Regulations on Conditions for Operating Sports Facilities Organizing Traditional Martial Arts and Vovinam Activities

Pursuant to the Law on Physical Education and Sports No. 77/2006/QH11 dated November 29, 2006;

Pursuant to Decree No. 112/2007/NĐ-CP dated June 26, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on Physical Culture and Sports;

Article 1. Other types of artistic performances

Pursuant to Decree No. 69/2008/NĐ-CP dated May 30, 2008 of the Government on policies encouraging socialization in education, vocational training, healthcare, culture, sports, and environmental activities,

The Ministry of Culture, Sports and Tourism hereby stipulates conditions for operating sports facilities organizing traditional martial arts and Vovinam activities as follows:

Article 1. Scope of Regulation

These Circulars provide detailed regulations on conditions regarding infrastructure, equipment, and specialized staff at sports facilities organizing traditional martial arts and Vovinam activities.

Article 2. Applicability

These Circulars apply to organizations and individuals organizing traditional martial arts and Vovinam activities in Vietnam.

Article 3. Conditions Regarding Infrastructure, Equipment, and Tools

1. Infrastructure Conditions:

a) Training venues may be indoors or outdoors, with flat floors that are not slippery or deformed;

b) The floor area must ensure a minimum of 2.5 square meters per person;

c) Training venues must ensure adequate lighting and ventilation;

d) Sound and noise must not affect the surrounding environment;

e) There must be a first aid kit and initial rescue tools;

f) There must be a sanitation and parking area;

g) There must be a record book tracking trainees' participation in training, recording full name, date of birth, place of residence, and each trainee's application form;

h) There must be a program and lesson plan specific to each martial art;

i) There must be a bulletin board displaying rules including training hours and safety regulations during training;

k) Ensure operational time, security, environmental hygiene, and fire prevention according to regulations.

2. Equipment and Training Tools Used at Sports Facilities Organizing Traditional Martial Arts and Vovinam Must Meet the Following Requirements:

a) They must comply with the Competition Law of each discipline and the professional regulations issued by the Vietnam Traditional Martial Arts Federation or the Vietnam Vovinam Federation.

b) If the equipment and training tools fall under the list of crude weapons, explosives, and auxiliary tools, they must be managed and used in accordance with the laws on weapon management, explosives, and auxiliary tools.

Article 4. Conditions for Professional Staff

Sports facilities organizing traditional martial arts and Vovinam activities must have professional instructors who are coaches and guides:

1. For Coaches, the following criteria must be met:

a) Traditional Martial Arts: - Hold a certificate from the General Department of Physical Culture and Sports or the Vietnam Traditional Martial Arts Federation certifying participation in a professional traditional martial arts training course. - Hold a professional grade certificate of level 15 or higher from the Vietnam Traditional Martial Arts Federation.

b) Vovinam: - Hold a certificate from the General Department of Physical Culture and Sports or the Vietnam Vovinam Federation certifying participation in a professional Vovinam training course. - Hold a professional grade certificate of Yellow Belt Second Degree (two stripes) or higher from the Vietnam Vovinam Federation.

2. For Guides, one of the following criteria must be met:

a) Traditional Martial Arts: - Hold a certificate from the General Department of Physical Culture and Sports, the Vietnam Traditional Martial Arts Federation, or the Provincial Department of Culture, Sports and Tourism certifying participation in a professional traditional martial arts training course. - Hold a professional grade certificate of level 13 or higher from the local Traditional Martial Arts Association.

b) Vovinam: - Hold a certificate from the General Department of Physical Culture and Sports, the Vietnam Vovinam Federation, or the Provincial Department of Culture, Sports and Tourism certifying participation in a professional Vovinam training course. - Hold a professional grade certificate of Yellow Belt First Degree (one stripe) or higher from the Vietnam Vovinam Federation.

3. Each coach instructing training sessions shall not exceed 40 trainees per hour; if there are more than 40 but up to 60 trainees, an additional guide is required; if there are more than 60 but up to 80 trainees, two additional guides are required.

Article 5. Responsibilities of State Administrative Authorities with Competence

1. The General Department of Physical Education and Sports shall be responsible for guiding and inspecting the implementation of this Circular.

Clause 2. The Department of Culture, Sports and Tourism shall conduct inspections and handle, within its authority, organizations and individuals violating provisions on professional conditions when organizing Traditional Martial Arts and Vovinam activities.

3. Provincial Departments of Culture, Sports and Tourism under the central government are responsible for implementing this Circular.

Article 6. Effectiveness

This Circular takes effect from January 1, 2012. During implementation, if any difficulties arise, organizations and individuals are requested to promptly report them to the Ministry of Culture, Sports and Tourism for study and timely resolution.
