CIRCULAR

OF THE MINISTRY OF JUSTICE NUMBER 14/1999/TT-BTP OCTOBER 28, 1999 GUIDING ON THE SELECTION OF THE TITLE OF LABOR HERO IN THE JUSTICE SECTOR

Pursuant to Decision No. 38/1999/QĐ-TTg dated March 6, 1999 of the Prime Minister promulgating the Regulations on the objects and criteria for the title of Labor Hero of the People's Armed Forces during the period of renovation;

After exchanging with the National Institute of Encouragement and Reward, the Ministry of Justice guides on the selection of the title of Labor Hero in the justice sector as follows:

I. OBJECTS OF SELECTION FOR THE TITLE OF LABOR HERO

1. Individuals currently working in units under the Ministry of Justice, enforcement agencies, local people's courts, and the Department of Justice.

2. Collectives in the justice sector including grassroots units and small collectives under the management of the Ministry of Justice within grassroots units:

2.1. Grassroots units: the Ministry of Justice, provincial Departments of Justice, provincial People's Courts, Legal Newspaper, Hanoi Law University, School for Training Judicial Officers;

2.2. Small collectives within grassroots units are constituent units of grassroots units: Departments, Bureaus, Institutes, Journals, Inspection Office, and Offices under the Ministry; Faculties, Departments, and units under Schools; units under the Legal Newspaper; Courts and units under provincial People's Courts. Due to the specific nature of industry management, Enforcement Departments, Enforcement Teams, and district-level People's Courts are uniformly understood as small collectives of the Department of Justice.

II. STANDARDS

1. Criteria for the title of Labor Hero for individuals:

Individuals who are awarded the title of Labor Hero must meet the following criteria:

1.1. Possessing a spirit of daring to think and act, creativity in work achieving outstanding quality and effectiveness in the justice sector; being a prominent model and making significant contributions to the development of the unit, locality, justice sector, and the country;

1.2. Achieving outstanding results in scientific research or applying legal science to practical conditions; having new initiatives or valuable solutions in judicial work, or having famous legal scientific works of special value applied to judicial work yielding high efficiency;

1.3. Having high political and professional legal qualifications. Making great contributions to the training and education of colleagues and young cadres in the sector;

1.4. Demonstrating high sense of responsibility, dedication to assigned tasks, practicing thrift, integrity, impartiality, and incorruptibility. Serving as a model in complying with state policies and laws, promoting cooperative and supportive spirit; being a nucleus in building unity and consensus within the collective; being a role model in building a cultured family life.

When reviewing individual achievements, all four criteria mentioned above must be considered, none of which can be overlooked. The harmonious integration of these four criteria transforms the individual into a paragon making significant contributions to the revolutionary cause of the Party and the nation during the period of renovation.

When considering achievements for awarding the title of Labor Hero to individuals, emphasis should be placed on evaluating the depth of their achievements; paying attention to young talents who are not afraid of difficulties, dare to think and act in implementing new or key tasks, achieving particularly outstanding results, setting shining examples for cadres and civil servants in the justice sector.

2. Criteria for the title of Labor Hero for collectives:

Small collectives and grassroots units that are awarded the title of Labor Hero must meet the following criteria:

2.1. Being leading in the entire country in the justice sector regarding competition indicators, work quality and effectiveness, contributing significantly to the socio-economic development of the locality and the country;

2.2. Leading in the movement to promote innovations, improvements, and reforms in organizing and implementing judicial work;

2.3. Leading in training and improving the overall capabilities of cadres and civil servants; being a model for other collectives to follow in terms of training and enhancing professional legal knowledge;

2.4. Leading in strictly implementing Party guidelines and state policies: effectively implementing Party and state guidelines. Promoting the rights of cadres and civil servants to participate in managing the unit and implementing democratic regulations in the operation of the agency. The collective is united and consistent, with a clean and strong Party organization, a comprehensive strong administrative organization, and mass organizations within the agency. Properly managing the budget and assets entrusted, caring for the material and spiritual lives of cadres and civil servants in the unit. The collective is trusted and praised by the local authorities and people.

When reviewing collective achievements, all four criteria mentioned above must be considered, none of which can be overlooked. The harmonious integration of these four criteria transforms the collective into a leading and exemplary one in the justice sector, making significant contributions to the revolutionary cause of the Party and the nation during the period of renovation.

When considering achievements for awarding the title of Labor Hero to collectives, emphasis should be placed on evaluating the depth of their achievements; paying attention to leading collectives in organizing and implementing new or key tasks, achieving particularly outstanding results, setting shining examples for other collectives in the justice sector.

III. TIME FRAME FOR REVIEWING ACHIEVEMENTS; PROCEDURES AND DOCUMENTATION FOR SELECTION AND SUBMISSION FOR REVIEW OF THE TITLE OF LABOR HERO

1. Time frame for reviewing achievements.

The review period starts from 1986 when the Party and State initiated the renovation process until now, with a focus mainly on achievements from 1990 to early 2000.

