CIRCULAR

REGULATIONS ON DELEGATION OF POWERS, GRADATION, DETERMINATION OF JURISDICTION AND AMENDMENT AND SUPPLEMENTATION OF CERTAIN PROVISIONS OF CIRCULARS IN THE FIELD OF WATER RESOURCES

Pursuant to the Law on Water Resources dated November 27, 2023;

Pursuant to the Government Organization Law on February 18, 2025;

Pursuant to the Law on Organization of Local Administration dated June 16, 2025;

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;

Pursuant to Decree No. 131/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the delegation of jurisdiction for two levels of local authorities in the field of state management under the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 136/2025/NĐ-CP dated June 12, 2025 of the Government on the delegation and decentralization in the agricultural and environmental sectors;

Pursuant to Decree No. 35/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the National Water Resources Management Agency;

The Minister of Agriculture and Rural Development issues this Circular on Regulations on Delegation of Powers, Gradation, Determination of Jurisdiction and Amendment and Supplementation of Certain Provisions of Circulars in the Field of Water Resources.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the delegation of powers, gradation, determination of jurisdiction and amendment and supplementation of certain provisions of Circulars in the field of water resources within the jurisdiction of the Minister of Agriculture and Rural Development.

Article 2. Applicability

This Circular applies to central administrative agencies, local authorities, and other organizations and individuals related to the field of water resources.

Chapter II

REGULATIONS ON DELEGATION OF POWERS, GRADATION, DETERMINATION OF JURISDICTION IN THE FIELD OF WATER RESOURCES

Article 3. Amendment and supplementation of certain provisions of Circular No. 03/2024/TT-BTNMT dated May 16, 2024 of the Minister of Natural Resources and Environment detailing the implementation of certain provisions of the Law on Water Resources

1. Amending and supplementing point b Clause 2 Article 7 as follows:

"b) The People's Committee of the province shall direct the Department of Agriculture and Rural Development to organize the identification and zoning of functions for surface water sources within the province and seek opinions from the Departments of Industry and Trade; Construction; Culture, Sports and Tourism; the People's Committees of communes and relevant agencies and units regarding the results of the functional zoning of water sources."

Based on the comments received, the Department of Agriculture and Rural Development shall compile, absorb, explain, and complete the dossier to submit to the People's Committee of the province for consideration and approval;"

2. Amendment and supplementation of Article 9 as follows:

"Article 9. Cases requiring the determination and announcement of the sanitary protection zone for areas where drinking water is extracted

Water resource exploitation works for production and supply of clean water for daily use (hereinafter referred to as water extraction works for daily use supply) that require a water resource exploitation permit according to regulations must determine and announce the sanitary protection zone for areas where drinking water is extracted.".

3. Amendment and supplementation of Clause 2, Clause 3, and Clause 5 of Article 12 as follows:

a) Amend and supplement Clause 2 as follows:

"2. In cases where the scope of the sanitary protection zone for areas where drinking water is extracted lies within the territory of one province:

On the basis of the proposed scope of the sanitary protection zone for areas where drinking water is extracted by organizations and individuals specified in Clause 1 of this Article and the current land use status, the Department of Agriculture and Rural Development shall organize the determination of the scope of the sanitary protection zone for areas where drinking water is extracted for the work.

Within 10 working days from the date the water resource exploitation permit is signed and issued by the competent authority, the Department of Natural Resources and Environment shall submit to the People's Committee of the province for approval of the sanitary protection zone for areas where drinking water is extracted for the work.".

b) Amend and supplement Clause 3 as follows:

"3. In cases where the scope of the sanitary protection zone for areas where drinking water is extracted lies within the territory of two provinces or centrally governed cities and above:

On the basis of the proposed scope of the sanitary protection zone for areas where drinking water is extracted by organizations and individuals specified in Clause 1 of this Article and the current land use status, the Department of Agriculture and Rural Development where the water extraction work is located shall take the lead and coordinate with the Departments of Agriculture and Rural Development of the involved provinces to unify the scope of the sanitary protection zone for areas where drinking water is extracted for the work.

