Pursuant to the Labor Code 2012;

Pursuant to the Civil Aviation Law of Vietnam 2006;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport issues this Circular amending and supplementing Article 14.010 Chapter B Part 14 of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011 of the Minister of Transport.

Amending and supplementing Article 14.010 Chapter B Part 14 of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operation issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011 of the Minister of Transport as follows:

"14.010 AGE LIMITS FOR PILOTS

Article 1. 1. Aircraft operators when participating in commercial aircraft operations for aircraft with a maximum take-off weight over 5,700 kg shall not use pilots over 65 years old for men and over 60 years old for women as PIC or F/O.

2. Pilots when participating in commercial aircraft operations to serve as PIC or F/O for aircraft with a maximum take-off weight over 5,700 kg shall not exceed 65 years old for men and 60 years old for women.

3. Pilots aged from 65 years old for men and from 55 to 60 years old for women when participating in commercial aircraft operations must fly alongside other members under 60 years old for men or under 55 years old for women.

4. When using pilots aged 60 years or older for men and 55 years or older for women, aircraft operators shall be responsible for:

a) Establishing a recruitment committee to assess compliance with the conditions stipulated in Appendix 1 of the Chicago Convention;

b) Requiring pilots to ensure health standards for aviation personnel as prescribed by law."

This Circular takes effect from July 1, 2014.

The Head of the Office, the Inspector General, the Heads of Departments, the Director of the Civil Aviation Authority of Vietnam, Deputy Ministers, relevant organizations, and individuals are responsible for implementing this Circular.

Article 2. This Circular takes effect from July 1, 2014.

Article 3. The Director of the Office, the Inspector General, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, Deputy Ministers of relevant agencies, organizations, and individuals concerned are responsible for implementing this Circular.
