Pursuant to Decree No. 36/CP dated May 29, 1995 of the Government on ensuring road traffic safety and urban traffic order; Decree No. 75/1998/NĐ-CP dated September 26, 1998 of the Government amending and supplementing certain articles of Decree No. 36/CP;
At the proposal of the Minister of Public Security,
DECISION:
Article 1. Domestic delegations and foreign guests coming to Vietnam with traffic police escort vehicles shall be regulated as follows:
1. For high-ranking Party and State leaders and domestic delegations:
- The General Secretary of the Central Committee of the Communist Party of Vietnam, President, Chairman of the National Assembly, Prime Minister when visiting, working, attending commemorative ceremonies, conferences within the country and internationally organized at localities;
- Members of the Politburo, Advisors to the Central Committee of the Communist Party of Vietnam, Vice Presidents, Vice Chairmen of the National Assembly, Deputy Prime Ministers when visiting, working, attending commemorative ceremonies, conferences within the country and internationally organized at localities;
- Delegations of the Party during the National Party Congress;
- Delegations of the National Assembly during sessions of the National Assembly;
- Parade vehicles serving major national holidays or organized by provincial and municipal people's committees;
- Funeral processions organized by the State.
2. For foreign delegations invited by the Party and State:
- Heads of State;
- Heads of Government;
- Chairpersons of National Assemblies;
- Secretaries-General, Party Chairpersons, or heads of parties having relations with the Communist Party of Vietnam;
- Deputy Heads of State, Deputy Prime Ministers, Deputy Chairpersons of National Assemblies, and equivalents;
- Secretary-General and Deputy Secretary-General of the United Nations;
- Former Secretaries-General, Party Chairpersons, Heads of State, Prime Ministers;
- Heads of International Organizations;
- Ministers and equivalents;
- Key members of the Royal Family (King, Queen, Prince, Princess);
- Accredited Ambassadors presenting Letters of Credence;
- Foreign delegations participating in official activities organized by the State;
- Guests attending international conferences organized by the State.
3. In addition to the subjects specified in Clauses 1 and 2 of this Article, other cases requiring traffic police escort vehicles shall be proposed by relevant agencies and organizations in writing for consideration and decision by the Minister of Public Security.
Article 2. The implementation of traffic escort services must ensure the following principles:
Adherence to State protocol, diplomatic etiquette, and international customs and practices;
- Ensuring economy, avoiding ostentatious and wasteful displays;
- Ensuring absolute safety for Party and State leaders, domestic delegations, and foreign guests traveling smoothly and meeting requirements;
- Traffic police escort vehicles are priority vehicles; all persons and means of transport must yield according to the law;
Agencies, organizations, and provincial and municipal people's committees, when requesting traffic police escort vehicles, must promptly notify and coordinate plans so that traffic police forces can proactively implement according to the Prime Minister's regulations and the Ministry of Public Security.
Article 3. The Ministry of Public Security shall provide detailed guidance for the uniform implementation of this Decision throughout the country.
Article 4. This Decision shall take effect fifteen days from the date of signature. All previous regulations that conflict with this Decision are hereby abolished.
Article 5. Ministers of Ministries, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial and municipal people's committees are responsible for enforcing this Decision.