Within 15 working days from the date the water resource exploitation permit is signed and issued by the competent authority, the Department of Agriculture and Rural Development where the water extraction work is located shall submit to the People's Committee of the province for approval of the sanitary protection zone for areas where drinking water is extracted for the work.".

c) Amending and supplementing Clause 5 as follows:

"5. Within 10 working days from the date of the decision approving the sanitary protection zone for areas where drinking water is extracted, the People's Committee of the province shall direct the Department of Agriculture and Rural Development to organize the publication on mass media and the local electronic information portal; send to the People's Committee of the commune concerned if the scope of the sanitary protection zone for areas where drinking water is extracted lies within the territory of one province or to the relevant Department of Agriculture and Rural Development if the scope of the sanitary protection zone for areas where drinking water is extracted lies within the territory of two provinces or centrally governed cities and above to organize the determination of the boundaries of the sanitary protection zone for areas where drinking water is extracted on-site.".

4. Amendment and supplementation of Article 13 as follows:

"Article 13. Organization of the determination of the boundaries of the sanitary protection zone for areas where drinking water is extracted on-site

1. In cases where the scope of the sanitary protection zone for areas where drinking water is extracted lies within the territory of one province:

a) In cases where the scope of the sanitary protection zone for areas where drinking water is extracted lies within the territory of one commune, within 30 working days from the date of receipt of the decision approving the sanitary protection zone for areas where drinking water is extracted, the People's Committee of the commune shall notify the plan for determining the boundaries of the sanitary protection zone on-site to the organizations and individuals investing, managing, and operating the water extraction work and cooperate in implementing the determination of the boundaries and placement of signs indicating the sanitary protection zone for areas where drinking water is extracted on-site.

After completing the determination of the boundaries of the sanitary protection zone for areas where drinking water is extracted on-site, the People's Committee of the commune shall notify the Department of Agriculture and Rural Development about the completion results;

b) In cases where the scope of the sanitary protection zone for areas where drinking water is extracted lies within the territory of two communes or more, within 30 working days from the date of the decision approving the sanitary protection zone for areas where drinking water is extracted, the Department of Agriculture and Rural Development shall notify the plan for determining the boundaries of the sanitary protection zone on-site to the People's Committees of the involved communes, organizations and individuals investing, managing, and operating the water extraction work and cooperate in implementing the determination of the boundaries and placement of signs indicating the sanitary protection zone for areas where drinking water is extracted on-site.

2. In cases where the scope of the sanitary protection zone for water supply areas spans across two or more provinces or centrally governed cities:

Within thirty working days from the date of receipt of the decision approving the sanitary protection zone for water supply areas, the Department of Agriculture and Environment where the water extraction works are located shall notify the plan to determine the boundaries of the sanitary protection zone on-site to the Departments of Agriculture and Environment of the relevant provinces, organizations, individuals investing, managing, and operating the water extraction works, and cooperate in determining the boundaries and positions of signs indicating the sanitary protection zone for water supply areas on-site.”

5. Amend and supplement Clause 3 of Article 14 as follows:

“3. The provincial People's Committee shall direct the Department of Agriculture and Environment and the People's Committee of the commune to perform the following tasks: determine the boundaries of the sanitary protection zone for water supply areas on-site; inspect and supervise activities within the sanitary protection zone for water supply areas of water extraction works within their jurisdiction; receive information and resolve issues arising related to the sanitary protection zone for water supply areas of water extraction works within their jurisdiction according to their authority.”

6. Amend and supplement Clause 2 of Article 24 as follows:

“2. The Department of Agriculture and Environment shall seek written comments on the draft groundwater protection plan from the Departments of Construction, Industry and Trade, Health, the People's Committee of the commune, and representatives of some organizations and individuals extracting and using large amounts of groundwater within the province.”

Article 4. Amend and supplement certain provisions of Circular No. 05/2024/TT-BTNMT dated May 16, 2024, issued by the Minister of Natural Resources and Environment regarding the relocation, change of location, and dissolution of groundwater monitoring stations.

Delete the phrase "People's Committee of the district" at Point d of Clause 4, Article 13 and Point d of Clause 2, Article 14.

Article 5. Amend and supplement certain provisions of Circular No. 22/2024/TT-BTNMT dated November 26, 2024, issued by the Minister of Natural Resources and Environment promulgating the National Technical Regulation on Plugging Unused Wells.

