Pursuant to the Government's Decree No. 88/2003/NĐ-CP dated July 30, 2003 on the organization, operation, and management of associations;
Considering the proposal of the Vietnam Jewelry Artisan Association and the Department of Non-Governmental Organizations.

Pursuant to …;

Article 1: Permitting the change of name of the Vietnam Jewelry Artisan Association to the Vietnam Gemstones and Jewelry Artisan Association and approving the amended Statutes of the Vietnam Gemstones and Jewelry Artisan Association.

Article 2: The Vietnam Gemstones and Jewelry Artisan Association shall organize and operate according to the Statutes approved by the Minister of Home Affairs and be subject to state management by the State Bank of Vietnam.

The Vietnam Gemstones and Jewelry Artisan Association shall bear its own expenses and means of operation.

Article 3: The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 4: The Chairman of the Vietnam Gemstones and Jewelry Artisan Association, the Director of the Department of Non-Governmental Organizations, and the Head of the Office of the Ministry shall be responsible for implementing this Decision./.

 

CHARTER

VIETNAM GEMSTONES AND JEWELRY ARTISAN ASSOCIATION
(Amended and supplemented)

The Vietnam Gemstones and Jewelry Artisan Association is a voluntary, non-governmental social and occupational organization of individuals and organizations engaged in jewelry, gemstone, and related crafts.

The Vietnam Gemstones and Jewelry Artisan Association was renamed from the Vietnam Jewelry Artisan Association pursuant to Decision No. 14/2004-BNV dated March 2, 2004 of the Ministry of Home Affairs.

The full name of the Association is the Vietnam Gemstones and Jewelry Artisan Association. It may also be abbreviated as the Vietnam Jewelry Artisan Association.

The international trade name in English is "Vietnam Gemstones Jewelry and Art Craft Association," abbreviated as "VGJA."

Chapter 1:

AIMS, FUNCTIONS, AND TASKS OF THE ASSOCIATION

Article 1: Aims and Objectives

The Vietnam Gemstones and Jewelry Artisan Association (hereinafter referred to as the Association) has the aim of uniting and mobilizing members and those in the same profession to enhance their skills and production efficiency, protect their legitimate rights and interests, and contribute to preserving and developing the jewelry, gemstone, and art crafts industry, thereby promoting national prosperity and social equity, democracy, and civilization.

Article 2: The Association operates throughout the country in accordance with its statutes and complies with the Constitution and laws of the Socialist Republic of Vietnam.

The Association has legal personality, its own seal, and separate bank accounts.

The central office of the Association is located in Hanoi. Representative offices and other organizations of the Association can be established in provinces, cities within the country, and abroad in accordance with state regulations.

Article 3: The Association has its own emblem which was approved at the first National Congress of the Association.

The Association has badges and membership cards. The issuance, use, and management of membership cards and badges are governed by the Association's regulations.

Article 4: Tasks and Powers of the Association

1. Building a strong organization and effective operations that bring tangible benefits to members and enhance the Association's reputation and prestige.

2. Providing advice, reviewing, and conducting social appraisals of projects related to the production and development of jewelry, gemstone, and art crafts industries when requested by the state and other economic sectors. Reflecting members' opinions and aspirations and participating in the drafting of policies and regulations related to these professions.

3. Protecting members' legitimate rights and interests. Supporting members in finding markets, partners, and loans for production and business development. Organizing and participating in domestic and international trade fairs, seminars, and tours related to jewelry, gemstone, and art crafts, as stipulated by the state.

4. Establishing and supporting schools, centers, and training facilities for employment creation in accordance with state regulations.

- Organizing specialized seminars, skill competitions, identifying and nurturing young talents, encouraging and assisting artisans and scientists in the field of jewelry, gemstone, and art crafts.

- Based on the artisan standards issued by the state, establishing the Association's "Artisan in Jewelry and Art Crafts" standard and conferring the title of Artisan on members. – vàng" của hội và xét phong tặng danh hiệu Nghệ nhân cho Hội viên.

5. Establishing production, business, consulting services, and applying science and technology in accordance with state regulations to develop the jewelry and gemstone industry; supporting members and providing funds for the Association's activities.

6. Publishing magazines, newspapers, and special issues to promote and introduce the jewelry and gemstone industry, the Association's activities, and members, as stipulated by the state. Providing information and advice on science and technology, market, trade, and legal matters related to jewelry, gemstone, and art crafts for members and interested organizations.

7. Educating about the tradition of "remembering one's roots" and love for the profession. Encouraging members to participate in traditional craft festivals and contribute to restoring and preserving historical sites and shrines dedicated to ancestors.uống nước nhớ nguồn" và lòng yêu nghề. 8. Developing cooperative relations with individuals and organizations both domestically and internationally related to the jewelry, gemstone, and art crafts industry, as stipulated by the state.

