DECREE

Provisions on industries and trades subject to conditions in the civil aviation sector

in the field of civil aviation

Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government stipulating industries and trades subject to conditions in the civil aviation sector took effect from July 1, 2016, amended and supplemented by:

1. Decree No. 89/2019/ND-CP dated November 15, 2019 of the Government amending and supplementing certain articles of Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government stipulating industries and trades subject to conditions in the civil aviation sector and Decree No. 30/2013/ND-CP dated April 8, 2013 of the Government on air transport business and common aviation activities, effective from January 1, 2020.

2. Decree No. 64/2022/ND-CP dated September 15, 2022 of the Government amending and supplementing certain articles of decrees related to business operations in the civil aviation sector, effective from September 15, 2022.

3. Decree No. 15/2024/ND-CP dated February 16, 2024 of the Government amending and supplementing certain articles of Decree No. 30/2013/ND-CP dated April 8, 2013 of the Government on air transport business and common aviation activities and Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government stipulating industries and trades subject to conditions in the civil aviation sector, effective from February 16, 2024.

Pursuant to the Law on Government Organization dated June 19, 2015;

Based on the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Certain Articles of the Civil Aviation Law of Vietnam dated November 21, 2014;

Pursuant to the Investment Law dated November 26, 2014;

At the proposal of the Minister of Transport;

The Government promulgates this Decree stipulating regulations on industries and trades subject to conditions in the civil aviation sector.1

 

Chapter I. GENERAL PROVISIONS

 

Article 1. Scope of Regulation

1. This Decree stipulates regulations on industries and trades subject to conditions in the civil aviation sector including:

a) Air transport business;

b) Airports and aerodrome business;

c) Air services at airports and aerodromes;

d) Design, production, maintenance, or testing of aircraft, aircraft engines, propellers, and aircraft equipment in Vietnam;

đ) Air traffic service provision;

e) Training and vocational training for aviation personnel.

2. This Decree does not apply to dedicated airports.

Article 2. Applicability

This Decree applies to organizations and individuals involved in industries and trades subject to conditions in the civil aviation sector in Vietnam.

Article 3. Explanation of Terms

1. Air services at airports are those services directly related to aircraft operation, air transport operation, and flight activities carried out at airports.

2. Airport business is the exploitation of airport infrastructure and other facilities within the airport infrastructure under the management of the airport enterprise for profit-making purposes.

3. Air transport business includes two forms of air transport business and common air transport business.

a) Air transport business involves transporting passengers, baggage, cargo, and mail by air for profit-making purposes.

b) Common aviation business is the common aviation activity aimed at profit-making using aircraft except unmanned aerial vehicles and ultra-light aircraft as defined in Article 21 of the Civil Aviation Law of Vietnam.

Article 4. Confirmation of Capital

1. The confirmation document for capital shall be stipulated as follows:

a) For contributions in Vietnamese dong and freely convertible foreign currency: A document from a credit institution confirming the amount of funds frozen at the credit institution by the organization or individual applying for a permit; the release of frozen funds at the credit institution can only be executed after the organization or individual has been granted a permit or when they receive a notification letter refusing the permit issuance;

b) For contributions in assets directly serving the purpose of business: An appraisal certificate from a competent appraisal organization confirming the value converted into money of the asset at the time of preparing the application for permit issuance in accordance with the law on appraisal;

c)2 For enterprises currently operating industries and trades subject to conditions in the civil aviation sector that increase or decrease capital to meet the capital requirements when expanding or narrowing the scope of business, or adding or reducing other industries and trades subject to conditions as prescribed in this Decree, they may use the audited financial statements of the previous year before the application date or a bank guarantee letter as the capital confirmation document or an audited capital movement report at the application date.

2. For businesses operating multiple investment and business sectors subject to conditions under this Decree, the minimum capital requirement shall be the highest capital among all business sectors.

Organizations and individuals directly confirming the capital of a business shall be responsible for the accuracy and honesty of the data at the time of confirmation.

 

Chapter II. AIR CARGO TRANSPORTATION BUSINESS

 

1. Fulfilling the conditions regarding aircraft operation assurance plans, organizational structures, capital, business plans, and product development strategies as stipulated in Articles 6, 7, 8, and 9 of this Decree.3

1. Meeting the conditions regarding the plan to ensure aircraft operation, organizational structure, capital, business plan, and product development strategy as stipulated in Articles 6, 7, 8, and 9 of this Decree.

2. The provisions of this Chapter shall not apply to the training and vocational instruction of flight crew members and flight instructors.

