CIRCULAR
Temporary guidance on implementing the allowance system for leadership positions in local forest rangers

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, and members of the armed forces;
After receiving the opinions of the Ministry of Home Affairs in Circular No. 3749/BNV-TL dated December 22, 2005, the Ministry of Finance in Circular No. 12782/BTC-PC dated October 10, 2005, the Ministry of Agriculture and Rural Development hereby provides temporary guidance on implementing the allowance system for leadership positions in local forest ranger agencies as follows:
I. GENERAL PROVISIONS
This Circular applies to units under the Ministry of Education and Training; departments of education and training, education and training divisions; preschool education institutions, general education institutions, regular education institutions, teacher training colleges, college of education, universities, universities, academies, other educational institutions, and related organizations and individuals (hereinafter referred to collectively as agencies and units).
This circular stipulates the coefficient for the allowance for leadership positions applicable to civil servants appointed by competent authorities to hold leadership positions in Forest Ranger District Offices in provinces and centrally-administered cities (hereinafter referred to as Forest Ranger District Offices).
2\. The coefficient for the allowance for leadership positions of Forest Ranger District Offices shall be determined based on the classification of Forest Ranger District Offices.
3\. The implementation of the allowance system for leadership positions in local forest ranger agencies shall be carried out according to the guidance provided in Circular No. 02/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs on the implementation of the allowance system for leadership positions for civil servants, public officials, and employees, and Section II of Circular No. 83/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs on amending and supplementing the promotion pay system and the allowance system for civil servants, public officials, and employees.
II\. CLASSIFICATION OF FOREST RANGER DISTRICT OFFICES
1\. Forest Ranger District Offices are classified into two categories:
Category I Forest Ranger District Office is a district office with a score of 85 points or higher.
Category II Forest Ranger District Office is a district office with a score below 85 points.
Notably, the Forest Ranger District Office of Hanoi City and the Forest Ranger District Office of Ho Chi Minh City are classified as Category I (regardless of their scores).
2\. The scoring criteria are as follows:
a\. Forest area index (accounting for 60% of the total score):
- 150,000 hectares or more earns 60 points
- Less than 150,000 hectares earns 50 points
b\. Number of management units such as Forest Ranger Stations, Forest Product Inspection Stations, and Mobile Forest Ranger Teams (accounting for 20% of the total score):
- Nine or more units earn 20 points
- Fewer than nine units earn 15 points
c\. Number of staff (accounting for 20% of the total score):
- 150 or more staff earn 20 points
- Fewer than 150 staff earn 15 points.

IV\. EFFECTIVE DATE AND IMPLEMENTATION:
1. This Circular shall take effect fifteen days after its publication in the Official Gazette.
2\. The allowance system for leadership positions of Forest Ranger District Offices stipulated in this circular shall take effect from October 1, 2004. Civil servants and employees appointed to leadership positions after October 1, 2004 shall enjoy the leadership position allowance according to the guidance provided in this circular from the date they are appointed to leadership positions by competent authorities.
3\. Provincial People's Committees shall base on the classification criteria and the coefficient for the allowance for leadership positions as guided in this circular to issue decisions on classifying subordinate Forest Ranger District Offices and determining the coefficient for the allowance for leadership positions of those offices.
4\. In the course of implementation, if there are any difficulties, the provinces and centrally-administered cities are requested to report to the Ministry of Agriculture and Rural Development for research and resolution./.
