clause 4 of this Article.

d) VND 5,000,000 to VND 10,000,000 for organizing preschool education activities;

4. VND 10,000,000 to VND 20,000,000 for organizing general education activities;

a) VND 20,000,000 to VND 30,000,000 for organizing vocational college education activities;

b) VND 30,000,000 to VND 50,000,000 for organizing higher education activities, except for cases provided for in Point d of Clause 4 of this Article;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP d) VND 50,000,000 to VND 80,000,000 for organizing educational activities according to a master's or doctoral program.

b) A fine of VND 10,000,000 to 20,000,000 for recruiting more than 30 students incorrectly.

Article 7. Violations concerning additional teaching

1. A fine shall be imposed for violations of regulations on additional teaching according to the following levels of fines:

a) From VND 1,000,000 to VND 2,000,000 for organizing additional teaching activities that do not ensure material facilities as prescribed;.From VND 2,000,000 to VND 4,000,000 for organizing additional teaching activities that do not comply with the target group;

b) From VND 4,000,000 to VND 6,000,000 for organizing additional teaching activities that do not comply with the content already permitted;.From VND 6,000,000 to VND 12,000,000 for organizing additional teaching activities without a permit.

c) The right to use the additional teaching permit shall be revoked for six to twelve months for violations stipulated in Points b and c Clause 1 of this Article;

d) Suspension of additional teaching activities for twelve to twenty-four months for violations stipulated in Point d Clause 1 of this Article.

2. Remedial measures:

a) Compel to supplement all necessary conditions regarding material facilities for violations stipulated in Point a Clause 1 of this Article;

b) Compel to refund all collected amounts to students and bear all costs of refunding for violations stipulated in Points b, c, and d Clause 1 of this Article.

3. Compel students to be transferred to locations where they have been authorized to operate for violations stipulated in Clause 2 of this Article;

a) VIOLATIONS OF REGULATIONS ON ENROLLMENT ACTIVITIESArticle 8. Violations concerning announcements, enrollment counseling, and determination of enrollment quotas

b) A fine from VND 2,000,000 to VND 4,000,000 shall be imposed for announcing enrollment without providing sufficient information about the target group, level of education, form of education, duration of education, location of education, student file, and course fees, or failing to comply with the announced enrollment announcement.No.A fine from VND 5,000,000 to VND 10,000,000 shall be imposed for announcing foreign educational programs without permission to implement such programs on Vietnamese territory.

A fine from VND 10,000,000 to VND 15,000,000 shall be imposed for providing overseas study counseling or counseling for foreign educational program enrollment on Vietnamese territory without permission to operate on Vietnamese territory.

A fine from VND 15,000,000 to VND 20,000,000 shall be imposed for violating regulations on criteria for determining enrollment quotas.

1. Violations concerning enrollment targetsof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsA fine shall be imposed for incorrectly enrolling high school students according to the following levels of fines:ìFrom VND 200,000 to VND 500,000 for incorrectly enrolling fewer than ten students;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Vietnam.

3. From VND 500,000 to VND 2,000,000 for incorrectly enrolling between ten and less than twenty students;.From VND 2,000,000 to VND 5,000,000 for incorrectly enrolling twenty or more students.

4. A fine shall be imposed for incorrectly enrolling vocational college students according to the following levels of fines:

a) From VND 20,000,000 to VND 40,000,000 for incorrectly enrolling between five and less than ten students;

b) From VND 40,000,000 to VND 60,000,000 or suspension of enrollment for twelve months for incorrectly enrolling ten or more students.

c) A fine from VND 5,000,000 to VND 10,000,000 shall be imposed for falsifying documents in enrollment applications to secure admission.

2. A fine from VND 10,000,000 to VND 20,000,000 shall be imposed for failing to comply with the prescribed procedures in the enrollment regulations.

a) Compel to cancel admission decisions, refund all collected amounts to students, and bear all costs of organizing refunds for violations stipulated in Clauses 1, 2, 3, and 4 of this Article;

b) Compel to cancel admission decisions for violations stipulated in Clause 5 of this Article.

c) A fine of VND 5,000,000 to 15,000,000 for recruiting incorrectly fewer than 10 students;

1. A warning or fine shall be imposed for the act of admitting students to vocational training programs exceeding the number specified in the notification from the competent authority or assigned quota according to the following levels of fines:

a) A warning or a fine of VND 200,000 to VND 500,000 for the act of admitting more than 5% but less than 10%;

b) A fine of VND 2,000,000 to VND 5,000,000 for the act of admitting more than 10% but less than 15%;

c) A fine of VND 5,000,000 to VND 10,000,000 for the act of admitting more than 15% but less than 20%;

d) A fine of VND 10,000,000 to VND 20,000,000 for the act of admitting 20% or more.

2. A fine shall be imposed for the act of admitting students to college, university, master's and doctoral programs exceeding the number specified in the notification from the competent authority or assigned quota according to the following levels of fines:

a) A fine of VND 2,000,000 to VND 5,000,000 for the act of admitting more than 5% but less than 10%;

b) A fine of VND 5,000,000 to VND 20,000,000 for the act of admitting more than 10% but less than 15%;

c) A fine of VND 20,000,000 to VND 40,000,000 for the act of admitting more than 15% but less than 20%;

d) A fine of VND 40,000,000 to VND 60.000,000 for the act of admitting 20% or more.

Article 11. Violations of regulations on duration, content, and educational programs

A fine of VND 200,000 to VND 500,000 shall be imposed for the act of not having complete files and records as prescribed or not using teaching equipment as provided.

1. A warning or a fine shall be imposed for the act of not teaching the required number of class hours for a subject in the training program according to the following levels of fines:

1. Impose fines up to a maximum of VND 500,000 for each violation stipulated in Chapter II of this Decree;

Article 30. Application of Deportation Sanction Form

Foreign individuals committing administrative violations as stipulated in Clause 7, Article 8 of this Decree to the extent that they must be deported from the territory of Vietnam shall be implemented in accordance with the Government's Decree on the regulations for temporary detention, escorting individuals through administrative procedures, and applying the deportation sanction form through administrative procedures.

Chapter IV

IMPLEMENTING PROVISIONS

Article 31. Effective Date

1. This Decree takes effect from December 10, 2013.

Article 32. Transitional Provisions

For administrative violations in the field of education occurring before July 1, 2013 but discovered later or under examination and resolution thereafter, the provisions most favorable to the violating organizations or individuals shall be applied.

Article 33. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen ||Provincial People's Committees under the Central Government are responsible for enforcing this Decree./.
