THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

BASED ON Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
BASED ON Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
BASED ON Decision No. 1471/QĐ-TTg dated August 13, 2010 of the Prime Minister on the establishment of the Youth Work Department under the Ministry of Home Affairs;
Considering the proposal of the Director of the Department of Youth Affairs and the Director of the Department of Civil Service Personnel

Article 1. Position and Functions

The Youth Work Department is an organization of the Ministry of Home Affairs, with the function of advising and assisting the Minister to manage state administration regarding youth work;

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Assist the Minister in drafting legal normative documents, plans, programs, projects, and proposals on youth and youth work for competent authorities to decide, including:

a) Laws, Resolutions, Decrees, and Decisions on youth and youth work;

b) Circulars and Joint Circulars for the Minister of Home Affairs to consider and issue guidance and implement legal normative documents on youth and youth work;

c) Strategies and programs for developing youth and national targets on youth; five-year and annual plans on organizing and managing youth work;

d) Strategies, programs, and policies related to youth, youth work, and resource development among youth;

e) Proposals on organization and management for youth work;

f) Plans for promoting and educating the law to youth and youth work;

g) Training and capacity-building programs in the field of state management over youth and youth work;

h) Programs and plans for mid-term and final reviews of the implementation of legal provisions, strategies, and national target programs on youth and youth work;

2. Serve as the focal point to assist the Minister in performing the following tasks:

a) Implementing programs, plans, projects, and plans related to youth and youth work according to the division of responsibilities by competent authorities;

b) Take the lead or coordinate with Ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally-administered cities to implement legal normative documents on youth and youth work; integrate mechanisms and policies for youth and youth work when developing economic and social development programs within the scope of management of ministries, sectors, and localities;

c) Coordinate with relevant agencies and organizations in resolving inter-sectoral issues concerning youth and youth work;

d) Coordinate with the National Committee for Youth, the Central Committee of the Ho Chi Minh Communist Youth Union, and other youth organizations led by the Ho Chi Minh Communist Youth Union in implementing mechanisms and policies for youth and youth work;

e) Guide and inspect the implementation of legal provisions on youth work, the implementation of policies and systems in organizing and managing youth and youth work;

3. Take the lead or coordinate with agencies and organizations under the Ministry to carry out foreign activities on youth; organize international conferences and seminars related to youth and youth work according to the assignment of the Minister;

4. Take the lead in preparing responses on youth and youth work according to assigned functions and tasks and the Minister's assignment; coordinate with agencies and organizations under the Ministry in reviewing the establishment of youth associations;

5. Coordinate with the Inspectorate of the Ministry in conducting inspections, audits, and handling complaints and denunciations related to youth and youth work within the scope of the Ministry's state management;

6. Leading or participating in scientific research, scientific topics, and special scientific studies on youth and youth work according to assigned functions and tasks and the Minister's assignment.

7. Carry out comprehensive work and statistical data collection on organizing and managing youth and youth work; organize the application and development of information technology and build databases to serve specialized state management work on youth and youth work according to assigned functions and tasks in line with the Ministry's information technology application and development program;

8. Perform other tasks assigned by the Minister;

Article 3. Organization and Working System

1. The Department consists of a Director, Deputy Directors, and civil servants.

2. The Director shall be responsible to the Minister for organizing and implementing the tasks specified in Article 2 and shall have the following specific duties and powers:

a) Organizing and directing the implementation of the Department's tasks and being accountable to the Minister for all aspects of the Department's work;

b) Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants within the Department;

c) Signing on behalf of the Minister to respond, provide guidance, and request information from relevant agencies, organizations, units, or individuals according to the Department's functions and tasks;

d) Cooperating with agencies and organizations under the Ministry and related agencies in resolving issues within the Department's functions, tasks, and powers;

đ) Implementing the information system for civil servants in the Department according to the Ministry's working regulations;

e) Deciding on the contents of reports, reviews, summaries, and recommendations to the Minister regarding policies and solutions in organizing the implementation of the Department's tasks;

g) Implementing the Ministry's working regulations; managing civil servants and assets according to the Ministry's classification.

3. Deputy Department Heads perform professional tasks and assist the Department Head in managing one or more areas of work according to the Department Head's assignment; are responsible to the Department Head for assigned tasks;

The Director shall assign a Deputy Director to oversee the Department's operations during the Director's absence.

4. Civil servants in the Department shall perform specialized tasks and be accountable to the Director for the assigned tasks.

5. The Department operates under a specialist system combined with a chief system; in cases where the Ministry's leadership directly works with Deputy Department Heads or specialists, Deputy Department Heads and specialists are responsible for implementing the Ministry's leadership's opinions and promptly reporting back to the Department Head;

Article 4. Effective date

1. Transfer intact the state management functions, tasks, and powers regarding youth work as stipulated in Decision No. 116/QĐ-BNV dated February 2, 2009 of the Minister of Home Affairs on the functions, tasks, powers, and organization of the General Department before the Youth Work Department was established;

2. This Decision takes effect from the date of issuance;

Article 5. Responsibilities for Implementation

The Director of the Ministry's Office, the Department Heads of the Cadre and Civil Servant Organization Department, the General Department, the Youth Work Department, the Heads of agencies and organizations under the Ministry, and relevant officials and civil servants are responsible for implementing this Decision./.