2. The minimum number of aircraft maintained throughout the air cargo transport business operation is three aircraft for air cargo transport operations; one aircraft for general aviation operations.4

1. The plan to ensure aircraft operation includes the following contents:

a) Number, type, and age of aircraft;

b) Form of ownership;

c) Operation and maintenance plans, and sources of human resources ensuring aircraft operation and maintenance.

2. The minimum number of aircraft to be maintained throughout the air cargo transportation business operation is three aircraft for air cargo transportation; one aircraft for general aviation business.

2. Individuals appointed to positions responsible for safety and security management systems, aircraft operation, aircraft maintenance, and flight training must have at least three consecutive years of experience in the relevant field, holding certificates recognized according to civil aviation laws.5

1. Having an organizational structure implementing safety and security management systems, aircraft operation, aircraft maintenance, flight training, and ground operations.

2. Individuals appointed to positions responsible for safety management systems, security, aircraft operation, maintenance, and flight training must have at least three consecutive years of experience in the relevant field and possess certificates or qualifications recognized under civil aviation laws.

3. For foreign-invested enterprises, the number of foreign members shall not exceed one-third of the total number of members participating in the management structure. The management structure referred to in this clause includes:

a) General Director (Director), Deputy General Directors (Deputy Directors);

b) Chief Accountant;

c) Persons responsible for areas such as the safety management system; aircraft operation; aircraft maintenance; flight training, and persons holding equivalent positions as determined by the company's organizational structure.

Article 9. Business Plans and Development Strategies6

1. The minimum capital level (including equity and debt) for establishing and maintaining an air cargo transportation business:

a) Operating up to ten aircraft: 300 billion Vietnamese dong;

b) Operating eleven to thirty aircraft: 600 billion Vietnamese dong;

c) Operating more than thirty aircraft: 700 billion Vietnamese dong.

2. The minimum capital level for establishing and maintaining a general aviation business: 100 billion Vietnamese dong.

3. An air cargo transportation business with foreign investment must meet the following conditions:

a) Foreign investors may hold no more than 34% of the registered capital.

b) There must be at least one Vietnamese individual or Vietnamese legal entity holding the largest portion of the charter capital;

c) In cases where a Vietnamese legal entity has foreign investment contributing capital, the proportion of foreign contribution capital shall not exceed 49% of the charter capital of the legal entity.

Article 10. Procedures for Issuing Licenses for Air Cargo Transport Business and General Aviation Business7

The business plan and development strategy of the enterprise include the following contents:

1. Assessment of market demand and development trends.

2. Evaluation of practical service provision and competitive levels on the market.

3. Air cargo transportation product development strategy, aircraft fleet development strategy, and five-year business development plan from the date of operation commencement.

Applicants for licenses for air cargo transport business and general aviation business submit one set of documents directly or through postal services or other appropriate means to the Civil Aviation Authority of Vietnam and bear responsibility for the accuracy and truthfulness of the information in the dossier.8

1. The applicant requesting issuance of an Air Cargo Transportation Business License or a General Aviation Business License shall submit one set of application documents directly or through the postal service or by other appropriate means to the Civil Aviation Authority of Vietnam and shall bear responsibility for the accuracy and truthfulness of the information contained in the application.

2. The application documents for obtaining a license include:

b) A report (with supporting documents) demonstrating compliance with air cargo transport business conditions, including: the plan for the number of aircraft to be operated; the organizational structure plan to ensure aircraft operation and air cargo transport business; the business plan and product development strategy; the proposed brand; the organizational chart of the enterprise;

b) A report (accompanied by supporting documentation) on compliance with air cargo transportation business conditions, including: plans for the number of aircraft to be operated; organizational plans for ensuring aircraft operations, air cargo transportation business, business strategies, and product development; proposed trademarks; organizational structure diagrams of the enterprise;

c) Original document confirming the capital;

d) A copy from the original book or a copy with the original presented for verification or a certified copy (in case of direct submission); a certified copy (in case of submission via postal service) of the following documents: appointment decision, labor contracts, copies of professional certificates of individuals responsible as specified in Article 7 of this Decree;

d) Framework agreement or agreement regarding the purchase, lease-purchase, or lease of aircraft;

e) Copy of the Enterprise Operation Regulations;

g) A list of shareholders and members at the time of submitting the application; the list of shareholders and members must include full information: Full name; date of birth; nationality; place of permanent residence registration; current address; shareholding ratio or number of shares held; representative managing the shareholding portion for organizational shareholders, members; capital contribution agreements among shareholders, members (certified copies or copies with the original presented for verification).

3. In cases where the application documents are incomplete, within three working days from the date of receipt of the documents, the Vietnam Civil Aviation Authority must provide a written response to the applicant and guide the completion of the documents according to regulations.

