Regarding the issuance of the Rules on Organization and Operation
of the Safe Deposit Services Center
GOVERNOR OF THE STATE BANK OF VIETNAM
Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated December 12, 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam No. 10/2003/QH11 dated June 17, 2003;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and Ministerial-Level Agencies;
Pursuant to Decree No. 10/2002/NĐ-CP dated January 16, 2002 of the Government on financial regulations applicable to public service units with revenue;
Pursuant to Decree No. 116/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of officials and civil servants in state-owned public service units;
At the proposal of the Director of the Safekeeping Services Center and the Head of the Organization and Cadres Department,
DECISION:
Article 1. The accompanying Decision promulgates the "Rules on Organization and Operation of the Safe Deposit Services Center."
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Heads of the Office, the Organization and Cadres Department, the Director of the Safekeeping Services Center, and the Heads of relevant units under the State Bank of Vietnam are responsible for implementing this Decision./.
RULES ON ORGANIZATION AND OPERATION
OF THE SAFE DEPOSIT SERVICES CENTER
(Issued together with Decision No. 1390/2005/QĐ-NHNN dated September 19, 2005
of the Governor of the State Bank)
PART I
GENERAL PROVISIONS
Article 1. The Safe Deposit Services Center (hereinafter referred to as the Center) is a public service unit under the State Bank, with the function of providing public services related to safe deposit vault security for the State Bank and supplying public services related to safe deposit vault security for organizations and individuals in accordance with the law.
Article 2. The Center has legal personality, its own bank account and seal for transactions and operations in accordance with the law, implementing the financial system of the State applicable to public service units with revenue and as prescribed by the Governor.
Article 3. The Director manages the operation of the Center; assisting the Director are several Deputy Directors. The Director and Deputy Directors of the Center are appointed by the Governor.
Chapter II
TASKS AND POWERS
Article 4. The Center has the following tasks and powers:
1. Providing public services in the field of safe deposit vault security for units within the State Bank system as follows:
a) Designing, producing specialized products for safe deposit vault security. Designing, installing, renovating, upgrading, maintaining, servicing, repairing equipment, technical systems, specialized products (locks, cash vault doors, surveillance, alarm systems for vaults and safes, fire prevention systems, and other equipment);
b) Designing, installing direct lightning protection systems and signal transmission lightning protection systems;
c) Providing other safe deposit vault security services as prescribed by law and by the Governor.
2. Providing safe deposit vault security services for organizations and individuals in accordance with the law and as prescribed by the Governor.
3. Managing finance, assets, and other resources allocated in accordance with the law and as prescribed by the Governor.
4. Implementing information reporting systems as prescribed by the State and by the Governor.
5. Performing other tasks assigned by the Governor.
Chapter III
ORGANIZATIONAL STRUCTURE AND MANAGEMENT
Article 5. The organizational structure of the Center includes:
1. Administrative-Human Resources Department;
2. Accounting-Finance Department;
3. Business Planning Department;
4. Safe Deposit Vault Security Equipment Production Workshop (referred to as the Equipment Workshop);
5. Service Supply Department.
Specific tasks and powers of the departments, divisions, and workshops are defined by the Center Director.
Article 6. Tasks and powers of the Center Director:
1. Organizing and implementing all activities of the Center as stipulated in Article 4 of these Rules and being responsible before the Governor for all activities of the Center.
2. Signing administrative documents, transaction contracts, invoices, certificates, and other papers within the functions and tasks of the Center.
3. Recruiting, utilizing, and managing officials and civil servants (referred to as staff) of the Center in accordance with State regulations and industry regulations, specifically:
a) Implementing management, job assignment, and work arrangement for Center staff in accordance with laws and delegation from the Governor;
b) Implementing recruitment and termination of employment for staff: Annually preparing a recruitment plan for review and approval by the Governor. Based on the approved recruitment plan, actual needs, and financial resources, developing a recruitment plan, deciding on recruitment methods, implementing recruitment, signing employment contracts, probation periods, and appointing staff positions, terminating employment according to current regulations;
c) Deciding on grade changes and salary increases based on years of service for staff at grades equivalent to Assistant Specialist and below. Proposing salary and grade increases, and grade-based salary changes for staff at grades equivalent to Senior Assistant Specialist and above; signing decisions on salary and grade increases for staff at grades equivalent to Assistant Specialist and below after obtaining written approval from the competent authority;
d) Appointing and dismissing leaders of units within the Center's organizational structure in accordance with Governor's regulations;
đ) Proposing the Governor to appoint, reappoint, dismiss, reward, and discipline Deputy Directors of the Center;
e) Implementing staff evaluation in accordance with State and industry regulations;
g) Implementing staff policies and systems as prescribed by the State and industry;
h) Implementing staff rewards and disciplinary measures within authority and proposing rewards and disciplinary measures for staff according to the law;
i) Implementing staff statistics and reporting requirements as prescribed by the State and industry;
k) Establishing, managing, and archiving staff files of the Center in accordance with regulations;
l) Resolving complaints and reports against staff within authority.
n) Being authorized to enter into fixed-term labor contracts for seasonal or specific tasks lasting less than twelve months in accordance with the Labor Law.
Article 7. Tasks and powers of the Deputy Director of the Center:
1. Assisting the Director in directing and managing certain aspects of Center operations as delegated by the Director and being responsible before the Director and the law for matters delegated.
2. Signing on behalf of the Director on documents and papers as delegated by the Director.
3. When the Director is absent, a Deputy Director may be authorized to manage the Center's general operations, being responsible before the Director and the law for matters resolved and reporting back when the Director returns.
Chapter IV
IMPLEMENTING PROVISIONS
Article 8. Amendments and supplements to these Rules shall be decided by the Governor./.
