Circular No. 14/2023/TT-BKHCN promulgates the forms of administrative procedures' files stipulated in certain articles of Decree No. 76/2018/NĐ-CP dated May 15, 2018 of the Government detailing and guiding the implementation of some provisions of the Law on Technology Transfer.

Issuing Model Forms for Administrative Procedure Documents as Provided for in Certain Articles of the Government Decree No. 76/2018/NĐ-CP dated May 15, 2018

 regarding detailed provisions and guidance on implementation of certain articles of the Technology Transfer Law

Pursuant to Decree No.28/2023/ND-CP June 2, 2023 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

The Minister of Science and Technology issues this Circular to issue Model Forms for Administrative Procedure Documents as provided for in certain articles of the Government Decree No. 76/2018/NĐ-CP dated May 15, 2018 stipulating detailed provisions and guidance on implementation of certain articles of the Technology Transfer Law.76/2018/NĐ-CP May 15, 2018 of the Government stipulating detailed provisions and guidance on implementation of certain articles of theTechnology TransferLaw.

Article 1. Scope of Regulation

This Circular issues Model Forms for Administrative Procedure Documents as provided for in Article 18, Article 20, Article 22, Article 26, and Article 27 of the Government Decree No. 76/2018/NĐ-CP dated May 15, 2018 stipulating detailed provisions and guidance on implementation of certain articles of the Technology Transfer Law.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals related to the implementation of administrative procedures as provided for in Article 1 of this Circular.

Article 3. Forms issued with this Circular

Attached to this Circular are model forms for documents to implement the following administrative procedures:

1. Model form for the application to recognize research results and technological development conducted by organizations or individuals at their own expense as provided for in Appendix 1 of this Circular.

2. Model form for the application to support funding or purchase research results and technological development as provided for in Appendix 2 of this Circular.

3. Model form for the application to purchase patents or inventions as provided for in Appendix 3 of this Circular.

4. Model form for the application to publish new technology or products created in Vietnam from research results and technological development as provided for in Appendix 4 of this Circular.

5. Model form for the application to support funding or purchase technology created from research results and technological development for the production of national, key, or main products as provided for in Clause 2 of this Article.

Article 4. Effectiveness and Implementation

1. This Circular takes effect from August 16, 2023.

2. Agencies, organizations, and individuals related to this matter shall be responsible for its implementation. Any difficulties encountered during implementation should be reported to the Ministry of Science and Technology for review and amendment.