4. Within twenty days from the date of receiving all required documents, the Vietnam Civil Aviation Authority reports to the Ministry of Transport the results of the review.

5. Within fifteen days from the date of receiving the assessment report from the Civil Aviation Authority of Vietnam, the Ministry of Transport will review and submit to the Prime Minister. If the Ministry of Transport does not approve the assessment result, it will issue a written response to the Civil Aviation Authority of Vietnam detailing the reasons.

6. Within ten days from the date of receiving the Memorandum from the Ministry of Transport, the Prime Minister will review and authorize the Ministry of Transport to issue an Air Cargo Transportation Business License or a General Aviation Business License. If permission is denied, the Prime Minister will notify the Ministry of Transport and specify the reasons.

7. Within five working days from the date of receiving the written opinion of the Prime Minister, the Ministry of Transport will issue the license according to Model No. 02 stipulated in the Appendix issued together with this Decree or notify the opinion of the Prime Minister regarding the non-issuance of an Air Cargo Transportation Business License or a General Aviation Business License.

Article 11. Procedures for Reissuing Air Transport Business Licenses and Common Air Business Licenses9

1. An Air Cargo Transportation Business License or a General Aviation Business License will be reissued in cases of loss, damage, deterioration, changes in the contents of the license, or revocation due to failure to meet the conditions prescribed in point a, c, d, đ Clause 1 Article 12 of this Decree..

2. An air cargo transportation business enterprise shall submit one set of reissue application documents directly or through the postal service or by other appropriate means to the Civil Aviation Authority of Vietnam and shall bear responsibility for the accuracy and truthfulness of the information contained in the application.

3. For licenses reissued due to changes in the content of the license:

a) The documents include: A request for reissuance of the license according to Form No. 01 prescribed in the Appendix issued together with this Decree; related documents concerning changes to the contents of the License (if applicable);

c) Within three working days from the date of receipt of the Civil Aviation Administration of Vietnam's review report, the Ministry of Transport shall reissue the license in accordance with the annex issued together with this Decree. In case of disapproval, the Ministry of Transport shall notify the Civil Aviation Administration of Vietnam in writing to respond to the applicant in writing and specify the reasons.

c) Within three working days from the date of receiving the assessment report from the Civil Aviation Authority of Vietnam, the Ministry of Transport will reissue the license according to Model No. 02 stipulated in the Appendix issued together with this Decree. If approval is not granted, the Ministry of Transport will issue a written notification to the Civil Aviation Authority of Vietnam to respond to the applicant in writing and specify the reasons.

c) Within two working days from the date of receipt of the Civil Aviation Administration of Vietnam's report, the Ministry of Transport shall consider reissuing the license in accordance with

a) The documents include: A request for reissuance of the license according to Form No. 01 prescribed in the Appendix issued together with this Decree;

5. For licenses reissued due to revocation:

c) Within two working days from the date of receiving the report from the Civil Aviation Authority of Vietnam, the Ministry of Transport will consider and reissue the license according to Model No. 02 stipulated in the Appendix issued together with this Decree. If approval is not granted, the Ministry of Transport will issue a written notification to the Civil Aviation Authority of Vietnam to respond to the applicant in writing and specify the reasons.

point a, b, c, d, đ, g Clause 2 Article 10 of this Decree;

b) If the application is not valid, within three working days from the date of receipt of the application, the Civil Aviation Administration of Vietnam must issue a written response to the applicant and guide them to complete the application in accordance with the regulations; c) Within fifteen days from the date of receipt of all required documents, the Civil Aviation Administration of Vietnam shall report to the Ministry of Transport the results of the review;;

d) Within three working days from the date of receipt of the Civil Aviation Administration of Vietnam's review report, the Ministry of Transport shall reissue the license in accordance with

6. The reissued license must include the content of the cancellation of the lost, damaged, deteriorated, or content-changed license or the revoked license.

d) Within three working days from the date of receiving the assessment report from the Civil Aviation Authority of Vietnam, the Ministry of Transport will reissue the license according to Model No. 02 stipulated in the Appendix issued together with this Decree. If approval is not granted, the Ministry of Transport will issue a written notification to the Civil Aviation Authority of Vietnam to respond to the applicant in writing and specify the reasons.

1. Air Cargo Transport Business Licenses and Common Air Business Licenses shall be revoked in the following cases:

Article 12. Revocation of Air Transport Business Licenses and Common Air Business Licenses10

c) Ceasing air cargo transport operations for a continuous period of thirty-six months;

d) Not obtaining an Aircraft Operator Certificate within thirty-six months from the date of issuance of the license;

b) Intentionally falsifying information in the application dossier;

đ) The Aircraft Operator Certificate being withdrawn or revoked for more than thirty-six months without reissuance;

e) Operating contrary to the purpose or content stated in the license;

g) Serious violation of laws on national security and defense;

h) Serious violation of laws on aviation security, aviation safety, organizational structure, and air cargo transport operations, common air operations;

i) Ceasing operations in accordance with the law or at the request of the air cargo transport enterprise;

k) No longer meeting the conditions for issuing the license as stipulated by law.

