Circular No. 14/2025/TT-BYT stipulates the division of authority between two levels of local government in the fields of social assistance and prevention and control of social evils.

REGULATIONS ON THE DETERMINATION OF AUTHORITY OF TWO LEVELS OF LOCAL ADMINISTRATION IN THE FIELD OF SOCIAL ASSISTANCE AND PREVENTION OF SOCIAL EVILS
IN THE FIELD OF SOCIAL ASSISTANCE AND PREVENTION OF SOCIAL EVILS

Pursuant to the Law on Government Organization 2025;

Pursuant to Resolution No. 190/2025/QH15 of the National Assembly in 2025 on handling some issues related to the organization and staffing of state agencies;

Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Social Assistance Administration,

The Minister of Health promulgates this Circular regulating the determination of authority of two levels of local administration in the field of social assistance and prevention of social evils.

Article 1. Implementation of regulations on the professional standards for community social work volunteers at the commune level

The authority to implement tasks stipulated in Clause 2, Article 6 of Circular No. 07/2013/TT-BLDTBXH dated May 24, 2013 of the Minister of Labor, War Invalids and Social Affairs regarding the professional standards for community social work volunteers at the commune, ward, town level shall be carried out by the Chairman of the People's Committee at the commune, ward, special zone level (hereinafter referred to as the commune level).

Article 2. Establishment, dissolution of Volunteer Social Work Teams and approval of operational regulations

1. The authority to decide on the establishment, dissolution of Volunteer Social Work Teams (hereinafter referred to as Volunteer Teams) as stipulated in Article 6 and approval of operational regulations as stipulated in Clause 1, Article 10 of Joint Circular No. 24/2012/TTLT-BLDTBXH-BNV-BTC dated October 22, 2012 of the Ministers of Labor, War Invalids and Social Affairs, Interior, and Finance on the establishment, dissolution, organization of activities, and policies for Volunteer Social Work Teams at the commune, ward, town level shall be carried out by the Chairman of the People's Committee at the commune level.

2. Procedures and steps for implementation:

a) Based on the actual situation and practical requirements of social evil prevention and control in the managed area, the Chairman of the People's Committee at the commune level shall consider and decide on the establishment of Volunteer Teams and approve the Operational Regulations of Volunteer Teams.

In cases where members of Volunteer Teams need to be changed, the Chairman of the People's Committee at the commune level shall decide on changing the members of Volunteer Teams;

b) Based on the actual situation of social evil prevention and control in the locality, the Chairman of the People's Committee at the commune level shall decide on the dissolution of Volunteer Teams.

Article 3. Decision to suspend social assistance benefits

1. The authority to decide on suspending monthly social assistance benefits and monthly care and support costs as stipulated in Clause 4, Article 2 of Circular No. 02/2021/TT-BLDTBXH dated June 24, 2021 of the Minister of Labor, War Invalids and Social Affairs guiding the implementation of certain provisions of Decree No. 20/2021/NĐ-CP dated March 15, 2021 of the Government on social assistance policies for beneficiaries of social assistance (hereinafter referred to as Decree No. 20/2021/NĐ-CP) shall be carried out by the Chairman of the People's Committee at the commune level.

2. Procedures and steps for implementation:

The Chairman of the People's Committee at the commune level shall base on the provisions of Clause 3, Article 2 of Circular No. 02/2021/TT-BLDTBXH to consider and decide on suspending monthly social assistance benefits and monthly care and support costs.

Article 4. Guidance and training on receiving care and nurturing of social assistance beneficiaries in the community

The authority to organize the implementation of guidance and training on receiving care and nurturing of social assistance beneficiaries in the community as stipulated in Clause 2, Article 4 of Circular No. 02/2021/TT-BLDTBXH shall be carried out by the Chairman of the People's Committee at the commune level.

Article 5. The decision to pay social allowances and monthly care and maintenance costs at corresponding levels

The authority to decide payments at corresponding levels as prescribed in Clause 1 of Article 5 of Circular No. 02/2021/TT-BLDTBXH shall be exercised by the Chairman of the People's Committee at the commune level.

Article 6. Implementation Provisions

1. This Circular takes effect from July 1, 2025.

2. This Circular shall cease to be effective from March 1, 2027.

3. During the period this Circular is in effect, if the provisions on administrative authority and state management responsibilities in this Circular differ from those in Circulars issued by the Minister of Health before July 1, 2025, then the provisions of this Circular shall apply.

In the course of implementation, any difficulties should be promptly reported to the Ministry of Health for study and supplementary guidance.
