The Prime Minister issues this Decision on construction, management, exploitation of Legal Bookshelves.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Decision stipulates the construction, management, exploitation of the National Electronic Legal Bookshelf; Legal Bookshelves at particularly difficult communes, border communes, safe area communes, particularly difficult coastal and island communes, and communes in poor districts (hereinafter referred to collectively as particularly difficult communes), and Legal Bookshelves at agencies and units of the People's Armed Forces.
2. Construction, management, exploitation of Legal Bookshelves not falling under the case prescribed in Clause 1 of Article 1 of this Decision shall be implemented in accordance with Clause 2 of Article 15 of this Decision.
3. This Decision applies to agencies, organizations, and individuals responsible for constructing, managing, exploiting, and using Legal Bookshelves.
Article 2. Interpretation of Terms
1. A Legal Bookshelf is a place for storing and managing books, newspapers, legal documents to serve the needs of research, study, understanding policies and laws, disseminating and educating about laws, accessing legal information, and grassroots mediation of agencies, organizations, and individuals.
2. The National Electronic Legal Bookshelf is a Legal Bookshelf where books and legal documents are stored and managed in digital form and accessed through computers, electronic devices, and telecommunications networks to serve agencies, organizations, and individuals nationwide.
3. The Legal Bookshelf at particularly difficult communes is a Legal Bookshelf where parts of books and legal documents are stored and managed in paper form and other carriers of information to serve cadres, civil servants, staff working in political organizations, political-social organizations, self-governing organizations at the grassroots level, and the people in the locality.
4. The Legal Bookshelf at agencies and units of the People's Armed Forces is a Legal Bookshelf where parts of books and legal documents are stored and managed in paper form and other carriers of information to serve cadres, civil servants, officials, non-commissioned officers, professional soldiers, soldiers, and workers in the People's Armed Forces.
Article 3. Principles of construction, management, exploitation of Legal Bookshelves
1. Construction, management, exploitation of Legal Bookshelves must be appropriate to the requirements of each locality, agency, unit, and the needs of users for accessing books and legal documents.
2. Construction, management, exploitation of the National Electronic Legal Bookshelf must be linked to the goals and roadmap for building an e-Government; ensuring continuous and long-term maintenance and exploitation of centralized books and legal documents; maximizing the use of existing information technology infrastructure; linking and extracting from databases on laws, information, dissemination, and education about laws.
3. Strengthening, innovating, and enhancing the effectiveness of operations of Legal Bookshelves at particularly difficult communes to widely meet the needs of grassroots-level information search and exploitation; unifying the management and exploitation of books and legal documents of Legal Bookshelves and those of communal libraries, communal post and culture centers, and community learning centers currently available in the locality.
4. The State prioritizes the distribution and provision of books and legal documents for Legal Bookshelves at particularly difficult communes to ensure citizens' right to access legal information.
Article 4. Budget for Construction and Management of Legal Bookshelves
1. The budget for construction and management of Legal Bookshelves shall be guaranteed from the state budget and allocated within the annual regular expenditure budget assigned to agencies, units, localities, and other lawful sources (if any). The preparation, execution, and settlement of the budget shall comply with the laws on the state budget.
2. The budget for construction and operation of the National Electronic Legal Bookshelf shall be allocated from the state budget and other lawful sources as prescribed. The budget for construction and operation of the National Electronic Legal Bookshelf shall be integrated into the budget for maintaining the current system of regulatory legal documents and the budget for implementing programs and projects related to the application of information technology in legal dissemination and education. The content and level of expenditure for the National Electronic Legal Bookshelf shall be implemented according to the current regulations of the Minister of Finance.
