THE MINISTER OF THE MINISTRY OF HOME AFFAIRS
Pursuant to Decree No. 102/SL-L004 dated May 20, 1957, on the right to establish associations;
Pursuant to Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government on the organization, operation, and management of associations;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Considering the proposal of the Chairman of the Vietnam Association of Economic Geology and the Director of the Department for Non-Governmental Organizations,
DECISION:
Article 1. Approves the Charter of the Vietnam Association of Economic Geology which was adopted at the First National Congress of the Association on July 9, 2005.
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Chairman of the Vietnam Association of Economic Geology and the Director of the Department for Non-Governmental Organizations shall be responsible for implementing this Decision.

VIETNAM ASSOCIATION OF ECONOMIC GEOLOGY

PART I
GENERAL PROVISIONS
Article 1. Name of the Association
The Association has the name: Vietnam Association of Economic Geology.
English name for transactions: Vietnam Association of Economic Geology.
Article 2. Aims and Objectives
1. The Vietnam Association of Economic Geology (hereinafter referred to as the Association) is a voluntary social-professional organization of Vietnamese citizens engaged in the field of economic geology.
The Vietnam Association of Economic Geology is a member of the Vietnam Geological Society, operating within the framework of the laws of the Socialist Republic of Vietnam and according to the Charter of the Association.
2. The purpose of the Association is to widely unite those working in the fields of economic geology, mainly research, exploration, exploitation, processing, and mineral services, to help each other promote talent and intelligence, improve professional skills and occupational ethics, contribute to the development of the country's mineral raw material industry serving the industrialization and modernization of the nation, and contribute to building a prosperous, equitable, democratic, and civilized Vietnam.
Article 3. Scope of Activities
The Vietnam Association of Economic Geology operates throughout the country, with its headquarters in Hanoi. The Association has legal personality, a seal, separate assets and finances, and a bank account.
The Vietnam Association of Economic Geology may join organizations in the same field in the region and internationally in accordance with the law.
Chapter II
TASKS, POWERS, AND METHODS OF OPERATION
Article 4. Tasks and Powers
1. Mobilize members to fully contribute their enthusiasm and capabilities to geological survey, research, exploration, evaluation of minerals and the geological environment, and mineral services to achieve high economic efficiency, meeting the needs of national socio-economic development.
2. Encourage, assist, and contribute to the continuous training of members to enhance their scientific and technological knowledge and skills in related fields.
3. Participate in information dissemination and popularization of scientific and technical knowledge and economic geology in the specialized fields of geology and minerals both domestically and internationally in accordance with the law.
4. Study and apply new theories, scientific and technological advancements, and economic geology experiences from both domestic and international sources into geological surveys, research, evaluation, mineral services, and the geological environment, continuously improving economic efficiency.
5. Conduct scientific research activities in geology and minerals and mineral services (geological surveys and evaluations, construction of mineral maps and planning for exploration, exploitation, and utilization of minerals. Consulting on the development and utilization of mineral resources for economic sectors, localities, trade services, and introduction of mineral products). Participate in evaluating projects and reports on research, surveys, evaluations, exploration, and exploitation of minerals.
6. Carry out activities in accordance with the law through the application of technological advancements and mineral service technologies to generate income for the Association's fund.
7. Exchange experiences and participate in work with domestic and foreign scientific and technical organizations on geology and minerals in accordance with the law.
Article 5. Methods of Operation
1. Organize and participate in organizing scientific conferences and seminars to exchange information on specialties related to Geology - Mineral Resources and Economic Geology.
2. Organize training courses and professional skill enhancement for members and those interested.
3. Participate in writing and publishing books and journals related to Geology - Mineral Resources and Economic Geology.
4. Participate in organizing and implementing scientific and technical research projects and economic geology topics in fields related to Geology - Mineral Resources, geological environment, and Economic Geology.
5. Expand cooperation relationships with domestic and foreign associations in accordance with the law to exchange information, learn from experiences, and seek assistance. Scientific and technological forms suitable for consulting and transferring mineral raw material technology to generate association funds in accordance with the law.