2. In the event of revocation of the license, the Ministry of Transport shall issue a decision to revoke the license and the enterprise must immediately cease air cargo transport operations.

k) No longer meets the conditions for issuing the License as provided by law.

2. In the case where the License is revoked, the Ministry of Transport shall issue a decision to revoke the license, and the enterprise must immediately cease its air cargo transportation business.

Article 12a. Notifications of Changes to Enterprises11

Air cargo transportation enterprises must notify the Civil Aviation Administration of Vietnam in writing within thirty days from the date of implementation regarding the following contents:

1. Amendments to the Charter of Operations and the Charter of Transportation;

2. Confirmation certificates on changes to the business registration content when there are changes to the business registration content;

3. Changes to organizational structure as stipulated in Article 7 of this Decree;

4. Changes to members of the management board;

5. Changes to shareholders holding five percent or more of the charter capital.

Article 12b. Management of Air Transport Business Activities12

1. Air cargo transportation enterprises may conduct air cargo transportation after meeting the regulations on Aircraft Operators issued by the Minister of Transport.

2. Air cargo transportation enterprises must ensure that the number of leased aircraft with flight crews meets the following criteria simultaneously:

a) Not exceeding thirty percent of the total number of aircraft;

b) Not exceeding ten aircraft.

Article 12c. Management Measures for Air Transport Rights13

1. Airlines granted air transport rights shall comply with confirmed flight schedules and takeoff and landing times.

2. The Civil Aviation Administration of Vietnam shall implement measures to ensure compliance with confirmed flight schedules and takeoff and landing times of airlines.

Article 12d. Management of Aircraft Imported into Vietnam14

b) For aircraft used for cargo, mail, and express delivery, and mixed air transportation: Not exceeding fifteen years from the date of manufacture to the date of importation into Vietnam under purchase or lease-purchase contracts; not exceeding twenty-five years from the date of manufacture to the end of lease contracts;

a) For aircraft used for passenger transport: Not more than ten years from the date of manufacture to the date of importation into Vietnam under purchase or lease-purchase contracts; not more than twenty years from the date of manufacture to the end of the lease contract. For helicopters, not more than twenty-five years from the date of manufacture to the end of the lease contract;

b) For aircraft used for cargo, mail, and express delivery, and general aviation business: Not more than fifteen years from the date of manufacture to the date of importation into Vietnam under purchase or lease-purchase contracts; not more than twenty-five years from the date of manufacture to the end of the lease contract;

c) Other types of aircraft not covered by points a and b of this clause: Not more than twenty years from the date of manufacture to the date of importation into Vietnam under purchase or lease-purchase contracts; not more than thirty years from the date of manufacture to the end of the lease contract.

2. Aircraft types imported into Vietnam must be certified by the Federal Aviation Administration (FAA) of the United States, the European Union Aviation Safety Agency (EASA), or the Vietnamese Civil Aviation Authority.

3.15 Article 13. Conditions for Airport and Airport Terminal Business Operations

 

Chapter III. AIRPORT OPERATIONS

 

2. Issuance of an Airport and Airport Terminal Business Operation License upon meeting the conditions prescribed at

1\. The establishment of an airport business entity and the transfer of shares or capital contributions of an airport business entity to foreign investors shall be subject to the approval of the Minister of Transport.

2. Is granted an Airport and Airfield Business License when meeting the conditions stipulated at Article 14 of this Decree.

Article 14. Conditions for Issuing a Business License for Civil Aviation Airports16

1\. Provide documentation explaining compliance with the conditions for ensuring aviation safety and security as stipulated in Clause 2, Article 63 of the Civil Aviation Law of Vietnam and Annex 14 of the International Civil Aviation Organization Convention.

2. Meeting the capital requirements as follows:

a) The minimum capital required to establish and maintain an airport business: 100 billion Vietnamese dong;

b) The proportion of foreign investor's capital shall not exceed 30% of the registered capital.

 

Chapter IV. AIR TRANSPORT SERVICES OPERATIONS

 

Article 15. Conditions for Operating Air Transport Services at Airports

1. Air transport services at airports include:

a) Passenger terminal operation service;

b) Airfield operation service;

c) Terminal and cargo warehouse operation service;

d) Aircraft fuel supply service;

đ) Ground commercial technical support service;

e) In-flight catering service;

g) Aircraft and equipment repair and maintenance service;

h) Air navigation service;

i) Aviation security service.

