CIRCULAR
Regulations on the management and settlement of materials imported from SIDA aid sources and foreign currency contributed by medical experts between the Ministry of Health and companies and enterprises in the healthcare sector
Continue to implement Decision No. 114/CT dated May 10, 1989 of the Chairman of the Council of Ministers, Circular Joint Ministry of Health-Finance No. 13/TTLB dated June 5, 1989 regarding the use of SIDA aid funds and foreign currency contributed by medical experts, the Ministry of Health hereby stipulates certain regulations on management and settlement as follows:
I. MANAGEMENT REGIME
1. Materials provided through SIDA aid and foreign currency contributed by medical experts must be imported and exported according to the regulations of the Ministry of Health, through two channels: VIMEDIMEX Hanoi and VIMEDIMEX Ho Chi Minh City.
2. The Vietnam Pharmaceutical Enterprises Association has the responsibility to build orders for approval by the Ministry to import goods according to the plan.
3. The two VIMEDIMEX entities organize the importation and distribution of materials and goods to companies and enterprises according to the approved plan. Companies and enterprises are allowed to independently choose specifications and product forms to enter into processing and production contracts that meet market consumption requirements while ensuring commitments with funding agencies.
4. Companies and enterprises have the duty to fully and promptly repay the amount of SIDA aid materials and goods imported using foreign currency contributed by experts to VIMEDIMEX according to the specified regulations. VIMEDIMEX is responsible for settling payments to the Ministry within the prescribed time frame; if not settled on time, interest will be calculated as if borrowed from the State Bank.
II. SETTLEMENT REGIME
1. Settlement Period
Within 45 days from the date of delivery by VIMEDIMEX, companies and enterprises must settle the full payment to VIMEDIMEX. VIMEDIMEX shall settle the payment to the Ministry within 15 days from the date of receipt of payment transferred by companies and enterprises.
2. Exchange Rate for Settlement
From now on, the foreign exchange rate will be calculated based on the rate set by the Bank at the time of VIMEDIMEX's delivery to units, reduced by 10% for essential medicines, reduced by 5% for medicines in the essential drug list, and not reduced for medicines outside the essential drug list, and reduced by 15% for critical equipment users (except for consignments arriving before February 1990, calculated at the rate of 3,900 VND/USD).
If the settlement period specified in Part II, Point 2 above is exceeded, companies and enterprises and VIMEDIMEX must bear interest at a rate of 2.5% per month on the total amount due to the Ministry, calculated based on the Bank's exchange rate at the time of settlement.
This Circular takes effect from the date of issuance, and all previous regulations on the management and settlement of SIDA aid material sources and foreign currency contributed by medical experts that conflict with this Circular are hereby abolished./.
Beyond the payment deadline specified in Part II, Point 2 above, the companies, enterprises, and VIMEDIMEX must pay interest at a rate of 2.5% per month on the total amount due to the Ministry, calculated based on the exchange rate stipulated by the Bank at the time of payment.
III. IMPLEMENTATION PROVISIONS
This Circular takes effect from the date of issuance; all previous regulations concerning the management and settlement of SIDA aid raw materials and foreign currency for experts that conflict with the provisions of this Circular are hereby abolished./.
