CIRCULAR

Guidelines for Implementing Decree No. 56/1998/NĐ-CP of the Government

stipulating forms, subjects, and criteria for commendation and reward by the Government, Ministries, agencies at the ministerial level, agencies under the Government, People's Committees at all levels; detailing the criteria for awarding Labor Medals.

On July 30, 1998, the Government issued Decree No. 56/1998/NĐ-CP "Regulating Forms, Subjects, and Criteria for Commendation and Reward by the Government, Ministries, Agencies at the Ministerial Level, Agencies Under the Government, People's Committees at All Levels; Detailing the Criteria for Awarding Labor Medals."

To continue the tradition of the Two Excellences movement "Teaching Well, Studying Well" initiated by President Ho Chi Minh in the education sector, which has been maintained continuously since the 1961-1962 academic year to date, with the notable goal of becoming Excellent Teachers and Advanced Schools, Outstanding Advanced Schools.

To be consistent with the characteristics of teaching and learning activities in the education sector, with the agreement of the Central Steering Committee for Competitions and Rewards, and the National Institute for Competitions and Rewards as stated in Circular No. 478/BGD&ĐT/VP-TĐKT dated January 19, 1999, the Ministry of Education and Training provides specific guidelines on implementing Decree No. 56/1998/NĐ-CP of the Government in the education sector as follows:

I- SUBJECTS, FORMS OF RECOGNITION AND REWARD FOR COMPETITION AWARDS

This Circular applies to individuals and collectives within the education sector.

Based on the characteristics of teaching and learning activities in the education sector, the forms of recognition and reward for individual and collective competition awards applied in the education sector include the following titles:

The forms of recognition and reward for individual competition awards include:

- Excellent Worker.

- Model Worker at the grassroots level - Excellent Teacher at the grassroots level.

(For kindergartens, primary schools, secondary schools, high schools, vocational schools, technical training centers, and continuing education centers, it is referred to as Excellent Teacher; for colleges and universities, it is referred to as Excellent Lecturer; in this Circular, Excellent Teacher and Excellent Lecturer are collectively referred to as Excellent Teacher; Technical training centers and continuing education centers are collectively referred to as educational centers).

- Model Worker at the provincial level - Excellent Teacher at the provincial level.

- Model Worker at the central ministry level - Excellent Teacher at the central ministry level.

- National Model Worker - National Excellent Teacher.

The forms of recognition and reward for collective competition awards include:

- Excellent Working Unit - Advanced School.

- Excellent Working Unit with Distinction - Advanced School with Distinction.

The forms of recognition and reward for students and trainees are not covered in this Circular and will have separate guidance documents.

1- Title of Excellent Worker

The title of Excellent Worker is a form of recognition awarded to teachers, managers, workers, and staff working in the education sector as stipulated in Article 7 and Article 10 of Decree No. 56/1998/NĐ-CP.

2- Title of Model Worker - Title of Excellent Teacher

a- The title of Model Worker is a form of recognition awarded to managers and staff working in the education sector as stipulated in Article 7 and Article 10 of Decree No. 56/1998/NĐ-CP.

b- The title of Excellent Teacher is the Model Worker title applicable to the education sector, a form of recognition awarded to teachers and lecturers working in educational institutions and training centers; it includes three levels: grassroots, provincial-central ministry, and national; the criteria are similar to those for Model Workers as specified in Article 10 of Decree No. 56/1998/NĐ-CP, adapted specifically for the education sector.

3- Title of Excellent Working Unit - Title of Advanced School

a- The title of Excellent Working Unit is a form of recognition awarded to management units of the education sector at various levels, production and service units, small groups within schools, and small units within basic organizations of the sector as stipulated in Article 11 of Decree No. 56/1998/NĐ-CP.

b- The title of Advanced School is the Excellent Working Unit title applicable to the education sector, a form of recognition awarded to school units and educational centers; the criteria are similar to those for Excellent Working Units as specified in Article 11 of Decree No. 56/1998/NĐ-CP, adapted specifically for the education sector.

4- Title of Excellent Working Unit with Distinction - Title of Advanced School with Distinction

a- The title of Excellent Working Unit with Distinction is a form of recognition awarded to management units of the education sector at various levels, production and service units, small groups within schools, and small units within basic organizations of the sector as stipulated in Article 11 of Decree No. 56/1998/NĐ-CP.

b- The title of Advanced School with Distinction is the Excellent Working Unit with Distinction title applicable to the education sector, a form of recognition awarded to school units and educational centers; the criteria are similar to those for Excellent Working Units with Distinction as specified in Article 11 of Decree No. 56/1998/NĐ-CP, adapted specifically for the education sector.