2\. An enterprise may conduct the air transport services specified in Clause 1 of this Article after obtaining an Air Transport Service Provision License at airports, provided that the cases specified in Clauses 3 and 4 of this Article are excluded.

3. Airfield operation services shall be provided by the airport company or organizations entrusted by the Ministry of Transport to manage the airport infrastructure.

4. Aviation security services shall be provided by the aviation security force established in accordance with Article 195 of the Civil Aviation Law of Vietnam.

Article 16. Conditions for Issuing a License for Providing Air Services at Civil Aviation Airports17

1.18 Comply with the conditions set forth in Points b, c, d of Clause 2, Article 65 of the Civil Aviation Law of Vietnam and undergo assessment by the Vietnam Civil Aviation Authority according to the corresponding service sectors as prescribed. 2. Minimum capital required to establish and maintain an air transport service business at airports:.

2. Minimum capital required to establish and maintain enterprises providing air services at civil aviation airports:

c) Aircraft fuel supply service: 30 billion Vietnamese dong.

An airport business providing passenger terminal operation service and terminal and cargo warehouse operation service does not need to comply with the conditions set out in Points a and b of Clause 2 of this Article.

3. For businesses providing passenger terminal operation service, cargo terminal operation service, aircraft fuel supply service, ground commercial technical support service, and airfield operation service, the proportion of foreign individual or organization's contribution shall not exceed 30% of the business's registered capital.

2a.19 Article 17. Capital Conditions

3\. For enterprises providing passenger terminal operation services, cargo terminal operation services, aviation fuel supply services, ground commercial technical support services, and airfield operation services, the proportion of foreign individuals' and organizations' capital contributions shall not exceed 30% of the charter capital of the enterprise.

a) Passenger terminal operation service: 30 billion Vietnamese dong;

b) Terminal and cargo warehouse operation service: 30 billion Vietnamese dong;

a\. Passenger terminal operation service: VND 30 billion;

b\. Cargo terminal operation service: VND 30 billion;

c\. Aviation fuel supply service: VND 30 billion.

2\. For enterprises providing passenger terminal operation services, cargo terminal operation services, aviation fuel supply services, ground commercial technical support services, and airfield operation services, the proportion of foreign individuals' and organizations' capital contributions shall not exceed 30% of the charter capital of the enterprise.

Article 18. Procedures for Issuing a License for Providing Air Services at Civil Aviation Airports20

1.21 Individuals and organizations applying for an Air Transport Service Provision License at airports must submit one set of application documents directly, through postal services, via electronic means, or other methods to the Vietnam Civil Aviation Authority and bear responsibility for the accuracy and truthfulness of the information in the application. The application includes:

a) An application form for the license according to Form No. 03 attached to this Decree;

b) A copy of the enterprise's explanation document on compliance with the provisions stipulated in Clause 1 of Article 16 of this Decree;;

c) Original or certified electronic copy of the capital confirmation document, except in cases specified in Clause 2a of Article 16 of this Decree..

2.22 Within 12 days from the date of receiving complete application documents, the Vietnam Civil Aviation Authority shall issue an Air Transport Service Provision License at airports according to Model No. 04 attached to this Decree. In case of refusal to issue the license, a written response must be sent to the applicant, specifying the reasons.

If the application is incomplete, within three working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam must send a written response guiding the applicant to complete the application in accordance with regulations.

The results will be delivered at the Civil Aviation Authority of Vietnam's office, through postal services, electronically, or by other appropriate methods as prescribed.

3. The Civil Aviation Authority of Vietnam shall notify the Air Port Control Unit about the issuance of the permit for inspection and supervision purposes.

Article 19. Procedures for Reissuing Air Service Supply Permit at Airports

1. An Air Service Supply Permit may be reissued if it is lost, damaged, or if there are changes in its contents.

2\. Enterprises submit applications for reissuing an Air Transport Service Provision License at airports directly, through postal services, via electronic means, or other methods.23 to the Civil Aviation Authority of Vietnam and bear responsibility for the accuracy and truthfulness of the information in the application. The application includes:

a) A request for reissuing the license according to Form No. 03 as prescribed in the attached Appendix to this Decree;

b)24 Copies of relevant documents related to changes in the permit's contents (if applicable).

3\. For licenses reissued due to changes in content: Within five working days from the date of receiving complete application documents, the Vietnam Civil Aviation Authority shall reissue the Air Transport Service Provision License at airports; if the license is not issued, a written response must be sent to the applicant, specifying the reasons.

