CIRCULAR
Amending and supplementing certain articles of Circular No. 26/2014/TT-BCT dated August 28, 2014 of the Minister of Industry and Trade on the organization of selecting outstanding rural industrial productsPursuant to Decree No. 45/2012/NĐ-CP dated May 21, 2012 of the Government on promoting industry; The Minister of Industry and Trade issues this Circular amending and supplementing certain articles of Circular No. 26/2014/TT-BCT dated August 28, 2014 of the Minister of Industry and Trade on the organization of selecting outstanding rural industrial products.

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Article 1. Amending and supplementing certain articles of Circular No. 26/2014/TT-BCT dated August 28, 2014 of the Minister of Industry and Trade on the organization of selecting outstanding rural industrial products
PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE LOCAL INDUSTRY DEPARTMENT
1. Clause 2 of Article 3 shall be amended as follows:
"2. A set of products is a collection of products produced by the same rural industrial establishment, used together to enhance their effectiveness and aesthetic value, and falls under one of the following cases:
a) Products with the same functions and purposes, made from the same raw materials or materials but different in design and appearance;
b) Products with the same design and appearance and functions and purposes, made from different raw materials or materials."
2. Clause 3, Clause 4, and Clause 5 shall be added to Article 3 as follows:
is a certified copy from the original book or a certified copy from the original document or an uncertified copy (without certification) presented along with the original for verification.
Electronic dossier
"3. Certified copy is a collection of electronic documents of the registration dossier for participating in the selection of outstanding rural industrial products, created online or scanned in a computer data format and accurately and completely reflecting the content of the document through database software.
4. Creating an electronic dossier is the application of information technology to link electronic documents formed during the process of compiling and reviewing the registration dossiers for participating in the selection of products by rural industrial establishments.
5. 3. Clause 3 of Article 4 shall be amended as follows: "3. Products participating in the selection must not violate regulations on intellectual property rights, industrial property rights, and other relevant regulations concerning quality standards, safety and labor hygiene, food safety, and environmental protection."
4. Clause 3 of Article 6 shall be amended as follows:
"3. A rural industrial establishment may register to participate in the selection for one or more products. Outstanding rural industrial products (at various levels) can be registered to participate in multiple selection rounds. The selection process shall be carried out according to the procedures stipulated in this Circular."
5. Clause 1 and Clause 2 of Article 10 shall be amended as follows:
"1. The Selection Councils at all levels have the responsibility to establish the Jury Board and the Technical Assistance Team; organize the selection of outstanding rural industrial products at the corresponding level; propose and submit the results of the selection for approval by the competent authority; decide on the recognition and issuance of certificates for outstanding rural industrial products (hereinafter referred to as Certificates).
2. The Selection Councils at the district, provincial, and regional levels are responsible for selecting and compiling lists of the most outstanding rural industrial products at the corresponding level to propose and submit for approval by the People's Committee of the district, the People's Committee of the province, or the Department of Industry and Trade to register for participation in higher-level selections."
6. Clause 1 of Article 12 shall be amended and supplemented as follows:
"1. Dossier for registering for selection at the district level:
Rural industrial establishments shall submit two (2) sets of dossiers (including an electronic dossier) to the Selection Council (either directly or via postal service) when registering to participate in the selection. The dossier will be used for all levels of selection. The dossier includes:
a) Registration form for participating in the selection of products by rural industrial establishments (according to the model attached to this Circular) accompanied by a valid copy of one of the following documents: Certificate of Enterprise Registration, Business Registration Certificate, Cooperative Registration Certificate, Household Business Registration Certificate, or other documents with equivalent legal validity;
b) Description and introduction of the product being selected (according to the model attached to this Circular) accompanied by a minimum of three (3) color photographs, size (10 x 15) cm of the product taken from different angles (minimum at front, side, top views);
c) Valid copies of other relevant documents related to the product (if any), such as: Quality standard certification for the product; certificate of food safety conditions; awards and commendations for the product and other related documents."
7. Clause 1 and Clause 2 of Article 13 shall be amended and supplemented as follows:
"1. Dossiers for selecting outstanding rural industrial products at the district level shall be retained by the unit decided by the People's Committee of the district; at the provincial level, they shall be retained by the Department of Industry and Trade; at the regional and national levels, they shall be retained by the Department of Industry and Trade.
2. The retention period for dossiers at all levels shall be implemented in accordance with the laws on archiving."
8. Point a of Clause 1 of Article 14 shall be amended as follows:
"a) At the district and provincial levels, it shall be organized every two years. In other cases, it shall be decided by the competent authority."
