Issuing List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Agriculture and Rural Development

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality; Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality;

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

WHEREAS Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amends and supplements some articles of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality;The Minister of Agriculture and Rural Development issues this Circular promulgating the List of products and goods that have the potential to cause safety hazards under the management responsibility of the Ministry of Agriculture and Rural Development.

1. This Circular takes effect from February 3, 2022.

The List of products and goods that have the potential to cause safety hazards under the management responsibility of the Ministry of Agriculture and Rural Development is set out in the annex attached hereto.

This Circular replaces Circular No. 28/2017/TT-BNNPTNT dated December 25, 2017 of the Minister of Agriculture and Rural Development on the List of products and goods that have the potential to cause safety hazards under the management responsibility of the Ministry of Agriculture and Rural Development.

Article 2. Implementation

1. This Circular shall take effect from January 1, 2019.

3. For products and goods that do not yet have National Technical Regulations or National Standards, inspection shall be carried out according to the self-declared basic standards applied by the entity until such time as National Technical Regulations or National Standards are issued and take effect, not exceeding twelve months from the date this Circular takes effect. In cases where the legal documents, standards, and regulations referred to and applied in this Circular are amended, supplemented, or replaced by corresponding new documents, they shall be implemented in accordance with those new documents.

4. During the course of implementation, if there are any difficulties, agencies, organizations, and individuals shall promptly report them to the Ministry of Agriculture and Rural Development for consideration and amendment.
