DECISION OF THE MINISTER OF HOME AFFAIRS

Approving the Charter of the Vietnam Hydrogeology Association

 THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

 On the basis of Decree No. 102/SL-L004 dated May 20, 1957, regarding the right to establish Associations;

On the basis of Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government on the organization, operation, and management of Associations;

On the basis of Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Considering the proposal of the Chairman of the Vietnam Hydrogeology Association and the Director of the Department for Non-Governmental Organizations,

 

DECISION:

Clause 4 of Article 6Approves the Charter of the Vietnam Hydrogeology Association which was adopted at the First National Congress of the Association on August 13, 2005.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Chairman of the Vietnam Hydrogeology Association and the Director of the Department for Non-Governmental Organizations shall be responsible for implementing this Decision.

CHARTER

VIETNAM HYDROGEOLOGY ASSOCIATION

Issued pursuant to Decision No. 139/2005/QĐ-BNV dated December 28, 2005

of the Minister of Home Affairs

PART I

NAME, AIMS AND OBJECTIVES, SCOPE OF ACTIVITY

Article 1. Name

The Association has the name: Vietnam Hydrogeology Association.

English trading name: Vietnam Association of Hydrogeology.

Article 2. Aims and Objectives

1. The Vietnam Hydrogeology Association (hereinafter referred to as the Association) is a voluntary social-professional organization of organizations and individuals engaged in the hydrogeology specialty. The Vietnam Hydrogeology Association is a member of the Vietnam Geological Society. The Association operates within the framework of the laws of the Socialist Republic of Vietnam and according to the Association's Charter.

2. The purpose of the Association is to unite and mobilize widely those people working in the hydrogeology specialty to help each other promote talent and intellect, improve professional competence, and contribute to the cause of industrialization and modernization of the country, contributing to building a prosperous Vietnam with a fair, democratic, and civilized society.

Article 3. Scope of Activity

1. The Vietnam Hydrogeology Association operates throughout the country, with its headquarters in Hanoi. The Association has legal personality, a seal, separate assets and finances, and a bank account.

2. The Vietnam Hydrogeology Association may join domestic and international organizations in the same field in accordance with the law.

Chapter II

TASKS AND METHODS OF OPERATION

Article 4. Tasks

1. Mobilizing the enthusiasm and creative abilities of members in researching and investigating basic geological hydrology to meet the socio-economic development needs of the country.

2. Encouraging and assisting members to improve their scientific and technical skills, contributing to training talents in the geological sector.

3. Exchanging information; disseminating knowledge of geological science and technology, underground water resources, and environmental issues among the public; promoting and encouraging creativity among the geological hydrology workforce.

4. Studying and applying new theories, scientific and technological advancements, and advanced experiences both domestically and internationally to geological investigation work, underground water resource management, and environmental protection for sustainable development.

5. Providing advice, criticism, and supervision of projects related to research, exploitation, and utilization of underground water, participating in strategic planning for geological and hydrogeological development, and specific policies, systems, and measures to promote the development of the hydrogeology sector when requested.

6. Conducting economic activities in accordance with the law through the application of scientific and technological progress to generate income for the Association's fund.

7. Organizing training and international cooperation in accordance with the law on hydrogeology and the environment.

Article 5. Methods of Operation

1. Organizing conferences, seminars, and information exchanges on the specialized field of Hydrogeology within the national, regional, and international scope in accordance with the provisions of the law.

2. Conducting training and professional development courses, including foreign language classes for members and the general public. Participating in undergraduate and postgraduate education at universities and research institutes.

3. Participating in the publication of books and periodicals related to Geology and Hydrogeology in accordance with the provisions of the law.

4. Supporting research and investigation activities concerning Hydrogeology (water resources) and minerals; rewarding and encouraging creative activities, outstanding research works, and academic achievements of students, graduates, and research fellows in the field.

5. Expanding cooperative relations with domestic and foreign associations in accordance with the law to learn from experiences and seek assistance and support from domestic and foreign organizations for the development of the Association.

Chapter III

MEMBERS

Article 6. Members and Membership Standards

1. Vietnamese citizens engaged in Hydrogeological work or related professions, who have the conditions to regularly participate in the Association's activities, voluntarily submit membership applications, may be considered for admission as members of the Vietnam Hydrogeology Association.

