THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

          Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 289/QD-TTg dated March 18, 2008 of the Prime Minister on certain support policies for ethnic minority groups, policy beneficiaries, poor households, near-poor households, and fishermen;

At the proposal of the Director of the Fisheries Resource Exploitation and Protection Department,

DECISION:

Article 1. Attached hereto is the "Economic and Technical Standards and Norms for Fishing Vessels Supported According to Point a Clause 4 and Point a Clause 5 Article 1 of Decision No. 289/QD-TTg dated March 18, 2008 of the Prime Minister on Issuing Certain Support Policies for Ethnic Minority Groups, Policy Beneficiaries, Poor Households, Near-Poor Households, and Fishermen"

Article 2.

1. The Directors of Fisheries Departments and Departments of Agriculture and Rural Development shall be responsible for:

- Compiling and reporting the number of fishing vessels and fishermen eligible for support to the People's Committee of the province and coordinating with relevant sectors and levels to estimate the support budget, ensuring that the support reaches the correct recipients promptly and accurately.

- Directing the Fisheries Resource Protection Agencies and Fisheries Resource Exploitation and Protection Agencies:

+ To quickly implement registration, inspection, and issuance of fishing permits to facilitate fishermen receiving support as stipulated.

- Monthly and quarterly, every six months, compiling and reporting to the Ministry (Fisheries Resource Exploitation and Protection Department) the list of vessel owners who have received support under this Decision.

- Annually, compiling and reporting to the Ministry the list of fishing vessels, fishermen, and the amount of support funds provided by the locality to fishermen.

2. The Director of the Fisheries Resource Exploitation and Protection Department shall be responsible for:

- Coordinating with relevant sectors and levels to organize the implementation of regulations on supporting fishermen.

- Guiding the Fisheries Resource Exploitation and Protection Agencies to promptly resolve outstanding issues related to registration, inspection, and issuance of fishing permits to facilitate fishermen receiving support as stipulated.

- Before the 10th day of each month and the 10th day of the first month of each quarter, compiling and reporting to the Minister the situation regarding registration, inspection, and issuance of fishing permits.

Article 3. This Decision shall take effect from the date of signing.

Article 4. Heads of Departments, units under the Ministry, and Directors of Fisheries Departments and Departments of Agriculture and Rural Development are responsible for implementing this Decision.

ECONOMIC AND TECHNICAL STANDARDS AND NORMS FOR FISHING VESSELS SUPPORTED UNDER DECISION NO. 289/QD-TTG DATED MARCH 18, 2008 OF THE PRIME MINISTER

1. Scope of Application:

These standards apply to fishing vessels in the fisheries sector that are supported according to Point a Clause 4 and Point a Clause 5 Article 1 of Decision No. 289/QD-TTg dated March 18, 2008 of the Prime Minister.

2. Economic and Technical Standards

a. For new fishing vessels purchased or newly built by fishermen eligible for support for marine fishing vessels with engine power of 90HP or more or service vessels for marine fishing activities.

- New engines must be 100% specialized marine engines (not converted from other types), accompanied by origin certificates, technical documentation, valid purchase and sale documents, and warranty commitments from the manufacturer.

- Engine power refers to the main propeller engine installed on the vessel, excluding auxiliary engines and other special-purpose engines.

- New engines must ensure fuel consumption does not exceed 180 grams per horsepower per hour.

- New engines must be equipped (power and speed) suitable for the vessel's fishing profession and operating area.

- There must be a document approving the purchase or construction of new vessels as stipulated in Article 8 of the Fishing Vessel Registration and Crew Regulations (this may only apply to new or constructed marine fishing vessels with engine power of 90HP or more).

- There must be technical documentation as required by Article 16 of the Fishing Vessel Inspection Regulations (this may only apply to new or constructed marine fishing vessels with engine power of 90HP or more).

b. For fishing vessels eligible for support to replace old engines with new ones that consume less fuel for marine fishing vessels with engine power of 40HP or more.

- New engines must be 100% specialized marine engines (not converted from other types), accompanied by origin certificates, technical documentation, valid purchase and sale documents, and warranty commitments from the manufacturer.

- New engines must ensure fuel consumption does not exceed 180 grams per horsepower per hour.

- There must be a technical installation supervision report issued by the inspection authority.

c. For fishing vessels eligible for support to replace old engines with new ones that consume less fuel for service vessels for marine fishing activities.

- Service vessels for marine fishing activities must have been registered as fishing vessels and the vessel owner must have obtained a business registration certificate for fishery service operations.

- New engines must be 100% specialized marine engines (not converted from other types), accompanied by origin certificates, technical documentation, valid purchase and sale documents, and warranty commitments from the manufacturer.

- New engines must ensure fuel consumption does not exceed 180 grams per horsepower per hour.

- There must be a technical installation supervision report issued by the inspection authority.

d. For fishing vessels eligible for support in providing fuel to fishermen who are the owners of marine fishing vessels or service vessels for marine fishing activities.

- For vessels with engine power below 20 HP, the vessel owner must have a registration confirmation issued by the competent fisheries management authority.

3. Organization of Implementation

a. The Directors of Fisheries Departments and Departments of Agriculture and Rural Development shall be responsible for organizing and guiding fishermen to understand and comply with these standards.

b. During the implementation process, if there are any difficulties, they must be reported promptly to the Ministry for supplementation and amendment.