3. The minimum annual budget standard for each Legal Bookshelf at particularly difficult communes and units of the People's Armed Forces is three million VND (three million dong), and it shall be implemented as follows:
a) The budget for construction and management of Legal Bookshelves at particularly difficult communes shall be guaranteed by the local budget; provincial and district budgets are encouraged to support the construction and supplementation of books, newspapers, and legal materials for Legal Bookshelves. For provinces and centrally-administered cities that can balance their budgets, they shall use local budget revenues to fund the construction and management of Legal Bookshelves. For provinces that cannot balance their budgets, the central government budget shall provide financial support for the construction and management of Legal Bookshelves from the central government budget allocated for supporting localities.
b) The budget for construction and management of Legal Bookshelves at units of the People's Armed Forces shall be included in the annual budget of the managing unit according to the laws on the state budget.
c) The budget for construction and management of Legal Bookshelves shall be allocated for reviewing, digitizing, systematizing, purchasing, and supplementing books, newspapers, and legal materials; organizing circulation and exploitation of books and legal materials, and other contents as prescribed by law.
4. It is encouraged for domestic and foreign organizations and individuals to participate in contributing and sponsoring funds, books, and materials for the construction, management, and exploitation of Legal Bookshelves; constructing, managing, contributing, and expanding self-managed Legal Bookshelves in communities.
Chapter II
NATIONAL ELECTRONIC LEGAL BOOKSHELF
Article 5. Requirements for Construction and Exploitation of the National Electronic Legal Bookshelf
1. Compliance with technical standards, technological norms, and ensuring maximum utilization of existing information technology infrastructure.
2. Ensuring linkage, extraction, and sharing of information and materials with appropriate information databases to effectively diversify and economize on information.
3. Digitization and updating of existing paper-based legal books and materials combined with equipping and supplementing new legal books and materials, ensuring diversity and richness, timely meeting the exploitation needs of agencies, organizations, and individuals.
4. Designing the structure of the National Electronic Legal Bookshelf must ensure expandability and development.
5. Protecting and respecting copyright, intellectual property rights, and ensuring cybersecurity as prescribed by law.
Article 6. Construction of the National Electronic Legal Bookshelf
1. The National Electronic Legal Bookshelf shall be constructed and managed uniformly by the Ministry of Justice, operated, exploited, and used nationwide in accordance with the direction of integration with the electronic portal of the Ministry of Justice, ensuring convenience and meeting the requirements for accessing information and disseminating legal education to individuals and organizations.
2. The National Electronic Legal Bookshelf shall contain component data on books and legal documents updated and managed by ministries, ministerial-level agencies, government-affiliated agencies, other state agencies at the central level (including: the Supreme People's Court, the Supreme People's Procuracy, the State Audit Agency), provincial people's committees, and municipal people's committees directly under the central government (hereinafter referred to collectively as provincial level) based on assigned accounts and management permissions.
3. Activities of the National Electronic Legal Bookshelf
a) Updating and exploiting component data on books and legal documents divided according to the management fields of ministries, ministerial-level agencies, government-affiliated agencies, other state agencies at the central level, and provincial-level people's committees.
b) Providing information and introducing the content of books and legal documents.
c) Informing and introducing activities related to the construction, management, and exploitation of the National Electronic Legal Bookshelf.
4. Types of books and legal documents in the National Electronic Legal Bookshelf
a) Documents and outlines introducing laws and ordinances.
b) Books and documents answering questions, commenting, explaining, and guiding laws; pamphlets, short stories, and legal tales.
c) Books and documents guiding specialized and vocational matters in the management fields of ministries, ministerial-level agencies, government-affiliated agencies, other state agencies at the central level, and provincial-level people's committees.
d) Regulatory legal documents linked and extracted from the National Legal Database, the Vietnam Socialist Republic Electronic Gazette, the Electronic Codex Portal, press releases regarding regulatory legal documents issued by the Government.
đ) Other necessary books and legal documents suitable for user exploitation needs.
Article 7. Issuance of Accounts and Allocation of Management Permissions for Component Data of the National Electronic Legal Bookshelf
1. The Ministry of Justice shall uniformly manage the National Electronic Legal Bookshelf, issue management accounts and allocate management permissions for component data on books and legal documents for ministries, ministerial-level agencies, government-affiliated agencies, other state agencies at the central level, and provincial-level people's committees to update and manage according to their assigned functions and tasks.
2. The operation, maintenance, monitoring, upgrading, development, and security assurance of the National Electronic Legal Bookshelf; inspection of the management of the National Electronic Legal Bookshelf shall be carried out in accordance with regulations on managing electronic information and data.