9. Point a of Clause 2 of Article 14 shall be amended as follows:
"a) At the regional and national levels, it shall be organized every two years; the national level shall be held immediately after the regional level selection year. In other cases, it shall be decided by the Minister of Industry and Trade."
10. Clause 3 of Article 17 shall be amended as follows:
"3. The Certificate for outstanding rural industrial products is valid from the date of issuance until December 31 of the fourth year (the first year being the year the rural industrial establishment has the product issued the Certificate)."
11. Clause 3 and Clause 4 of Article 21 shall be amended and supplemented as follows:
"3. To be provided with information and advisory guidance on accessing preferential policies and support from the State; advisory services for project development to expand production and develop outstanding rural industrial products."
11. Clause 3, Clause 4 of Article 21 shall be amended and supplemented as follows:
"3. To be provided with information and advisory guidance on accessing preferential policies and support from the State; to be advised on establishing investment projects for expanding production and developing outstanding rural industrial products.
4. Be prioritized for examination and support from national and local craft promotion funds to: vocational training and skill transmission; enhance management capacity; develop business strategies and marketing plans; establish technical demonstration models, transfer technology, and apply advanced and progressive scientific and technological machinery in production; participate in trade fairs, exhibitions, trade promotions, and product introductions; build and register trademarks; establish electronic information websites (websites) for the establishment and other priority support contents for the development of outstanding rural industrial products as prescribed in Decree No. 45/2012/NĐ-CP.
12. Point b Clause 5 Article 21 shall be amended as follows:
"b) At the central level: Information about outstanding rural industrial products can be published on communication media such as the Ministry of Industry and Trade's electronic portal, the Local Industry and Trade Department's electronic portal, and other communication media as prescribed."
13. Point b Clause 1 Article 23 shall be amended as follows:
"b) Develop a plan to organize the selection of outstanding rural industrial products at the national level, submit it to the Minister of Industry and Trade for approval, and implement it."
14. Add point đ to Clause 1 Article 23 as follows:
"đ) Implement the application of information technology, establish a database on outstanding rural industrial products; collect, manage, and guide localities in exploiting and using the database on outstanding rural industrial products."
15. Point a Clause 2 Article 23 shall be amended and supplemented as follows:
"a) The Department of Industry and Trade shall assist the provincial People's Committee in guiding the implementation of this Circular at the local level; coordinate with the Local Industry and Trade Department to organize the selection of outstanding rural industrial products at the regional and national levels according to the program and plan."
16. Add points h and i to Clause 2 Article 23 as follows:
"h) Summarize and monitor registration files for the selection of outstanding rural industrial products at the district and provincial levels; create and update electronic registration files for the selection of outstanding rural industrial products at the provincial level into the database on outstanding rural industrial products, and simultaneously send the registration for the regional level;
i) Coordinate with the Local Industry and Trade Department to review and provide comments on the list of outstanding rural industrial products proposed by the regional selection council for registration to participate in the national selection."
17. Point a Clause 3 Article 23 shall be amended and supplemented as follows:
"a) Develop a plan and organize the selection of outstanding rural industrial products at the district level in accordance with the approved overall plan; create electronic registration files for the selection of outstanding rural industrial products at the district level, update them into the database on outstanding rural industrial products, and simultaneously send the registration for the provincial level."
18. Replace Appendix No. 1 and Appendix No. 2 issued together with Circular No. 26/2014/TT-BCT with Appendices No. 1 and No. 2 issued together with this Circular.
Article 2. Abolition and change of wording
1. Abolish the provision that "Rural industrial establishments, agencies, and units prepare one set of files when registering to participate in the selection and send them to the Selection Council, with specific details." in Article 12 of Circular No. 26/2014/TT-BCT.
2. Replace the term "Local Industry Department" with the term "Local Industry and Trade Department" in point c Clause 1 Article 3; point c Clause 1 Article 8; point a, point b Clause 3, point b Clause 4 Article 9; point c Clause 4 Article 12; Clause 2 Article 17; point a Clause 1, point g Clause 2 Article 23; Clause 1 Article 24; Model No. 3 of Appendix No. 6 issued together with Circular No. 26/2014/TT-BCT.
Article 3. Effectiveness and Implementation
1. This Circular takes effect from August 16, 2018.
2. In cases where the legal documents referred to for application in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replaced documents.
3. During the implementation of this Circular, if there are difficulties or obstacles, organizations and individuals should reflect them to the Ministry of Industry and Trade (through the Local Industry and Trade Department) for guidance./.