II- CRITERIA FOR RECOGNITION AND REWARD FOR COMPETITION AWARDS

A- INDIVIDUAL COMPETITION AWARDS

1- Excellent Worker

An Excellent Worker has three criteria specified in Article 10 of Decree No. 56/1998/NĐ-CP. For implementation, Departments of Education and Training and relevant ministries with schools should develop specific content to apply these criteria to managers, teachers, and staff in the education sector.

2- Model Worker - Excellent Teacher

- Model Worker: Has three criteria specified in Article 10 of Decree No. 56/1998/NĐ-CP. For implementation, Departments of Education and Training and relevant ministries with schools should develop specific content to apply these criteria to managers, teachers, and staff in the education sector.

- Excellent Teacher: Based on the criteria for Model Workers at various levels specified in Article 10 of Decree No. 56/1998/NĐ-CP and existing criteria for Excellent Teachers, the Ministry of Education and Training will revise the criteria and procedures for selecting Excellent Teachers at various levels, report to the National Institute for Competitions and Rewards for unified implementation throughout the national education system.

B- COLLECTIVE COMPETITION AWARDS

1- Excellent Working Unit - Advanced School

B- AWARDS FOR COLLECTIVE ACHIEVEMENTS

1- Excellent Labor Collective - Advanced School

- A collective of excellent workers has three criteria specified in Article 11 of Decree 56/1998/NĐ-CP. Departments of Education and Training, ministries and sectors with schools shall develop specific content to apply these criteria to educational management agencies, production and service units within their sectors, small collectives within schools, and small collectives within basic units of the education sector.

- Advanced school: Based on the criteria for a collective of excellent workers specified in Article 11 of Decree 56/1998/NĐ-CP and the existing criteria for advanced schools, the Ministry of Education and Training will establish specific criteria and procedures for selecting advanced schools, to be reported to the State Agency for Awards and Honors for unified implementation throughout the national education system.

2- Excellent collective of workers - Outstanding advanced school

- An outstanding collective of workers has three criteria specified in Article 11 of Decree 56/1998/NĐ-CP. Departments of Education and Training, ministries and sectors with schools shall develop specific content to apply these criteria to educational management agencies, production and service units within their sectors, small collectives within schools, and small collectives within basic units of the education sector.

- Outstanding advanced school: Based on the criteria for an outstanding collective of workers specified in Article 11 of Decree 56/1998/NĐ-CP and the existing criteria for advanced schools, the Ministry of Education and Training will establish specific criteria and procedures for selecting outstanding advanced schools, to be reported to the State Agency for Awards and Honors for unified implementation throughout the national education system.

III- PROCEDURE FOR REVIEWING AND AWARDED AWARDS

1- Procedure for reviewing and awarding Excellent Worker

For educational institutions: The school's Award and Honor Council reviews, and the Principal decides to recognize.

For management agencies, production and service units: The unit's Award and Honor Council reviews, and the Unit Head decides to recognize.

2- Procedure for reviewing and awarding Model Worker - Excellent Teacher at the grassroots level

- For educational institutions under the county, district, town, city directly under province (collectively referred to as county) (kindergarten, primary school, secondary school, high school, vocational training center): The school's Award and Honor Council proposes the county Department of Education and Training's Award and Honor Council to review, and propose the People's Committee of the county or the Director of the Department of Education and Training to decide to recognize.

- For educational institutions under the provincial department (high school, college, vocational school, training center): The school's Award and Honor Council proposes the provincial Department of Education and Training's Award and Honor Council to review, and propose the Director of the Department of Education and Training to decide to recognize.

- For educational institutions under the province (university, college, political school) and production and service units of the education sector under the province: The school's Award and Honor Council and the unit's Award and Honor Council propose the provincial Department of Education and Training's Award and Honor Council to review, and propose the Provincial People's Committee to decide to recognize.

- For educational institutions and units of the education sector under the Ministry or Sector: The school's Award and Honor Council and the unit's Award and Honor Council propose the Ministry's Award and Honor Council to review, and propose the Minister to decide to recognize.

3- Procedure for reviewing and awarding Model Worker - Excellent Teacher at the provincial or ministerial level

- For educational institutions and units of the education sector managed by the province or city: The lower-level Award and Honor Council introduces, the provincial Department of Education and Training's Award and Honor Council reviews, reports to the provincial Award and Honor Council, and proposes the Chairman of the Provincial People's Committee to decide to recognize.

- For educational institutions and units of the education sector managed by the Ministry or Sector: The school's Award and Honor Council and the unit's Award and Honor Council propose the Ministry's Award and Honor Council to review, and propose the Minister to decide to recognize.

4- Procedure for reviewing and awarding Model Worker - Excellent Teacher at the national level

Provinces, cities, Ministries, and Sectors propose, the Department of Education and Training's Award and Honor Council selects, and the Minister of Education and Training submits to the Prime Minister for decision through the Central Award and Honor Council.

