Regulations on criteria for classification, conditions for establishment, restructuring, and dissolution of public service units in the archival field

Pursuant to the Government Decree No. 25/2025/NĐ-CP dated February 21, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on the establishment, restructuring, and dissolution of public service units (amended and supplemented by Decree No. 83/2024/NĐ-CP dated July 10, 2024); 7 year 2024);

At the proposal of the Director of the Cadre and Civil Service Department and the Director of the State Archives and Records Management Agency;

The Minister of Home Affairs issues this Circular stipulating the criteria for classification, conditions for establishment, restructuring, and dissolution of public service units in the archival field.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the criteria for classification, conditions for establishment, restructuring, and dissolution of public service units in the archival field.

Article 2. Applicability

1. This Circular applies to public service units established by competent authorities in accordance with the law in the archival field.

2. Agencies, organizations, and individuals related to the establishment, restructuring, and dissolution of public service units in the archival field.

3. This Circular does not apply to:

a) Public service units in the archival field under Party agencies, the Ministry of National Defense, the Ministry of Public Security, and the Ministry of Foreign Affairs;

b) Public service units in the archival field under the administrative-economic special zones.

Article 3. Principles for the establishment, classification, restructuring, and dissolution of public service units in the archival field

The establishment, restructuring, and dissolution of public service units in the archival field must comply with the principles prescribed in Article 4 of Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government on the establishment, restructuring, and dissolution of public service units (amended and supplemented by Decree No. 83/2024/NĐ-CP dated July 10, 2024) (hereinafter referred to as Decree No. 120/2020/NĐ-CP) and must be consistent with relevant laws.

Chapter II
CRITERIA FOR CLASSIFICATION, CONDITIONS FOR ESTABLISHMENT, RESTRUCTURING, AND DISSOLUTION OF PUBLIC SERVICE UNITS IN THE ARCHIVAL FIELD

Article 4. Criteria for classification of public service units in the archival field

1. Classification based on archival management functions:

a) Public service units directly managing permanent archives of agencies and organizations submitting documents to the national historical archives at the central level and other archives as prescribed by law;

b) Public service units directly managing permanent archives of agencies and organizations submitting documents to the provincial-level national historical archives and other archives as prescribed by law.

2. Classification based on financial autonomy level:

a) Public service units that self-fund regular expenses and investment expenses;

b) Public service units that self-fund regular expenses;

c) Public service units that partially self-fund regular expenses;

d) Public service units where regular expenses are guaranteed by the State.

The determination of the degree of financial autonomy of public service units in the archival field as stipulated in this clause shall be carried out in accordance with Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the mechanism of financial autonomy of public service units (amended and supplemented by Decree No. 111/2025/NĐ-CP dated May 22, 2025).

Article 5. Conditions for establishing public service units in the archival field

Public service units in the archival field are established when they meet the following conditions:

1. The conditions prescribed in Clause 1 of Article 5 of Decree No. 120/2020/NĐ-CP.

2. Specific conditions:

a) Having state historical archival functions;

b) Providing public services to support state management in the archival field;

c) Ensuring the number of staff according to the staffing norms for public service units in the archival field.

For self-financing public service units and those that are self-financing for both recurrent and capital expenditures, the minimum number of staff members when establishing these units shall be determined according to the establishment plan.

3. In addition to the conditions stipulated in Clauses 1 and 2 of this Article, the establishment of public service units in the archival field must also meet other conditions prescribed by relevant laws (if any).

Article 6. Conditions for restructuring public service units in the archival field

Public service units in the archival field shall be restructured when they fall under one of the cases specified in points a, b, and c of Clause 2, Article 5 of Decree No. 120/2020/NĐ-CP.

Article 7. Conditions for dissolving public service units in the archival field

1. Public service units in the archival field shall implement dissolution when they fall under one of the cases specified in points a, b, c, and d of Clause 3, Article 5 of Decree No. 120/2020/NĐ-CP.

2. Public service units shall only implement dissolution after completing their financial obligations, assets, land, loans, debts, and other obligations as prescribed by law and obtaining confirmation in writing from the competent authority.

Chapter III
IMPLEMENTATION

Article 8. Effective Date

This Circular takes effect from September 16, 2025.

Article 9. Responsibility for implementation

1. The Ministry of Home Affairs and People's Committees of provinces and centrally governed cities are responsible for implementing this Circular.

2. Public service units in the archival field, relevant agencies, organizations, and individuals are responsible for enforcing this Circular.

3. In case the legal regulatory documents cited in this Circular are amended, supplemented, or replaced by other legal regulatory documents, the provisions of the amended, supplemented, or replacing documents shall apply.

4. During the implementation of this Circular, if there are difficulties or obstacles, agencies, units, organizations, and individuals are advised to report to the Ministry of Home Affairs for guidance and resolution in accordance with regulations./.
