Pursuant to the Law on Organization of the Government dated December 25, 2001;

At the proposal of the Minister of Home Affairs and the Minister of Finance;

The Government issues this Decree to amend Article 7 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, public officials, and armed forces personnel and Section I of the Table of Position Allowances (election, appointment) in state agencies, public service units, and agencies under the People's Army and the People's Public Security.

Article 1. Amend Point b, Clause 2, Article 7 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, public officials, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP) as follows:

"Cadres, civil servants, and public officials who have received retirement notification according to State regulations, have completed assigned tasks, have not been classified at the highest grade level within their rank or position, and have not met the required time period to be eligible for regular promotion at the time of receiving the retirement notification shall be promoted one grade earlier than the time specified in Points a and b, Clause 1, of this Article."

Article 2. Amend Section I of the Table of Position Allowances (election, appointment) in state agencies, public service units, and agencies under the People's Army and the People's Public Security accompanying Decree No. 204/2004/NĐ-CP as follows:

1. Amend the coefficient of position allowance for the position of Chairman of the People's Committee of provinces and centrally-administered cities (except Hanoi and Ho Chi Minh City) as stipulated in Point 1, Clause 7, Section I of the Table of Position Allowances (election, appointment) in state agencies, public service units, and agencies under the People's Army and the People's Public Security accompanying Decree No. 204/2004/NĐ-CP as follows:

2. Amend Clause 10, Section I of the Table of Position Allowances (election, appointment) in state agencies, public service units, and agencies under the People's Army and the People's Public Security accompanying Decree No. 204/2004/NĐ-CP as follows:

Article 3. Effectiveness

1. This Decree takes effect from May 1, 2012.

2. The position allowance regulations set forth in Article 2 of this Decree shall be applied from January 1, 2011.

Article 4. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree.