2. Vietnamese citizens both domestically and abroad, with knowledge of the Hydrogeology profession, willing to contribute to the Association, recognizing the Charter of the Association, may be considered as affiliated members. Affiliated members enjoy rights and obligations like other members of the Association, except for the right to nominate, vote, and join the Executive Board and leadership positions of the Association, and do not participate in voting on Association matters.

3. Procedures for admitting and expelling members are stipulated by the Standing Committee of the Association.

4. Members of the Vietnam Hydrogeology Association may join other associations.

Article 7. Obligations and Benefits of Members

1. Members have the obligation to promote the Association, respond to all Association activities, implement the Charter of the Association, and pay membership fees.

2. Members have the right:

a) To participate in Association activities, to receive assistance from the Association to engage in scientific and technical activities and training both domestically and internationally, and to enjoy benefits provided by the Association. b) To discuss and vote on all Association matters, to be nominated and elected to Association bodies, to receive member cards, and to request withdrawal from the Association.

ORGANIZATION OF THE ASSOCIATION

Chapter IV

Article 8. Principles of Organization

The Vietnam Hydrogeology Association is organized and operates on the principles of voluntarism, self-management, financial autonomy, and legal responsibility; unity, democracy, collective leadership, individual responsibility, and majority decision-making. Leadership bodies at various levels of the Association are established through elections; each level decides issues within its scope of responsibility and authority but must not contravene the Charter of the Association, resolutions of the Congress, and state laws.

Article 9. Structure of the Association

National Congress.

1. 2. Central Executive Board of the Association.

3. Association Office.

5. Provincial and large city Hydrogeology Associations.

4. Inspection Board.

6. Basic Branches.

Article 10. National Congress

The highest leadership body of the Association is the National Congress with a term of five years. The Central Executive Board of the Association may decide to convene the Congress earlier if more than two-thirds of the Central Executive Board members or more than half of the basic organizational units request it. The composition and number of delegates (if it is a representative congress) are elected by the basic organizational units according to the ratio of members stipulated by the Central Executive Board of the Association. The number of invited delegates shall not exceed 10% of the number of convened delegates.

The National Congress has the following tasks:

Discussing and approving the report on the term of work of the Association. Deciding on the goals, directions, tasks, and work plans of the new term of the Association;

1. 2. Determining the number of Central Executive Board members and electing the new term Central Executive Board of the Association;

3. Approving the final accounts of the Association;

4. Discussing and approving resolutions on amending the Charter of the Association (if necessary).

4. Discuss and adopt a resolution to amend the Charter of the Association (if any).

Article 11. Principles of Voting at the General Assembly

1. The General Assembly adopts important issues of the Association through secret ballot or raising hands. The form of voting is decided by the General Assembly.

2. Resolutions of the General Assembly must be passed by more than 50% of the present official delegates.

Article 12. Central Executive Board of the Association

The Central Executive Board of the Association is the leading body of the Association between two General Assemblies. The Central Executive Board convenes regularly once a year; in case of necessity, extraordinary meetings can be organized upon the call of the President of the Association when more than half of the members of the Central Executive Board request it.

The Central Executive Board has the following responsibilities:

1. Implementing the resolutions of the General Assembly;

2. Leading the work of the Association during the period between two General Assemblies;

3. Electing the Standing Committee consisting of the President, Vice Presidents, Secretary-General, and Standing Members. The number of Standing Members is determined by the Central Executive Board of the Association;

4. Electing the Central Inspection Board. The Head of the Inspection Board is a Standing Member of the Central Executive Board;

5. When necessary, it has the right to elect additional Central Members but the number shall not exceed one-third of the Members elected by the General Assembly;

6. The election procedures for leadership positions of the Association are stipulated by the Central Executive Board of the Association.

Article 13. Standing Committee

The Standing Committee is the permanent body of the Central Executive Board of the Association, responsible for implementing the resolutions of the General Assembly and the Central Executive Board. The Standing Committee meets every three months; in case of necessity or upon the proposal of the President of the Association, the Standing Committee may convene extraordinary meetings.

The Standing Committee has the following responsibilities:

1. Representing the Central Executive Board of the Association to direct and manage the activities of the Association according to the resolutions of the General Assembly, the resolutions of the Central Executive Board of the Association, and must report on the situation between two meetings of the Central Executive Board;

2. Deciding on the establishment, appointment, dismissal, commendation, and disciplinary actions of staff of specialized boards and subordinate organizations of the Association in accordance with the law; deciding on the admission and expulsion of members in accordance with the Charter of the Association and the law;

3. Depending on the requirements of work, the Standing Committee may establish boards and organizations to assist in their duties with defined responsibilities and authorities.