4\. For licenses reissued due to loss, damage, or deterioration: Within three working days from the date of receiving the request, the Vietnam Civil Aviation Authority shall examine and decide on reissuing the license or notify the applicant in writing of the reasons for refusal.

5. The Civil Aviation Authority of Vietnam shall notify the Air Port Control Unit about the reissuance of the permit for inspection and supervision purposes.

6.25 The results will be delivered at the Civil Aviation Authority of Vietnam's office, through postal services, electronically, or by other appropriate methods as prescribed.

Article 20. Revocation of Air Service Supply Permit at Airports

1. An Air Service Supply Permit shall be revoked in the following cases:

a) Providing false information during the permit application process;

b) Failure to maintain the minimum capital continuously during operation;

c) Serious violation of laws on national defense and security;

d) Ceasing operations as prescribed by law or upon the enterprise's request;

đ) Being warned by the Civil Aviation Authority of Vietnam for the third time within twelve months without rectification;

e) Serious violation of regulations on aviation security, aviation safety, business conditions, service prices, fire prevention and extinguishing, environmental protection;

g) Not commencing air service supply at airports within twelve months from the date of permit issuance.

2\. The Vietnam Civil Aviation Authority issues a decision to revoke the license's validity, specifying the reasons. Air transport service providers at airports must immediately cease service provision in accordance with the decision issued.

 

Chapter V. SERVICES OF AIRCRAFT DESIGN, PRODUCTION, MAINTENANCE, TESTINGAND AIRCRAFT ENGINES, AIRCRAFT PROPELLERS, AND AIRCRAFT EQUIPMENTAIRCRAFT

 

Article 21. Conditions for providing aircraft maintenance services, aircraft engine propeller maintenance services, and aircraft equipment maintenance services in Vietnam26

1. Organizations providing aircraft maintenance services, propeller maintenance services, and aircraft equipment maintenance services in Vietnam must be granted an Approval Certificate for Maintenance Organizations by the Civil Aviation Authority of Vietnam.

2. Conditions for issuing an Approval Certificate for Maintenance Organizations include having documentation explaining the maintenance organization in accordance with regulations issued by the Minister of Transport.

3. This provision only applies to the maintenance of aircraft, propellers, and aircraft equipment in Vietnam for aircraft registered under Vietnamese nationality.

Article 22. Conditions for design, production, or testing facilities for aircraft, aircraft engines, aircraft propellers, and aircraft equipment in Vietnam27

1\. An entity engaged in aircraft design, production, or testing, aircraft engine design, production, or testing, aircraft propeller design, production, or testing, and aircraft equipment design, production, or testing shall be issued by the Civil Aviation Administration of Vietnam a Certificate of Approval for Design, Production, or Testing Organization of Aircraft, Aircraft Engines, Aircraft Propellers, and Aircraft Equipment accordingly.

2\. The conditions for issuing a Certificate of Approval for Design, Production, or Testing Organization of Aircraft, Aircraft Engines, Aircraft Propellers, and Aircraft Equipment in Vietnam as stipulated in Clause 1 of this Article include:

a) Having documentation explaining the design, production, or testing organization for aircraft, aircraft engines, propellers, and aircraft equipment in Vietnam that demonstrates the organization's capability;

b) Having manufacturing, design, production, maintenance, and testing procedures.

3. This applies only to cases where aircraft, aircraft engines, aircraft propellers, and aircraft equipment are designed, manufactured, or tested in Vietnam pursuant to a Type Certificate issued by the Civil Aviation Authority of Vietnam.

 

Chapter VI. OPERATIONS OF AIR TRAFFIC SERVICES

 

Article 23. Conditions for operating air traffic service businesses28

1\. The Civil Aviation Administration of Vietnam shall issue an operating permit for air traffic service facilities and systems, and technical equipment when such facilities and systems meet the requirements of technical standards and specifications for civil aviation.

2. Meeting the capital requirements as follows:

a) Enterprises providing air navigation services, aviation information services, search and rescue services must be state-owned enterprises;

b) For enterprises providing air navigation surveillance information services and aviation meteorological services, the state-owned capital ratio must not be less than 65% of the registered capital, and the foreign individual and organization contribution ratio must not exceed 30% of the enterprise's registered capital.

 

Chapter VII. OPERATIONS OF TRAINING AND SKILL DEVELOPMENT SERVICES FOR AVIATION PERSONNELAVIATION AUTHORITY

 

Article 24. Conditions for Operating Training and Skill Development Services for Aeronautical Personnel

The Civil Aviation Authority of Vietnam grants a Certificate of Eligibility for Training and Skill Development Services for Aeronautical Personnel when meeting the following requirements:

1. Requirements for organizational structure, physical facilities, equipment, and faculty as specified in Articles 25 and 26 of this Decree;

2. Requirements for training programs, textbooks, and training materials as prescribed by the Minister of Transport.

Article 25. Requirements for training institutions for aviation personnel29

Training institutions for aviation personnel business skills must meet the following requirements:

1. Provide documentation explaining that the physical facilities meet the technical standards and specifications for the aviation industry as prescribed by the Minister of Transport.