2. Procedures and formalities for selection.

2.1. For Individuals:

- Individuals must submit a report on their achievements and undergo evaluation at the small collective level within the grassroots unit. The evaluation must be recorded in a minutes and submitted by the head of the small collective to the grassroots unit's commendation and reward council for review. Individuals who are heads of grassroots units must submit a report on their achievements and undergo evaluation at both the grassroots unit and the grassroots unit's commendation and reward council.

- When reviewing, from the Competition and Reward Council at the grassroots level to the Competition and Reward Council of the Justice Sector must ensure the principles of transparency, democracy, and secret ballot. The meeting of the Competition and Reward Council at the grassroots level must be recorded in minutes and the Head of the grassroots unit must submit a document to the Minister of Justice. For the meeting of the Competition and Reward Council of the Justice Sector, it must be recorded in minutes and there must be a document requesting the Minister of Justice to consider and submit to the Prime Minister.

2.2. For groups:

- For small groups: The Head of the small group presents the report on achievements and reviews within the small group at the grassroots unit and it must be recorded in minutes. After obtaining agreement from the small group, the Head of the small group submits to the Competition and Reward Council at the grassroots unit for consideration. During the review, the Competition and Reward Council at the grassroots unit selects openly, democratically, and through secret ballot. The meeting of the Competition and Reward Council at the grassroots unit must be recorded in minutes and the Head of the grassroots unit must submit a document to the Minister of Justice;

- For groups that are grassroots units: The Head of the grassroots unit must present the report and review within the grassroots unit and it must be recorded in minutes. After obtaining agreement from the group, the Head of the grassroots unit must submit a document to the Minister of Justice;

- When reviewing small groups and grassroots units, the Competition and Reward Council of the Justice Sector selects openly, democratically, and through secret ballot. The meeting of the Competition and Reward Council of the Justice Sector must be recorded in minutes and there must be a document requesting the Minister of Justice to consider and submit to the Prime Minister.

3. The dossier for consideration includes:

3.1. A report on work achievements of individuals and groups proposed for commendation with the title of Labor Hero, confirmed, signed, and stamped by the Head of the grassroots unit (the report on achievements of the People's Court at the provincial level and the Enforcement Team must have the agreement of the Chairman of the People's Committee at the same level);

3.2. Minutes of the meeting for review and a document proposing the title of Labor Hero for individuals and groups, confirmed, signed, and stamped by the Head of the grassroots unit;

3.3. Minutes of the meeting of the Competition and Reward Council at the grassroots unit and minutes of the meeting of the Competition and Reward Council of the Justice Sector;

3.4. A document proposing for consideration by the Head of the grassroots unit accompanied by a proposal from the Competition and Reward Council at the grassroots unit. For groups and individuals under the Ministry, the Chairman of the Competition and Reward Council of the Ministry of Justice must submit a document proposing for consideration.

In particular, for the following cases, in addition to the above documents, the dossier for consideration must also include:

- A document agreeing with the Chief Judge of the People's Court at the provincial level and the Director of the Department of Justice proposing for consideration of the People's Court at the provincial level and individuals under the People's Court at the provincial level;

- The Competition and Reward Council of the Justice Sector examines and proposes the Minister of Justice to consider for the People's Court at the provincial level, individuals under the People's Court at the provincial level; individuals and groups under the People's Court at the provincial level based on agreement with the Chief Judge of the Supreme People's Court.

Individuals and groups under local People's Courts, enforcement agencies, Directors of the Department of Justice, and Departments of Justice proposed for consideration by the Minister of Justice must have a document agreeing with the People's Committee of the province or centrally-administered city.

The dossier for consideration consists of five sets, each type of document in the dossier must be an original copy (original). Documents in the dossier for consideration must be clean, neat, without erasures or arbitrary corrections; correctly and fully recording names, date of birth, positions, administrative units.

4. Time for submitting the dossier for consideration.

The consideration and recommendation for the title of Labor Hero in the Justice Sector from now until before the Sixth National Congress of Heroes and Advanced Individuals will only be done once. Therefore, localities and units must submit the dossier for consideration to the Ministry of Justice before March 30, 2000. The Ministry of Justice will submit to the Prime Minister for consideration of individuals and groups in the Justice Sector to the State Agency for Awards and Honors before May 30, 2000 so that the Prime Minister can recommend the President to award the title of Labor Hero in the second batch on September 2, 2000. From the following years onwards, the consideration and recommendation for the title of Labor Hero will be conducted annually after achieving outstanding results.

IV. INDIVIDUALS AND GROUPS WITH OUTSTANDING ACHIEVEMENTS

Individuals and groups in the Justice Sector who achieve outstanding achievements through bravery, creativity, intelligence, and willingness to sacrifice themselves to protect the lives and property of the collective and the people; setting a bright example in their profession, should immediately establish a dossier to propose the title of Labor Hero for outstanding achievements. The procedures and dossier for consideration follow the guidelines at point 2, 3 Section III above.

This Circular takes effect fifteen days after the date of signature. Any difficulties encountered during implementation should be promptly reported to the Ministry of Justice for study and resolution.