Article 8. Updating and Exploiting Books and Legal Documents
1. Books and legal documents updated on the component data of the National Electronic Legal Bookshelf must be appropriate, practical, ensure quality, and not contain content within the scope of state secrets.
2. Books and legal documents updated on the component data of the National Electronic Legal Bookshelf shall be searchable and exploitable free of charge and must meet the following requirements:
a) For unpublished books and legal documents, the head of the agency or unit primarily responsible for compiling them must confirm and approve the content before updating.
b) For books and legal documents published in paper or electronic form, the published version of the book or legal document must be updated.
c) For books and legal documents with copyright, they must comply with intellectual property law provisions; books and legal documents updated on the National Electronic Legal Bookshelf must include information about the name of the book or legal document; the agency, organization, or individual primarily responsible for compiling it; the date of issuance and validity of the document; and introduce the purpose and main content of the book or legal document.
3. Responsibility for updating books and legal documents
a) The Minister, the head of a ministerial-level agency, a government-affiliated agency, or another state agency at the central level shall be responsible for organizing the updating of books and legal documents compiled primarily by their agency and subordinate units.
b) The Chairman of the provincial-level people's committee shall be responsible for organizing the updating of books and legal documents compiled primarily by the provincial-level people's committee and its affiliated specialized agencies.
c) Those authorized persons specified in points a and b of this clause shall be responsible for assigning a specialized agency or unit under their jurisdiction to carry out the updating of books and legal documents and manage component data according to their management functions and tasks and the provisions of this Decision.
4. Process for updating books and legal documents
a) Review and use published books and legal documents or those approved by authorized persons.
b) Check and compare digitized books and legal documents with the original published or approved versions.
c) Implement updates and post information along with formatted books and legal documents according to the provisions within the component data of the National Electronic Legal Bookshelf.
d) Approve and post books and legal documents on the component data of the National Electronic Legal Bookshelf.
Chapter III
LEGAL BOOKSHELVES AT REMOTE AND DIFFICULT AREAS, AGENCIES, AND UNITS OF THE PEOPLE'S ARMED FORCES
Article 9. Requirements for construction, management, and utilization of Legal Bookcases
1. The location where the Legal Bookcase is placed must be convenient for utilization and use; reading rooms should be arranged and organized to facilitate on-site reading.
2. Regularly review and classify books and materials scientifically to ensure easy access; select high-quality and valuable legal books and materials to supplement and equip according to a regular schedule, suitable to regional conditions, characteristics, agencies, and units.
3. Uniformly manage and utilize books and materials of the Legal Bookcase with those of the communal library, post office-culture centers, and community learning centers in particularly difficult communes.
4. Construction and maintenance of Legal Bookcases at agencies and units of the People's Armed Forces shall be carried out in accordance with the provisions of Clause 1 and Clause 2 of this Article and the requirements of each agency and unit.
Article 10. Construction of Legal Bookcases
1. Establishment of Legal Bookcases
a) The Chairman of the People's Committee of particularly difficult communes and the Heads of agencies and units of the People's Armed Forces issue decisions to establish Legal Bookcases. Such decisions must specify the location of the Legal Bookcase; the person responsible and their duties and powers; the scope and target audience; operational rules and operating costs of the Legal Bookcase.
b) The Chairman of the Provincial People's Committee directs the unified management and utilization of books and materials of the Legal Bookcase and legal books and materials of the communal library, post office-culture centers, and community learning centers in line with local realities. Based on the opinions of the Prime Minister and the Central Party Committee Secretariat as stipulated in Point d, Clause 1 of Article 14 of this Decision, the Chairman of the Provincial People's Committee manages books and materials of the Legal Bookcase and legal books and materials of the project to equip books for commune, ward, and town bases.
2. Location of Legal Bookcases
a) Legal Bookcases in particularly difficult communes are located at the People's Committee headquarters or other suitable places based on the decision of the Chairman of the People's Committee.
b) Legal Bookcases at agencies and units of the People's Armed Forces are located at places convenient for management and utilization based on the decision of the Head of the agency or unit of the People's Armed Forces.