2. Provide documentation explaining the training program, textbooks, and training materials as prescribed by the Minister of Transport.

3. Training institutions for aviation personnel business skills must ensure sufficient theoretical and practical instructors so that each specialized aviation subject has at least one instructor.

Article 26. Instructors at training institutions for aviation personnel30

The criteria for aviation instructors must satisfy one of the following requirements:

1. Hold a professional certificate as stipulated in the specialized aviation regulations or have five years of experience working in a related field to the subject being taught.

2. Possess teaching qualifications under the laws on education or vocational training.

Article 27. Procedures for issuing a Certificate of Eligibility for Training Institutions for Aviation Personnel31

1\. Training and skill development organizations for aviation personnel shall submit one set of application documents directly or through postal services or other appropriate means to the Civil Aviation Administration of Vietnam. The application includes the following documents:

a) An application form for a Certificate of Eligibility for Training Institutions for Aviation Personnel according to Form No. 05 prescribed in the Appendix attached to this Decree;

b) Documentation explaining the training organization's compliance with the requirements set forth in Article 25 and Article 26 of this Decree.

2. The content of the documentation explaining the training organization includes:

a) A list of instructors;

b) Report on physical facilities: classrooms, equipment, practice sites suitable for the training content;

c) Report on the curriculum, textbooks, and training materials for theoretical and practical courses related to each subject;

d) Report on organizational structure, management staff, and management documents for training and business skills of aviation personnel.

3.32Within twenty days from the date of receipt of complete applications as prescribed, the Civil Aviation Administration of Vietnam shall review the application, inspect and evaluate the training and skill development organization; request the applicant to provide additional explanations and amendments to relevant contents; issue a Certificate of Eligibility for Training and Skill Development Services for Aviation Personnel to the requesting organization according to Model No. 07 attached to this Decree and deliver the result directly or through postal services or other appropriate means to the requesting organization; in case of refusal, a written response with detailed reasons must be provided.

Article 28. Reissuance of Certificates of Eligibility for Training Institutions for Aviation Personnel Business Skills

1. The certificate will be reissued in cases of loss, damage, or changes in the content of the certificate.

2. The application for reissue includes:

a) An application form according to Form No. 06 prescribed in the Appendix attached to this Decree;

b) Relevant documents concerning changes in the content of the certificate (if applicable).

3\. In cases where a certificate needs to be reissued due to loss, damage, or deterioration: within three working days from the date of receipt of complete applications as prescribed, the Civil Aviation Administration of Vietnam shall reissue the certificate or notify in writing of the refusal to reissue the certificate and specify the reasons.

4.33 In cases where the content of the certificate needs to be amended or supplemented: within fifteen days from the date of receipt of complete applications as prescribed, the Civil Aviation Administration of Vietnam shall review the application, inspect and evaluate the training and skill development organization; request the applicant to provide additional explanations and amendments to relevant contents; reissue the certificate or notify in writing of the refusal to reissue the certificate and specify the reasons.

Article 29. Revocation of Training and Vocational Staff Aviation Business License

1. The license shall be revoked in the following cases:

a) Ceasing operations in accordance with the provisions of the law or at the request of the training and vocational staff aviation business facility;

b) Intentionally falsifying information in the application dossier for the license;

c) Operating contrary to the purpose or not in accordance with the contents recorded in the license;

d) Intentionally violating regulations on ensuring aviation security and safety;

đ) Failing to maintain the conditions stipulated in the issued license;

e) The license being erased or altered.

2\. In cases where the certificate is revoked, the Civil Aviation Administration of Vietnam shall issue a decision to revoke the certificate; the training and skill development organization for aviation personnel must immediately cease operations of the training and skill development services in accordance with the decision of the Civil Aviation Administration of Vietnam.

 

Chapter VIII. IMPLEMENTATION PROVISIONS

 

Article 30. Responsibilities of Enterprises Engaged in Conditional Businesses in the Civil Aviation Sector

1. Operating in accordance with the purposes and contents recorded in the permit or certificate issued by the competent authority.

2. Maintaining the conditions for obtaining permits or certificates as prescribed in this Decree.

3. Adhering to operational conditions as stipulated by civil aviation laws.

4. For businesses operating under conditions requiring minimum capital, they must submit audited financial reports annually to the Vietnam Civil Aviation Authority for the purpose of inspecting and supervising the maintenance of the minimum capital as stipulated in this Decree.