1. Amend and supplement Section V of the National Technical Regulation on Plugging Unused Wells issued together with Circular No. 22/2024/TT-BTNMT dated November 26, 2024, issued by the Minister of Natural Resources and Environment as follows:

 “V. IMPLEMENTATION

1. Ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally governed cities, and related organizations, households, and individuals are responsible for implementing this National Technical Regulation.

2. The Director of the Water Resources Management Agency shall be responsible for disseminating and supervising the implementation of this National Technical Regulation.

3. Annually, before December 15, the People's Committee of the commune shall compile a list of plugged wells within its jurisdiction and submit it to the Department of Agriculture and Environment for consolidation.

4. Annually (before January 30 of the following year), the Department of Agriculture and Environment shall report to the Ministry of Agriculture and Environment (through the Water Resources Management Agency) and the Provincial People's Committee on the implementation of plugging unused wells within its jurisdiction.

5. During the implementation process, if there are any difficulties, the relevant agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Agriculture and Environment for consideration and decision./.”

2. Delete the word "district" in the Appendices of the National Technical Regulation on Plugging Unused Wells issued together with Circular No. 22/2024/TT-BTNMT dated November 26, 2024, issued by the Minister of Natural Resources and Environment.

Article 6. The registration dossier and forms for groundwater exploitation as prescribed in

Article 23 of Decree No. 131/2025/NĐ-CP dated June 12, 2025 of the Government on the division of authorities between two levels of local administration in the field of state management by the Ministry of Agriculture and Rural Development

Organizations and individuals submit one set of registration dossier (application form) to the People's Committee of the commune directly, through the internet, or via postal service according to Form No. 01 attached at Appendix I of this Circular for cases of groundwater exploitation for purposes with a scale not exceeding 10 m

/day-night, except households exploiting groundwater for their own domestic use; according to Form No. 02 attached at Appendix I of this Circular for cases of using flowing groundwater within mining pits for ore concentration, or pumping water to dry out mines.3Article 7. The dossier and forms for approving the content of the water transfer plan as prescribed in

Clause 2 of Article 31 of Decree No. 136/2025/NĐ-CP

dated June 12, 2025 of the Government on the delegation and decentralization in agriculture and environment sectors

Organizations and individuals submit one set of dossier to the agency assigned by the Chairman of the Provincial People's Committee to receive administrative procedure dossiers directly, through the internet, or via postal service. The dossier includes:

a) A request for approval of the content of the water transfer plan according to Form No. 03 attached at Appendix II of this Circular;

b) An explanatory report proposing the water transfer plan according to Form No. 04 attached at Appendix II of this Circular;

c) A schematic diagram of the water transfer project location;

d) Other relevant legal and technical documents related to the project.

Article 8. The dossiers, procedures, and forms prescribed in

Article 31 of Decree No. 136/2025/NĐ-CP

1. Dossier, procedures, and forms for approving and adjusting the payment for granting the right to exploit water resources for operational works

Organizations and individuals submit one set of dossier to the agency assigned by the Chairman of the Provincial People's Committee to receive administrative procedure dossiers directly, through the internet, or via postal service. The dossier includes:

a) Within thirty working days from the date of issuance of the water resource exploitation permit, the permit holder must submit one set of the payment calculation dossier for granting the right to exploit water resources to the agency assigned by the Chairman of the Provincial People's Committee to receive administrative procedure dossiers directly, through the internet, or via postal service;

b) The payment calculation dossier for granting the right to exploit water resources shall be prepared in accordance with Point a, Clause 1, Article 51 of Decree No. 54/2024/NĐ-CP dated May 16, 2024 of the Government on the practice of groundwater drilling, declaration, registration, licensing, water resource services, and payment for granting the right to exploit water resources, along with a copy of the water resource exploitation permit issued by the Ministry of Agriculture and Rural Development;

c) The procedures for receiving, examining, approving, and adjusting the payment for granting the right to exploit water resources shall be carried out in accordance with Points c and d, Clause 2, Article 51 of Decree No. 54/2024/NĐ-CP dated May 16, 2024 of the Government on the practice of groundwater drilling, declaration, registration, licensing, water resource services, and payment for granting the right to exploit water resources.