9. Regularly reporting to state management agencies on the organization and activities of the Association.

Chapter 2:

MEMBERS

Article 5: Conditions for becoming a member

Vietnamese citizens and organizations engaged in production, business, scientific research, and application of technology in the jewelry, gemstone, and art crafts industry and related fields who recognize and respect the Association's statutes and voluntarily apply to join the Association's activities can become members of the Association.

Article 6: Members

Members of the Association include:

1. Full members are Vietnamese citizens and organizations operating in the jewelry, gemstone, and art crafts industry and related fields who recognize and respect the Association's statutes and voluntarily participate in the Association's activities.

2. Supporting members are those who support the Association's aims and purposes and are willing to cooperate and assist the Association spiritually and materially.

3 . Honorary members are those who have made significant contributions and special merits to the Association and to the cause of preserving and developing the craft industries of decorative arts, jewelry, and precious stones.

1. Respect the Charter and strictly comply with all Resolutions and regulations of the Association and the law.

2. Actively participate in the activities and operations of the Association, fulfill assigned tasks well. Maintain the reputation and honor of the Association. Absolutely refrain from exploiting the name of the Association for improper purposes.

3. Foster unity and support each other in life and professional activities.

4. Regular members have the responsibility to pay membership fees fully as stipulated by the Association and financially support the Association's activities according to their capacity.

Properly keep and use membership cards and insignia of the Association as prescribed.

Article 8: Rights of members

1. Have the right to present opinions and aspirations related to policies, systems, and regulations of the state concerning the management of production, business, and development of the craft industries of decorative arts, jewelry, and precious stones to the Association.

2. Regular members have the right to discuss and vote on Association matters, to be nominated, elected, and run for positions in leadership bodies at all levels of the Association from grassroots organizations. Supporting members and honorary members enjoy the rights of regular members but cannot vote, nominate, or be elected.

3. Be protected in legitimate professional rights, enjoy benefits provided by the Association. Receive economic and scientific technological information serving professional activities, participate in skill competitions, and receive vocational training and enhancement at Association schools.. Receive support in obtaining production and business loans, seeking export markets for products.

Participate in trade fairs, seminars, occupational tourism activities, and other Association events both domestically and internationally as prescribed by the State.

4. Members meeting the criteria may be considered for the title of Artisan.

Members with outstanding achievements will be rewarded. Creative works, topics, and innovative improvements of value will be assisted by the Association in registering copyright protection.

5. Be issued membership cards, receive insignia, and participate in grassroots organization activities according to the Association's regulations. Members have the right to request withdrawal from the Association.

Article 9: Termination of Member Status

1. Members wishing to leave the Association must notify the Executive Board in writing to remove their names from the membership list.

2. Members acting against the Charter and resolutions of the Association will be disciplined or have their membership revoked.

Chapter 3:

Article 8. Principles of Organization

Article 10:

The Association operates under the principle of democracy, centralization, and unified action. Leadership bodies of the Association are elected and operate under the principle of collective leadership and individual responsibility. Voting principles at meetings and congresses follow the majority rule when more than half of the members present agree.

Article 11: The Association is organized

- The Central Association.

- Provincial Associations, city associations.

- Grassroots associations, directly affiliated associations.

Provincial and city associations are established by provincial and municipal people's committees (referred to as Provincial Associations, City Associations).

Provincial and city associations are members of the Vietnam Association of Decorative Arts, Jewelry, and Precious Stones (Central Association) and have their own charters and regulations but must not conflict with the charter and regulations of the Central Association.

Provincial and city associations have the responsibility to respect the Central Association's charter, strictly comply with resolutions and regulations, and report regularly and pay membership fees as prescribed by the Central Association.

Article 12: The organizational structure of the Association includes

- National Congress of Delegates.

- Central Executive Board of the Association.

- The Standing Committee of the Association consisting of: Chairman, Vice Chairmen (including one permanent Vice Chairman), Secretary General, and members.

- Inspection Board.

- Office, various boards, and specialized agencies.

Article 13: National Congress of Delegates

1. The highest leadership body of the Association is the National Congress of Delegates. The National Congress of Delegates has a term of five years.

In exceptional cases, extraordinary congresses can be convened if more than two-thirds of the Central Executive Board members request it.

2. The Congress has the following responsibilities.

+ Discuss and approve: Reports on the Association's activities during the term, the Central Executive Board's self-assessment report, directions, tasks, programs, and plans for the next term, reports from the Inspection Board, and the revised Charter of the Association.