Article 14. Inspection Board

The Central Inspection Board of the Association operates independently in its field, directly under the direction of the Standing Committee of the Central Executive Board. The tasks and powers of the Inspection Board are stipulated as follows:

1. Inspecting the implementation of the Charter of the Association, the implementation of the resolutions of the General Assembly, the resolutions and decisions of the Central Executive Board of the Association, and the Standing Committee of the Association;

2. Examining and resolving complaints and petitions related to members and organizational bodies of the Association in accordance with the law;

3. Having the right to require members and organizational bodies of the Association to report on matters related to the inspection content approved by the Standing Committee of the Central Executive Board in accordance with the law;

4. The Inspection Board has its own program of activities or operates upon the proposal of the President of the Association and the decision of the Standing Committee of the Central Executive Board.

Article 15. President of the Association

The President of the Association is elected by the Central Executive Board of the Association; the President of the Association has the following responsibilities:

1. Chairing meetings of the Central Executive Board, the Standing Committee, and annual meetings of the Association;

2. Managing the activities and making decisions on the affairs of the Association according to the resolutions of the General Assembly, the Central Executive Board, and the Standing Committee of the Association;

3. Representing the Association in internal and external relations;

4. Being accountable to the Central Executive Board, the Standing Committee, and members of the Association for the activities of the Association;

5. Being the first account holder of the Association;

6. Managing the meeting of the next term Central Executive Board until a new President is elected.

Article 16. Deputy Chairmen

1. The Deputy Chairmen are elected by the Central Executive Board of the Association, including one Deputy Chairman who serves as Acting Chairman. The Deputy Chairmen are assigned by the Chairman to lead certain aspects of the Association's work, with responsibilities and authorities within the scope of their assignments and as stipulated in the Operational Regulations of the Central Executive Board of the Association.

2. When the Chairman is absent, the Acting Deputy Chairman shall perform the duties of the Chairman.

Article 17. Secretary General

The Secretary General is elected by the Central Executive Board of the Association, with the following responsibilities:

1. Continuously handling Association affairs according to the Chairman's assignment and assisting the Chairman in implementing daily activities of the Central Office of the Association; directly directing the Office and other specialized units of the Association (if any);

2. Implementing the internal and external communication functions of the Association;

3. Organizing secretarial work and compiling documents for Congress sessions, Central Executive Board meetings, Standing Committee meetings, and annual meetings of the Association;

4. The Secretary General is the second account holder of the Association, responsible for managing the Association's assets according to the Chairman's assignment;

5. The Secretary General has an office and some staff proposed by the Secretary General, subject to approval by the Chairman of the Association;

6. The Secretary General may concurrently serve as the Director of the Office.

Chapter V

ASSOCIATION FINANCES

Article 18. Sources of Income

1. Membership fees paid by members.

2. Income from the Association's scientific and technological activities.

3. Money and property donated by individuals and organizations both domestically and internationally, in accordance with the law.

4. Income from other lawful activities.

Article 19. Financial and Asset Management

1. The Association has independent finances and assets; management and utilization are conducted in accordance with the regulations of the Central Standing Committee of the Association and state regulations.

2. Upon dissolution of the Association, its assets and finances must be inventoried and disposed of in accordance with the law.

Chapter VI

REWARDS AND DISCIPLINE

Article 20. Awards

Outstanding achievements of Association members and organizations will be recognized with rewards by the Association; they may also be recommended for rewards by the State and local authorities. Forms of reward are determined by the Central Standing Committee of the Association.

Article 21. Discipline

1. If Association members and organizations violate the Charter seriously, disciplinary measures will be imposed. Forms of discipline are decided by the Central Standing Committee of the Association.

2. In cases where laws are violated, administrative penalties or criminal prosecution will be pursued according to the law.

Chapter VII

IMPLEMENTING PROVISIONS

Article 22. Effectiveness of the Charter

1. This Charter consists of 7 Chapters and 22 Articles, which were unanimously approved at the First National Congress of the Vietnam Hydrogeological Association on August 13, 2005.

Only the National Congress of the Association has the authority to amend or supplement this Charter.

2. This Charter takes effect upon approval by the Minister of Home Affairs./.