2. Dossier, procedures, and forms for approving the payment for granting the right to exploit water resources for non-operational works

a) The payment calculation dossier for granting the right to exploit water resources shall be prepared in accordance with Point b, Clause 1 of this Article;

b) The procedures for receiving, examining, and approving the payment for granting the right to exploit water resources shall be carried out in accordance with Points a, c, and d, Clause 2, Article 51 of Decree No. 54/2024/NĐ-CP dated May 16, 2024 of the Government on the practice of groundwater drilling, declaration, registration, licensing, water resource services, and payment for granting the right to exploit water resources.

3. Replace the phrase "Provincial People's Committee" with the phrase "Chairman of the Provincial People's Committee" in Forms 01, 02, 03, 04, 05, 06, 07, 08, 09, 10, 11, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31 attached at Appendix I, Forms 53, 54, 55 attached at Appendix II, and Forms 57, 58, 59 attached at Appendix III; replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Chairman of the Provincial People's Committee" in Forms 49, 50, 51 attached at Appendix II issued together with Decree No. 54/2024/NĐ-CP dated May 16, 2024 of the Government on the practice of groundwater drilling, declaration, registration, licensing, water resource services, and payment for granting the right to exploit water resources.

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULARS IN THE WATER RESOURCES SECTOR

Chapter III

AMENDMENTS AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULARS IN THE FIELD OF WATER RESOURCES

Article 9. Amend and supplement some provisions of Circular No. 04/2024/TT-BTNMT dated May 16, 2024, of the Minister of Natural Resources and Environment on the inspection of compliance with laws on water resources and the review and acceptance of results of basic investigation activities on water resources. regarding the inspection of compliance with laws on water resources and the assessment and acceptance of the results of basic investigation activities on water resources source water

The agency entrusted by the Minister of Agriculture and Rural Development to undertake tasks of compiling, advising, and serving as the main coordinator for inspection work shall, in collaboration with the Water Resource Management Department, develop an inspection plan in the field of water resources, submit it to the Minister of Agriculture and Rural Development for approval.

The agency entrusted by the Minister of Agriculture and Rural Development to undertake tasks of compiling, advising, and serving as the main coordinator for inspection work, and the Water Resource Management Department shall implement inspections of compliance with laws on water resources according to the approved inspection plan; handle according to their authority or recommend handling the inspection results in accordance with the law; conduct surprise inspections when there is a basis as stipulated in Clause 2 of Article 6 of this Circular. The implementation of surprise inspections shall be carried out as follows:

a) For cases prescribed in Points a and c of Clause 2 of Article 6 of this Circular, based on their functions, tasks, powers, and division of labor by the Minister of Agriculture and Rural Development, the agency entrusted by the Minister of Agriculture and Rural Development to perform inspection functions and tasks or the Water Resource Management Department shall report to the Ministry of Agriculture and Rural Development for consideration and decision on the establishment of a surprise inspection team;

b) For cases prescribed in Points b and d of Clause 2 of Article 6 of this Circular, the Water Resource Management Department shall consider and decide on the establishment of a surprise inspection team. Depending on the severity of the violation signs, to ensure timely prevention and minimize harm caused by the violation, the Water Resource Management Department shall send a document requesting the People's Committee of the province where the violation occurred to organize the inspection and report the results back to the Water Resource Management Department."

IMPLEMENTING PROVISIONS

Article 10. Effective Date

This Circular shall take effect from July 1, 2025.

Article 11. Transitional Provisions

a) Collecting, evaluating relevant files, documents, samples (if any) related to the inspection content; inspecting the current status at places where water extraction works are located or where there are signs of violations (if necessary);

b) The on-site inspection shall be recorded in a record form according to Form No. 05 issued together with this Circular."

3. The inspection of compliance with laws on water resources being carried out in accordance with Circular No. 04/2024/TT-BTNMT dated May 16, 2024 of the Minister of Natural Resources and Environment on the inspection of compliance with laws on water resources and the assessment and acceptance of the results of basic investigation activities on water resources shall continue to be implemented until completion.

Article 12. Responsibility for Implementation

1. Matters concerning the solicitation of opinions from the People's Committees of districts regarding functional zoning of water sources as stipulated in Circular No. 03/2024/TT-BTNMT dated May 16, 2024, of the Minister of Natural Resources and Environment detailing certain provisions of the Law on Water Resources, if not completed by the People's Committees of districts before July 1, 2025, the People's Committees of communes with the authority to accept such responsibilities and tasks shall continue to implement in accordance with this Circular.