3. Types of legal books, newspapers, and materials of the Legal Bookcase are selected to suit the nature, functions, and tasks of particularly difficult commune authorities, agencies and units of the People's Armed Forces, and specific service targets, including the following types:
a) Books and materials specified in Point a and Point b, Clause 4, Article 6 of this Decision; books and materials guiding administrative cooperation, administrative, and judicial work at the grassroots level for Legal Bookcases in particularly difficult communes; books and materials serving management, professional guidance, teaching, and learning activities for Legal Bookcases at agencies and units of the People's Armed Forces. Legal Bookcases in particularly difficult communes of ethnic minority areas also include books and materials in ethnic minority languages.
b) Legal books and materials provided to communal libraries, post office-culture centers, and community learning centers within the area (if applicable); legal books and materials of the project to equip books for commune, ward, and town bases as directed by the Prime Minister and the Central Party Committee Secretariat in Point d, Clause 1, Article 14 of this Decision.
c) Legal books and materials as guided by the Chairman of the Provincial People's Committee.
4. Supplementing legal books, newspapers, and materials for Legal Bookcases
Based on the list of legal books and materials prescribed by the Ministry of Justice, Legal Bookcases in particularly difficult communes and agencies and units of the People's Armed Forces need to promptly supplement new legal books and materials; regularly review, update, and systematize legal books and materials.
Article 11. Management of the Legal Bookcase
1. Books, newspapers, and legal documents must be registered, stored, managed, and used in accordance with the laws on state assets.
2. Persons who lose or damage books, newspapers, or legal documents shall compensate according to the regulations.
Article 12. Utilization of the Legal Bookcase
1. Internal rules for the operation of the Legal Bookcase
a) The internal rules for the operation of the Legal Bookcase specify the operating hours, service methods; responsibilities of the person in charge of the Legal Bookcase; borrowing conditions and procedures; responsibilities for preservation and compensation for losses caused by readers or borrowers when they lose or damage books, newspapers, or legal documents, and other relevant contents.
b) The internal rules for the operation of the Legal Bookcase must be posted at the location where the Legal Bookcase is placed.
2. Service Hours
The Legal Bookcase operates daily during the working hours of the People's Committee of the commune, agency, or unit of the People's Armed Forces. In cases of service outside working hours, the Chairman of the People's Committee of the commune with special difficulties, or the Head of the agency or unit of the People's Armed Forces shall clearly stipulate the days and times for serving readers.
3. Service Forms
The Legal Bookcase provides services through on-site reading or lending.
4. Measures to Enhance Efficiency in Utilization and Use
a) The Legal Bookcase regularly informs and promotes about the Legal Bookcase; mobilizes and introduces cadres, civil servants, and the people to study, read, and borrow books, newspapers, and legal documents.
b) Timely announces the content of new books, newspapers, and legal documents on bulletin boards, information stations, public address systems, and electronic news pages to facilitate readers' access to and understanding of books, newspapers, and legal documents from the Legal Bookcase.
c) Organizes exhibitions and introductions of books and legal documents during Vietnam Book Day, National Law Day, club activities, legal knowledge contests, or other events to enhance the efficiency of utilizing the Legal Bookcase.
d) Implements exchanges and rotations of books and legal documents between the Legal Bookcase and self-managed bookcases in the community and other grassroots cultural and information facilities within the area.
đ) Other appropriate measures that comply with the requirements, tasks, and actual conditions of the commune, agency, or unit of the People's Armed Forces, and do not contravene the provisions of the law.
Article 13. Person in Charge of the Legal Bookcase
1. The person in charge of the Legal Bookcase in communes with special difficulties is assigned and appointed by the Chairman of the People's Committee of the commune from among the specialized civil servants of the People's Committee of the commune, ensuring suitability with the actual conditions of the locality and meeting the management and utilization requirements of the Legal Bookcase.
2. The person in charge of the Legal Bookcase in agencies or units of the People's Armed Forces is assigned and appointed by the Head of the agency or unit in accordance with the requirements of the unit.