Article 31. Effective Date34

1. This Decree takes effect from July 1, 2016.

2. This Decree abolishes:

a) Articles 5 to 19 of Decree No. 30/2013/NĐ-CP dated April 8, 2013 of the Government on air cargo transportation business and general aviation activities;

b) Articles 36, 37, Clause 1 of Article 38, Clauses 1 and 2 of Article 39 of Decree No. 102/2015/NĐ-CP dated October 20, 2015 of the Government on management and operation of civil airports.

3. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, organizations, and individuals related shall be responsible for implementing this Decree./.

Pursuant to the Investment Law dated November 26, 2014 and the Law Amending and Supplementing Article 6 and Appendix 4 on the List of Business Fields Subject to Investment Conditions of the Investment Law dated November 22, 2016;

At the proposal of the Minister of Transport;

The Government promulgates the Decree amending and supplementing some articles of Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government on conditional business sectors in the civil aviation industry and Decree No. 30/2013/ND-CP dated April 8, 2013 of the Government on air transport business and common air services.".

Decree No. 64/2022/ND-CP amending and supplementing some articles of Decrees relating to business operations in the civil aviation industry, based on the following grounds:

"Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

On the basis of the Civil Aviation Law dated June 29, 2006; the Law Amending and Supplementing Some Articles of the Civil Aviation Law dated November 21, 2014;

The Government promulgates this Decree amending and supplementing some articles of Decrees related to business operations in the civil aviation sector.”

Decree No. 15/2024/ND-CP amending and supplementing some articles of Decree No. 30/2013/ND-CP dated April 8, 2013 of the Government on air cargo transport business and common aviation activities and Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government stipulating business sectors and occupations with conditions in the civil aviation sector, is promulgated based on the following grounds:

"On the basis of the Law on Government Organization dated June 19, 2015; the Law Amending and Supplementing Some Articles of the Law on Government Organization and the Law on Local Administration dated November 22, 2019;

34 Articles 3 and 4 of Decree No. 89/2019/ND-CP amending and supplementing certain articles of Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government on business sectors and occupations subject to conditions in the civil aviation sector and Decree No. 30/2013/ND-CP dated April 8, 2013 of the Government on air cargo transportation business and common aviation activities, which took effect from January 1, 2020, are stipulated as follows:

Article 3. Effectiveness

1. This Decree shall take effect from January 1, 2020.

2. Repeal Article 13 and Article 17 of Decree No. 92/2016/NĐ-CP dated July 1, 2016, of the Government on industries and trades subject to conditions in the civil aviation sector.

3. Repeal Article 20 of Decree No. 30/2013/NĐ-CP dated April 8, 2013, of the Government on air transport business and common aviation activities.

Article 4. Responsibilities for Implementation

1. The Ministry of Transport shall organize the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for implementing this Decree./.

Article 4 of Decree No. 64/2022/ND-CP amending and supplementing certain articles of decrees related to business operations in the civil aviation sector takes effect from September 15, 2022, and is stipulated as follows:

Article 4. Effective date

1. This Decree shall take effect from September 15, 2022.

2. Repeal Decree No. 07/2019/ND-CP dated January 23, 2019, of the Government amending and supplementing certain articles of Decree No. 68/2015/ND-CP dated August 18, 2015, of the Government on registration of nationality and rights to aircraft (hereinafter referred to as Decree No. 07/2019/ND-CP).

3. For administrative procedures' files submitted to the Civil Aviation Authority of Vietnam before the effective date of this Decree, the provisions of Decree No. 68/2015/ND-CP; Decree No. 07/2019/ND-CP; Decree No. 92/2016/ND-CP; Decree No. 89/2019/ND-CP; and Decree No. 05/2021/ND-CP shall continue to be applied.

4. The Minister, the head of a ministerial-level agency, the head of a government-affiliated agency, and the Chairman of the People's Committee of a province or centrally governed city shall be responsible for implementing this Decree./”

Article 3 of Decree No. 15/2024/ND-CP amending and supplementing certain articles of Decree No. 30/2013/ND-CP dated April 8, 2013, of the Government on air transport business and general aviation activities and Decree No. 92/2016/ND-CP dated July 1, 2016, of the Government on conditional business sectors in the civil aviation sector takes effect from February 16, 2024, and is stipulated as follows:

“Article 3. Effective Date

1. This Decree takes effect from the date of issuance.

2. Certificates of Registration for General Aviation Activities and Certificates of Registration for Brand Usage issued before the effective date of this Decree shall continue to be valid until such certificates are revoked.

3. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for implementing this Decree./.
