Pursuant to the Agreement between the Ministry of Industry and Trade of the Socialist Republic of Vietnam (now the Ministry of Industry and Trade of the Socialist Republic of Vietnam) and the Ministry of Industry and Trade of the Lao People's Democratic Republic (now the Ministry of Industry and Trade of the Lao People's Democratic Republic) on goods benefiting from preferential tariff rates under the Vietnam-Laos Preferential Tariff Arrangement, signed on July 28, 2005;
Pursuant to the Agreement between the Ministry of Industry and Trade of the Socialist Republic of Vietnam and the Ministry of Industry and Trade of the Lao People's Democratic Republic on the amendment and supplementation of the Agreement between the Ministry of Industry and Trade of the Socialist Republic of Vietnam and the Ministry of Industry and Trade of the Lao People's Democratic Republic on goods benefiting from preferential tariff rates under the Vietnam-Laos Preferential Tariff Arrangement, signed on March 19, 2008;
Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Implementing the Prime Minister's directive in document number 1724/VPCP-QHQT dated March 19, 2008 regarding the signing of the preferential tariff rate agreement between Vietnam and Laos;
At the proposal of the Director of the Import-Export Department.
DECISION:
Article 1. Apply the tariff quota for the year 2008 for three groups of goods imported from Laos including: rice and paddy of all kinds, tobacco leaves and stems, motorcycle accessories, which enjoy a preferential tariff rate of 0%. The commodity codes and total quantity of the tariff quota for these groups of goods enjoying a preferential tariff rate of 0% are set out in Appendix I attached to this Decision.
Article 2. Vietnamese traders may import rice and paddy of all kinds, tobacco leaves and stems, motorcycle accessories under the tariff quota. For tobacco leaves and stems, only traders holding import permits for tobacco raw materials issued by the Ministry of Industry and Trade according to Circular No. 04/2006/TT-BTM dated April 6, 2006 of the Ministry of Industry and Trade (now the Ministry of Industry and Trade) shall be allowed to import; the quantity imported shall be deducted from the import permit for tobacco raw materials issued by the Ministry of Industry and Trade.
Article 3. Goods subject to Article 1 of this Decision must have a Certificate of Origin Form S (C/O form S) issued by the competent authority of Laos in accordance with the regulations, and be cleared through the border gates listed in Appendix II attached to this Decision. Customs procedures for importing goods shall be handled at the customs office where the import procedures are carried out according to the principle of automatic backward deduction (the total quantity of goods imported at the preferential tariff rate is deducted by the quantity of each item imported).
Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette.