3. Duties of the person in charge of the Legal Bookcase
a) Prepare the budget for constructing, managing, and utilizing the Legal Bookcase in accordance with Article 4 of this Decision and other financial regulations; implement after approval.
b) Develop the internal rules for the operation of the Legal Bookcase for approval by the Chairman of the People's Committee of the commune, the Head, or the head of the agency or unit of the People's Armed Forces.
c) Preserve books, newspapers, and legal documents in accordance with the regulations for state assets; lend out and guide the use of books, newspapers, and legal documents; monitor borrowing, returning, and rotation of books, newspapers, and legal documents.
d) Conduct annual inventory of books, newspapers, and legal documents; prepare six-monthly, annual, or ad hoc reports on the situation of constructing, managing, and utilizing the Legal Bookcase.
đ) Propose to the Chairman of the People's Committee of the commune to organize the rotation of books and legal documents between the Legal Bookcase and self-managed bookcases in the community and other grassroots cultural and information facilities within the area; propose handling of old, damaged books, newspapers, and legal documents; implement measures to enhance the efficiency of utilizing the Legal Bookcase as stipulated in Clause 4, Article 12 of this Decision.
4. Benefits of the person in charge of the Legal Bookcase
a) Receive training and guidance on the business of constructing, managing, and utilizing the Legal Bookcase and legal knowledge.
b) Be rewarded by competent authorities in accordance with the law for outstanding achievements in constructing, managing, and utilizing the Legal Bookcase and promoting and educating the law.
c) Other benefits as prescribed by law.
Chapter IV
IMPLEMENTATION
Article 14. Responsibilities to implement
1. Ministry of Justice
a) Take the lead and coordinate with relevant agencies and organizations to assist the Prime Minister in directing, guiding, and organizing the implementation of this Decision throughout the country.
b) Take the lead in guiding the business of building, managing, and utilizing the Legal Bookcase; compiling books and legal materials for the Legal Bookcase; organizing training on the business of building, managing, and utilizing the Legal Bookcase.
c) Take the lead and coordinate with the Ministry of Culture, Sports and Tourism, the Ministry of Information and Communications, the Ministry of Education and Training, and related units to direct and guide the unified management and utilization of books and materials from the Legal Bookcase with those of village libraries, postal and cultural centers, and community learning centers within their jurisdiction; monitor the distribution of free legal books and materials to the Legal Bookcase within their jurisdiction.
d) Take the lead and coordinate with the Central Propaganda Department, the National Political Publishing House, and related agencies and organizations to study and report to the Prime Minister and the Central Party Secretariat on the unified management and utilization of legal books and materials under the Project of equipping books for communal, ward, and town bases with the Legal Bookcase.
đ) Build, manage, guide the exploitation and use of the National Electronic Legal Bookcase to ensure connectivity and interoperability with related databases on legal dissemination and education; update legal books and materials on the component data of the National Electronic Legal Bookcase according to the provisions of this Decision; prepare budget estimates, settle accounts annually for the operation of the National Electronic Legal Bookcase.
e) Take the lead and coordinate with the Ministry of Information and Communications and related agencies and organizations to build the National Electronic Legal Bookcase and start its exploitation and use from 2021; propose solutions to ensure conditions for the effective exploitation and use of the National Electronic Legal Bookcase in conjunction with the application of information technology in legal dissemination and education work.
g) Guide the periodic list of new legal books, newspapers, and materials every six months (06 months).
h) Inspect, review, summarize, commend outstanding collectives and individuals in the work of building, managing, and utilizing the Legal Bookcase; discipline and handle violations in the construction, management, and utilization of the Legal Bookcase.
2. The Minister of National Defense and the Minister of Public Security shall decide on the construction, management, and utilization of the Legal Bookcase at agencies and units of the People's Armed Forces in accordance with the direction of narrowing the scope of construction and maintenance of the Legal Bookcase; direct the strengthened application of information technology in the exploitation of legal books and materials and the use of the National Electronic Legal Bookcase; take the lead and coordinate with the Ministry of Justice and related agencies and organizations in directing, guiding, inspecting, reviewing, summarizing, and reporting on the results of the construction, management, and utilization of the Legal Bookcase at agencies and units of the People's Armed Forces.
3. The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Justice and related agencies and organizations to direct and guide educational institutions in the national education system to integrate the activities of the Legal Bookcase with school libraries; guide the management and exploitation of legal books and materials to serve the teaching and learning of law and legal dissemination and education in schools; coordinate to guide the unified management and exploitation of legal books and materials of community learning centers with the Legal Bookcase.
