Pursuant to the Law on Inspection 2004;
Pursuant to the Government Decree No. 178/2007/NĐ-CP dated December 3, 2007 stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to the Government Decree No. 187/2007/NĐ-CP dated December 25, 2007 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
At the proposal of the Director of the Personnel Department and the Chief Inspector of the Ministry,
DECISION:
Article 1. Position and Functions
The Inspectorate under the Ministry of Information and Communications is an agency under the Ministry, performing the function of assisting the Minister in state management over inspection work; administrative inspection of agencies, units, and individuals under the Ministry; specialized inspection in the fields of press; publishing; postal services and delivery; telecommunications and internet; broadcasting and transmission; radio frequency; information technology and electronics; broadcasting and television; and national information and communication infrastructure; public services in sectors and areas within the scope of state management of the Ministry.
The Inspectorate has its own seal, separate account, and receives operational funding from the Ministry of Information and Communications; it may also allocate, establish, manage, and utilize other funds according to the provisions of the law.
Article 2. Tasks and Authorities
1. To take the lead or participate in drafting normative legal documents on inspection work; complaints and denunciations; prevention and combating corruption; administrative violations; and other relevant normative legal documents in the fields within the scope of state management of the Ministry;
2. To draft annual inspection and supervision programs and plans for the Ministry of Information and Communications, submit them to the Minister for approval, and organize their implementation;
3. To direct, guide, and inspect agencies and units under the Ministry in implementing legal regulations on inspection, complaints, and denunciations; inspection programs and plans in the fields within the scope of state management of the Ministry for the Inspectors of Bureaus and Departments;
4. To inspect and supervise the implementation of policies and laws, and the performance of agencies, units, and individuals under the Ministry;
5. To inspect and supervise the implementation of specialized legal regulations in the fields within the scope of state management of the Ministry for agencies, organizations, and individuals nationwide;
6. To inspect and supervise the implementation of international-funded programs and projects under the jurisdiction of the Ministry;
7. To inspect and supervise the implementation of duties by ministries, government agencies, and People's Committees at all levels within the scope of state management of the Ministry;
8. To inspect and supervise local authorities in the implementation of delegated management in sectors and fields within the scope of state management of the Ministry;
9. To propose competent state agencies to suspend the enforcement, revoke, or cancel regulations found to be contrary to the law through inspections; to propose amendments and supplements to inappropriate systems and policies discovered through inspection and supervision activities;
10. To propose competent authorities to stop illegal actions of agencies, organizations, and individuals when there is sufficient evidence to determine that such actions have caused damage to state interests, rights, and legitimate benefits of citizens;
11. To impose administrative penalties in accordance with the law on handling administrative violations;
12. To assist the Minister in resolving complaints and denunciations and proposals from organizations and individuals; and in preventing and combating smuggling and commercial fraud in the fields within the scope of state management of the Ministry;
13. To assist the Minister in organizing the implementation of anti-corruption measures in accordance with the law on anti-corruption;
14. To summarize practical experiences, provide guidance, and train specialized inspection skills for inspectors, specialized staff engaged in inspection work, and inspection collaborators in agencies and units under the Ministry and Departments;
15. To coordinate with law enforcement agencies and state inspection organizations to resolve cases of law violations related to information and communications;
16. To summon officials and civil servants from related agencies and units to join inspection teams;
17. To compile and report on the results of inspection work, complaint resolution, and anti-corruption efforts within the scope of the Ministry's management;
18. To manage organization, civil servants, assets, files, and documents of the unit in accordance with the law and the delegation of the Minister;
19. To perform other tasks and powers as prescribed by law or assigned by the Minister.
Article 3. Organizational Structure and Staffing
The Inspectorate of the Ministry shall have an Inspector General, Deputy Inspector Generals, and a supporting administrative apparatus.
The Inspector General is responsible to the Minister and the law for all activities of the Inspectorate of the Ministry.
Deputy Inspector Generals assist the Inspector General in directing and managing all aspects of work and are responsible to the Inspector General for assigned tasks.

- Press and Publishing Inspection Department
- Administrative and Complaint Handling Inspection Department
The staffing of the Inspectorate of the Ministry shall be established by the Inspector General and submitted to the Minister for decision.
Functions, duties, powers, and working relationships between departments of the Inspectorate shall be stipulated by the Inspector General of the Ministry.
Article 4. Effective date
This Decision shall take effect fifteen (15) days from the date of publication in the Official Gazette. Decree No. 37/2003/QĐ-BBCVT dated March 13, 2003, issued by the Minister of Posts and Telecommunications on functions, duties, powers, and organizational structure of the Inspectorate of the Posts and Telecommunications Ministry, is hereby repealed.
Article 5. Responsibilities for Implementation
The Director of the Office, Inspector General, Head of the Cadre and Civil Servant Organization Department, Heads of agencies and units under the Ministry, and related units are responsible for implementing this Decision.