2. Matters concerning the determination and announcement of the scope of sanitary protection zones for water supply areas and the organization of determining the boundaries of sanitary protection zones on site as stipulated in Circular No. 03/2024/TT-BTNMT dated May 16, 2024, of the Minister of Natural Resources and Environment detailing certain provisions of the Law on Water Resources, if not resolved by the competent authorities before July 1, 2025, the competent authorities accepting such responsibilities and tasks shall continue to implement in accordance with this Circular.

WATER TRANSFER PROJECT ALTERNATIVE

INTRODUCTION

1. Summarize the information about the proposing entity or individual for the water transfer project.

2. Present the necessity of investing in the project; preliminarily evaluate the conditions (advantages, difficulties) for implementing the investment project.

3. Present the compatibility of the project with the national water resource strategy, national environmental protection strategy; water resources planning, provincial planning, and other related plans; local socio-economic development plan and industries related to the exploitation and utilization of water resources in river basins.

4. Present basic information about the project and the water transfer works: source of water being transferred, receiving water source; purpose, scale, tasks of the project; location, scope of implementation of the project; water transfer method; expected project implementation schedule.

5. List the documents, information, data used to prepare the report, sources of information, and data.

PART I

CHARACTERISTICS OF WATER SOURCES AND REQUIREMENTS FOR WATER EXPLOITATION AND USE

(Describe the characteristics of the water sources and the situation of water exploitation and use from the water source being transferred and the receiving water source).

I. NATURAL CONDITIONS

1. Natural and socio-economic characteristics: provide a general description of the demographic situation and socio-economic development in the project area..

2. Specifically describe the morphological characteristics of the exploited water source/receiving water source (length, area, tributaries, sub-tributaries, etc.).

3. Describe the current status of aquatic ecosystems in the exploited water source and receiving water source areas.

II. SCALE AND WATER TRANSFER ALTERNATIVES OF THE PROJECT

1. Specifically describe the location, mission, scale of the works; water transfer scale, major components, and water transfer methods of the project.

2. Specifically describe the water transfer regime during different periods of the year (month/season/crop): average, maximum, and minimum water transfer flow rates for each period (unit m3/s).

III. WATER EXPLOITATION AND USE REQUIREMENTS IN THE AREA

1. List existing and planned water exploitation and use facilities on the section of the river/stream being transferred and receiving water downstream of the water transfer facility (with a schematic diagram of the river/stream network, the location of the water transfer facility with water regulation facilities in the area), and specify the purpose, method, operation mode, and requirements for water exploitation during each period of the year for each facility (average, maximum, and minimum exploitation flow rates for each period).

2. Summarize the water exploitation and use requirements of facilities in the lower reaches of the water transfer facility by month and period of the year.

IV. ASSESSMENT OF WATER SOURCE CAPACITY

1. Describe the method and results of calculating the characteristics of the flow at the water transfer location and receiving location including: annual flow characteristics, flood season, dry season, three driest months, driest month, flow changes throughout the year, over many years.

2. Propose the minimum flow value to maintain downstream of the water transfer location.

3. Assess the capacity of the water source to ensure water transfer for the project, maintain minimum flow, and meet other related water exploitation and use requirements in the area during each period of the year.

Chapter II

IMPACTS OF WATER TRANSFER AND MEASURES TO MITIGATE NEGATIVE IMPACTS

I. IMPACTS OF WATER TRANSFER

1. Evaluate changes in flow and water quality of the transferred water source and receiving water source downstream of the water transfer location during the flood and dry seasons (flooding, drought, saltwater intrusion); impact on erosion, sedimentation of riverbed and banks..

2. Evaluate the impact of water transfer on water exploitation by related entities on the section of the river/stream being transferred and receiving water downstream of the water transfer facility during the flood, dry, and increased water use periods.

3. Evaluate impacts on aquatic ecosystems, forest area, inland water transport, and other impacts (if any).

II. MEASURES TO MITIGATE NEGATIVE IMPACTS

1. Present solutions to ensure minimum flow maintenance and meet downstream water supply requirements (during normal, drought, and water shortage conditions).

2. Present plans and solutions to mitigate negative impacts (as evaluated in Section I of this Chapter) during construction and operation of the works.

3. Present solutions to ensure safe operation of the works (during normal operation and in case of natural disaster floods).
