JOINT CIRCULAR
Of the Ministry of Justice and the Ministry of Finance number 1385/TTLT/BTC-BTP dated October 11, 1997
guiding the issuance and management of uniforms for civil enforcement officers and staff

Implementing Decision No. 418/TTg dated June 14, 1997 of the Prime Minister on the uniform system for civil enforcement officers and staff, the Ministry of Justice and the Ministry of Finance guide the implementation of the issuance and management system as follows:
I. OBJECTS, STANDARDS AND PERIOD OF USE OF UNIFORMS
1. Recipients
Officers and staff recruited within the approved establishment quota working at the Civil Enforcement Management Department of the Ministry of Justice and local civil enforcement agencies (except Enforcement Officers) shall be issued uniforms to use when performing their duties.
2. Standards and period of use of uniforms.
The objects mentioned in point 1 above shall be issued uniforms according to the standards and period of use as follows:
a. Standards:
- Emblem attached to the hat brim and shirt collar;
- Winter-spring suit, summer suit, long-sleeved shirt, tie, leather shoes, leather belt, leather briefcase, socks, raincoat, Kepi cap, hard hat. For winter-spring suits and summer suits, two sets will be issued initially; for long-sleeved shirts, two pieces will be issued initially; for socks, two pairs will be issued initially.
Uniforms issued to officers and staff mentioned in point 1 Part I shall be made from domestically produced fabric.
b. Period of use of uniforms as follows:

II. BUDGET ESTIMATION, ISSUE AND MANAGEMENT OF UNIFORMS
1. Establishment of budget projections:
Annually, civil enforcement agencies base on the approved establishment quota and types of uniforms that have reached the end of their period of use to prepare budget estimates for procurement and submit them together with the annual state budget estimate to the Ministry of Justice for consolidation and submission to the Ministry of Finance in accordance with general regulations. For the year 1997, the procurement funds for uniforms for civil enforcement officers and staff are included in the state budget of the Ministry of Justice which has been approved and announced by the Government.
2. Funding allocation:
Based on the state budget expenditure estimate assigned by the Government and the budget estimate for procurement funds, the Ministry of Finance promptly allocates funds to the Ministry of Justice so that the Ministry of Justice can allocate to units for procurement of uniforms.
3. Management and use of uniforms
a. Civil enforcement agencies are responsible for maintaining records of uniform issuance according to the model prescribed in the appendix to this Circular. Annual procurement funds for civil enforcement agencies are settled according to the State Budget Law and current accounting and financial regulations.
b. In cases of resignation, forced resignation, leave under regulations, transfer to other positions... where uniforms still have remaining periods of use, they need not be returned (except emblems on hats and shirt collars); if the period of use has expired and they have not been issued, they will not be issued again.
c. The form, material, color, style... of the emblem attached to the hat brim and shirt collar of the objects mentioned in point 1 Part I of this Circular shall be implemented according to the provisions of Clause 1 Article 16 of Decree 30/CP dated June 2, 1993 of the Government; except for the emblem on the shirt collar of officers and staff of the Civil Enforcement Management Department of the Ministry of Justice and local civil enforcement agencies, which shall have a platinum-colored border around the emblem but without a shield or two swords.
When making uniforms (except emblems), they must comply with the models, styles, colors, and materials prescribed in Decision No. 296/QĐ-THA dated July 23, 1997 of the Minister of Justice.
d. The recovery of emblems in the cases mentioned in subpoint b point 3 Part II above shall be guided as follows:
- The Director of the Civil Enforcement Management Department of the Ministry of Justice shall recover emblems of officers and staff working at the Civil Enforcement Management Department of the Ministry of Justice;
- The Director of the Department of Justice shall recover emblems of officers and staff of local civil enforcement agencies under his/her jurisdiction. After recovering the emblems, the Director of the Department of Justice must report in writing to the Ministry of Justice.
đ. Uniforms of the objects that are still within the period of use and are lost or damaged without valid reasons shall not be replenished; individuals must purchase or make them according to the prescribed uniform regulations.
III. IMPLEMENTATION
This Circular takes effect from July 1, 1997.
Any difficulties encountered during implementation should be reported to the Ministry of Justice and the Ministry of Finance for appropriate amendments and supplements./.