5- Procedure for reviewing and awarding Collective of Excellent Workers - Advanced School

- For educational institutions under the county (kindergarten, primary school, secondary school, high school, vocational training center) and small collectives within the school: The school's Award and Honor Council proposes the county Department of Education and Training's Award and Honor Council to review, and propose the People's Committee of the county or the Director of the Department of Education and Training to decide to recognize.

- For educational institutions under the provincial department (high school, college, vocational school, training center) and small collectives within the school, small collectives within basic units of the education sector: The school's Award and Honor Council proposes the provincial Department of Education and Training's Award and Honor Council to review, and the Director of the Department decides to recognize.

- For educational institutions under the province (university, college, political school) and units of the education sector under the province: The school's Award and Honor Council and the unit's Award and Honor Council propose the provincial Department of Education and Training's Award and Honor Council to review, and propose the Provincial People's Committee to decide to recognize. For small collectives within the school and within basic units, the school's Award and Honor Council and the unit's Award and Honor Council review, and the Unit Head decides to recognize.

- For educational institutions and units of the education sector under the Ministry or Sector:

The school's Award and Honor Council and the unit's Award and Honor Council propose the Ministry's Award and Honor Council to review, and propose the Minister to decide to recognize. For small collectives within the school and within basic units, the school's Award and Honor Council and the unit's Award and Honor Council review, and the Unit Head decides to recognize.

6- Procedure for examination and recognition of Outstanding Labor Collectives - Advanced Schools

- For school units, units of the Education - Training sector under provinces and cities (including small collectives within schools, at grassroots units): The Education - Training Sector's Commendation Council at the provincial level proposes to the Provincial Commendation Council for examination, and the Chairman of the Provincial People's Committee decides on recognition.

- For school units, units of the Education - Training sector under the Ministry and Industry (including small collectives within schools, at grassroots units): The School's Commendation Council, the Unit's Commendation Council propose to the Ministry's Commendation Council for examination, and recommend the Minister to decide on recognition.

IV- ESTABLISHMENT OF THE COMMENDATION COUNCILS AT ALL LEVELS

School units and educational management levels need to improve and establish regulations for operations of all levels of Commendation Councils and arrange staff to assist the Principals and Heads in commendation work.

1- Composition of the School's Commendation Council

- For kindergartens, primary schools, secondary schools, high schools, continuing education centers, technical training centers:

- Chairperson of the Commendation Council: Principal, Director, Center Manager.

- Vice-Chairperson of the Commendation Council: Trade Union President.

- Members: Deputy Principal, Deputy Director, Secretary of the Party Branch, Department Heads, Youth League Secretary, Team Leader.

- For vocational high schools, colleges, universities:

- Chairperson of the Commendation Council: Principal.

- Vice-Chairperson of the Commendation Council: Secretary of the Party Committee, Trade Union President.

- Members: Deputy Principal, Heads of Human Resources, Training, Administrative Services, Planning, Research Departments, Youth League Secretary, Permanent Commendation Council Representative.

2- Composition of the Commendation Council of National Universities, Regional Universities

- Chairperson of the Commendation Council: Director.

- Vice-Chairperson of the Commendation Council: Secretary of the Party Committee, Trade Union President.

- Members: Deputy Directors, Principals of affiliated schools, Heads of Human Resources, Training, Administrative Services, Planning, Research Departments, Youth League Secretary, Permanent Commendation Council Representative.

3- Composition of the Commendation Council of Educational Management Agencies.

- Chairperson of the Commendation Council: Agency Head.

- Vice-Chairperson of the Commendation Council: Secretary of the Agency's Party Committee, Agency Trade Union President.

- Members: Deputy Agency Head, Heads of Departments and Units under the Agency, Permanent Commendation Council Representative.

4- Composition of the Commendation Council of Production and Service Units under the Education - Training Sector.

- Chairperson of the Commendation Council: Unit Head.

- Vice-Chairperson of the Commendation Council: Secretary of the Party Committee, Trade Union President.

- Members: Deputy Unit Head, Heads of Departments and Units under the Unit, Permanent Commendation Council Representative.

V- IMPLEMENTATION OF REWARD REGIME AND REWARD FUNDS

Regarding the reward regime and reward funds according to Articles in Chapter IV of Decree No. 56/1998/ND-CP, they shall be implemented in accordance with Circular No. 24/1999/BTC-TT dated March 4, 1999 "Guidelines for Financial Management in Implementing the Reward System for Outstanding Achievements in Economic and Social Tasks and National Defense" issued by the Ministry of Finance.

VI- IMPLEMENTATION

This Circular takes effect fifteen days from the date of issuance.

The Ministry of Education and Training requests provinces, cities, ministries, industries with schools to implement this guiding circular and guide school units, education centers, and educational management levels under their jurisdiction accordingly.

 

 

During implementation, if there are difficulties, provinces, cities, ministries, industries, school units, education centers, and educational management levels should report to the Ministry of Education and Training for timely revision and supplementation.