4. The Ministry of Culture, Sports and Tourism shall take the lead and coordinate with the Ministry of Justice and related agencies and organizations to direct and guide the construction, development, and improvement of the quality of legal books and materials in village libraries; coordinate to guide the unified management and exploitation of legal books and materials of village libraries with the Legal Bookcase; integrate the implementation of this Decision with the implementation of the Project on developing reading culture in the community until 2020, with a view to 2030.
5. The Ministry of Information and Communications shall take the lead and coordinate with the Ministry of Justice and related agencies and organizations to guide the application of information technology in the exploitation of legal normative documents; issue or submit to competent authorities for issuance policies on the application of information technology in the exploitation of legal normative documents, legal books, and materials, and the construction and operation of the National Electronic Legal Bookcase according to the provisions of this Decision; coordinate to guide the unified management and exploitation of legal books and materials of village postal and cultural centers with the Legal Bookcase.
6. The Ministry of Finance shall allocate regular funds to construct and maintain the Legal Bookcase in accordance with regulations on state budget decentralization; take the lead in reviewing, amending, and supplementing current laws and regulations on ensuring funding for the construction, management, and exploitation of the Legal Bookcase.
7. The Ministry of Planning and Investment shall allocate investment capital for development to implement the tasks of this Decision in accordance with the Law on Public Investment and guiding documents.
8. Vietnam Television, Voice of Vietnam, and other central and local mass media organizations shall strengthen propaganda about the position and role of the Legal Bookcase; mobilize and introduce cadres, civil servants, and people to read and borrow legal books, newspapers, and materials.
9. Ministries, ministerial-level agencies, government agencies, and other central state agencies within their functions and duties shall be responsible:
a) To perform the tasks stipulated in Clause 2 of Article 15 of this Decision;
b) To direct affiliated publishing houses (if any) to cooperate with relevant functional units under the Ministry of Justice to review and compile lists of new legal books and materials periodically; monitor and inspect the publication and distribution of legal books and materials for the Legal Bookcase to ensure quality;
c) To direct improvements in the quality of legal books and materials compiled by subordinate units; organize updates and bear responsibility for the accuracy and quality of the content of legal books and materials on the component data of the National Electronic Legal Bookcase according to the provisions of this Decision and their management functions and scope.
d) Coordinate inspections, interim reviews, final summaries, commendations for collectives and individuals with outstanding achievements in the construction, management, and exploitation of the Legal Bookcase; discipline and handle violations in the construction, management, and exploitation of the Legal Bookcase.
10. Propose the Central Committee of the Vietnam Fatherland Front and its member organizations:
a) Mobilize and promote the role of the people in community dwellings, organizations, and individuals both domestically and internationally to participate in the construction, management, and exploitation of the Legal Bookcase;
b) Coordinate, supervise, inspect, conduct interim reviews, final summaries, commendations for collectives and individuals with outstanding achievements in the construction, management, and exploitation of the Legal Bookcase; discipline and handle violations in the construction, management, and exploitation of the Legal Bookcase.
11. Propose the Central Propaganda Department, National Political Publishing House to implement the Project of equipping books for grassroots communal bases in conjunction with the construction, management, and exploitation of the Legal Bookcase as stipulated in this Decision.