+ Commend and reward units and individuals with outstanding achievements.

Elect the Central Executive Board through secret ballot or show of hands.

Article 14: Responsibilities and powers of the Central Executive Board.

1. Lead comprehensively on organizational and operational matters of the Association between two congresses.

2. Elect and dismiss the Standing Committee and the Chairman of the Association. Supplement and dismiss members of the Central Executive Board but not exceeding one-third of the number of members elected by the Congress. Such elections and dismissals are conducted when more than half of the Central Executive Board members request them, and they are carried out through secret ballot or show of hands as decided by the Central Executive Board.

3. The Central Executive Board convenes an annual meeting once a year. Extraordinary meetings are called when more than half of the members request them.

Article 15: Responsibilities and powers of the Standing Committee.

1. Elect and dismiss: Vice Chairmen (including one permanent Vice Chairman), Secretary General, Head of the Inspection Board through secret ballot or show of hands.

2. Represent the Central Executive Board in leading and directing the organizational structure and operations of the Association during the period between two Central Executive Board meetings. The Standing Committee meets every six months.

3. Issue regulations and decisions to establish various boards and affiliated organizations in accordance with the law and appoint and dismiss leaders of these units.

Article 16: Responsibilities of the Chairman, Vice Chairmen, Permanent Vice Chairman, and Secretary General.

1. Chairman of the Association: The Chairman is responsible for leading and directing all aspects of the Association's work and activities, and is the Association's account holder.

- Legal representative in internal and external relations of the Association.

2. Vice Chairmen assist the Chairman in managing specific areas of the Association's work. The permanent Vice Chairman (a full-time or part-time staff member) is responsible for handling tasks delegated by the Chairman and represents the Chairman in handling Association affairs when the Chairman is absent.

3. The General Secretary (who is a full-time or part-time staff member) is responsible for managing the central office of the Central Committee of the Association, handling daily operations of the Association, supervising and inspecting, and organizing the implementation of resolutions and regulations of the Association, preparing the agenda for meetings of the Standing Committee and the Executive Board, and performing tasks assigned by the Chairman.

Article 17: Duties and powers of the Inspection Board

 - Inspect compliance with the Charter of the Association, resolutions, and regulations of the Central Committee of the Association by members, grassroots organizations, and affiliated associations.

- Inspect the management and use of financial resources and assets of the Central Committee of the Association and its subordinate units.

- Resolve complaints and petitions related to association members and grassroots organizations within their jurisdiction and according to state laws.

- The Inspection Board has the right to request association members and organizational bodies to report on issues relevant to the inspection content upon approval by the Standing Committee.

Article 18: Professional and technical agencies of the Association

To assist the Central Committee of the Association in directing and managing and organizing the implementation of resolutions and activities of the Association, professional and technical agencies include: the Central Office of the Association, the Representative Office (Office II) in Ho Chi Minh City, various boards, professional and technical agencies, magazines, etc. These organizations operate under the direct leadership of the Standing Committee of the Association and in accordance with applicable laws.

Chapter 4:

ASSOCIATION FINANCES

Article 19: The Association's finances consist of

- Membership fees.

- Donations and sponsorships from domestic and foreign organizations and individuals as prescribed by the State.

- Income from other lawful activities.

Article 20. The Association has independent financial and asset resources. Management and utilization shall be conducted in accordance with the regulations of the Central Committee of the Association and comply with state regulations on finance and accounting.

Chapter 5:

REWARD AND DISCIPLINE

Article 21: Awards

 Members and organizations with outstanding achievements will be commended by the Association and recommended for commendation by state authorities..

Article 22: Disciplinary Measures

 Members and organizations violating the Charter, Resolutions, Regulations, and causing damage to the Association's assets, reputation, and honor shall be subject to disciplinary measures depending on the severity and nature of the violation, including:

- For members: Warning, revocation of membership status.

- For organizations: Warning, dissolution of the organization, or recommendation to the competent authority to dissolve the organization.

Chapter 6:

IMPLEMENTING PROVISIONS

Article 23:

The Central Committee of the Association is responsible for promulgating guidelines to implement the Charter of the Association.

These guidelines are considered the second most important documents after the Charter of the Association. Members and organizational bodies of the Association must respect and strictly adhere to the Charter and guidelines of the Association.

"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country.":

Only the National Congress has the authority to amend or supplement the Charter of the Association. This Charter consists of 6 chapters and 24 articles and was unanimously approved by the Third National Congress of the Vietnam Association of Arts and Crafts, Goldsmiths, and Gemstone Industry on November 12, 2003.

 The Charter takes effect upon approval by the competent state authority.