12. Provincial People's Committees shall be responsible for:
a) Directing, guiding, urging, and monitoring local levels and sectors to effectively implement this Decision;
b) The Chairman of the Provincial People's Committee shall perform the tasks prescribed in point b, Clause 1, Article 10 and Clause 2, Article 15 of this Decision;
c) Directing and guiding the construction, management, and exploitation of the Legal Bookcase according to the provisions of this Decision; enhancing the effectiveness of exploiting the Legal Bookcase within their jurisdiction; strengthening the application of information technology in managing and exploiting legal normative documents;
d) Compiling professional materials; improving the quality of legal books and materials compiled and distributed by the People's Committee and specialized agencies for the Legal Bookcase; overseeing and managing the distribution of legal books, newspapers, and materials to the Legal Bookcase within their jurisdiction; directing and guiding the circulation of legal books and materials between the Legal Bookcase and self-managed bookcases in communities and other grassroots cultural-information facilities;
đ) Organizing updates and being responsible for the accuracy and quality of the content of legal books and materials on the component data of the National Electronic Legal Bookcase according to their functions and management scope;
e) Directing and guiding the assignment and arrangement of personnel responsible for the Legal Bookcase according to the provisions of this Decision at the local level; training and providing professional guidance on the construction, management, and exploitation of the Legal Bookcase;
g) Ensuring funds from the state budget for the construction, management, and maintenance of the Legal Bookcase according to the provisions of this Decision; encouraging financial support for purchasing additional legal books, newspapers, and materials for various types of Legal Bookcases within their jurisdiction;
h) Inspecting, conducting interim reviews, final summaries, and commendations for collectives and individuals with outstanding achievements in the work of constructing, managing, and exploiting the Legal Bookcase; disciplining and handling violations in the construction, management, and exploitation of the Legal Bookcase;
i) The Department of Justice shall be responsible for advising and assisting the People's Committee at the same level in organizing the implementation of assigned tasks under this Decision.
Article 15. Transitional Provisions
1. The Legal Bookcase in particularly difficult communes and units of the People's Armed Forces constructed according to Decision No. 06/2010/QĐ-TTg dated January 25, 2010, of the Government Chairman on the construction, management, and exploitation of the Legal Bookcase shall continue to be maintained and consolidated according to the provisions of this Decision.
2. From the date this Decision takes effect, the Minister, Heads of ministerial-level agencies, agencies under the Government, central-level state agencies, and the Chairman of the Provincial People's Committee shall decide on the maintenance of the Legal Bookcase at commune, ward, town levels (hereinafter referred to collectively as commune level), the Legal Bookcase in state agencies, economic organizations, public institutions, schools, and other educational establishments under the national education system of state agencies, political-social organizations (hereinafter referred to collectively as agencies and units) that have been constructed according to Decision No. 06/2010/QĐ-TTg dated January 25, 2010, of the Government Chairman on the construction, management, and exploitation of the Legal Bookcase but not falling within the scope of application under Clause 1, Article 1 of this Decision as follows:
a) Organize reviews, assess effectiveness, determine the need for exploitation and use of the Legal Bookcase at the commune level, the Legal Bookcase in agencies and units under their management, and complete before December 31, 2019 to consider and decide on the direction of handling according to the provisions of points b, c, and d of this clause;
b) If continuing to maintain the Legal Bookcase at the commune level, direct, guide, allocate state budget funds for the operation of the Legal Bookcase until the end of 2020. From 2021, socialize the management and exploitation of the Legal Bookcase towards community self-management;
c) If not continuing to maintain the Legal Bookcase at the commune level, direct and guide the merger of the Legal Bookcase into the book and material section of the Library or the Post Office-Cultural Center, Community Learning Center currently operating effectively at the commune level and allocate state budget funds for the operation of the Legal Bookcase until the end of 2020. From 2021, the funds for building, managing, and exploiting books and materials will be allocated within the operational funds of the cultural-information facility where the Legal Bookcase is merged. The merger of the Legal Bookcase must be completed before December 31, 2020;
d) If not continuing to maintain the Legal Bookcase in agencies and units, direct the organization to store and manage existing legal books and materials in accordance with the conditions of the agency or unit according to regulations on the management of state assets and complete before December 31, 2020; allocate state budget funds for the operation of the Legal Bookcase until the end of 2020; direct the selection of suitable and valuable books and materials for digitization and updating on the component data of the National Electronic Legal Bookcase within the scope of management authority.
Article 16. Implementation Provisions
1. This Decision takes effect from May 1, 2019.
2. Decision No. 06/2010/QĐ-TTg dated January 25, 2010, of the Government Chairman on the construction, management, and exploitation of the Legal Bookcase ceases to be effective from the date this Decision takes effect.
3. The Minister, Head of a ministerial-level agency, agency under the Government, central state agency, Chairman of the People's Committee at the provincial level, and related agencies, organizations, and individuals are responsible for implementing this Decision./.