Chapter III
MEMBERS
Article 6. Members and Membership Standards
1. Vietnamese citizens engaged in geological survey, research, exploration, and mineral resource service processing both inside and outside the Geology sector, who have made significant contributions to scientific and technical research in the field of Geology - Mineral Resources and Economic Geology, may be considered and admitted as members of the Association upon voluntary application.
2. Vietnamese citizens both domestically and abroad with knowledge of the field of Geology - Mineral Resources and Economic Geology, contributing to the development of the Association, agreeing with the Charter but not yet meeting the conditions to become formal members, may be recognized as associated members. Associated members enjoy rights and obligations like other members of the Association, except for the right to nominate and vote for the Executive Board and leadership positions within the Association and do not participate in voting on Association issues.
3. The procedures for admitting and excluding members are stipulated by the Central Executive Committee of the Association.
Article 7. Obligations and Benefits of Members
1. Members have the obligation:
a) To respect the Charter of the Association, strictly comply with directives and resolutions of the Association, promote member recruitment, and mobilize public support for all Association activities;
b) To disseminate and popularize knowledge about Geology, Mineral Resources, Economic Geology, and environmental protection among the general public;
c) To pay membership fees according to regulations.
2. Members have the right:
a) To participate in Association activities, receive assistance from the Association to participate in scientific and technical activities and training;
b) To discuss and vote on all Association matters; nominate and vote for Association bodies;
c) To receive assistance and training in science and technology from the Association; be provided opportunities to implement research projects or innovative improvements; have their legitimate occupational rights protected by the Association; enjoy other benefits stipulated by the Association;
d) To request withdrawal from the Association or join other Associations.
Chapter IV
ORGANIZATION AND PRINCIPLES OF ASSOCIATION ACTIVITY
Article 8. Organizational Principles
The Association operates voluntarily, self-managed, financially autonomous, and legally responsible; united, democratic, collective leadership, individual responsibility, majority decision-making. Leadership bodies at all levels of the Association are elected; each level of the Association decides issues within its scope of responsibility and authority but must not contravene the Charter, resolutions of the Congress, and state laws.
Article 9. Organizational Structure
1. National Congress of Delegates.
2. Central Committee of the Association.
3. Inspection Board of the Association.
4. Office of the Association.
5. Basic Branches.
Article 10. National Congress of Delegates
The highest leading body of the Association is the National Congress of Delegates with a term of five years. The Central Committee of the Association may decide to convene the Congress earlier if more than two-thirds of the Central Committee members or more than half of the basic organizations request it. The composition and number of delegates (if it is a Congress of Delegates) are elected by the basic organizations according to the ratio of members specified by the Central Committee of the Association. The number of invited delegates shall not exceed 10% of the number of convened delegates.
The tasks of the National Congress of the Association include:
1. Discussing and approving the report on the previous term.
2. Deciding on the objectives and directions for work in the upcoming term.
3. Approving the amended Charter (if applicable).
4. Electing the Central Committee of the Association.
Article 11. Voting Principles at the Congress
1. Resolutions of the Congress are decided by a majority present at the Congress.
2. Specifically, for the following particularly important issues, approval must be obtained from more than two-thirds of the members present and that number must exceed half of the total number of members of the Association:
a) Amending or supplementing the Charter;
b) Dismissing some members of the Central Committee;
c) Dissolving and liquidating the assets of the Association.
Article 12. Central Committee of the Association
The Central Committee of the Association is the leading body of the Association between two Congresses. The Central Committee of the Association meets regularly once a year, and extraordinary meetings can be organized when more than half of the Central Committee members request it, convened by the President of the Association.
The tasks of the Central Committee of the Association include:
1. Implementing the resolutions of the Congress;
2. Leading the work of the Association during the period between two Congresses;
3. Electing the Standing Board consisting of the President, Vice-Presidents, General Secretary, and Standing Members;
4. Electing the Inspection Board of the Central Association. The Head of the Inspection Board is a Standing Member of the Central Association;
5. When necessary, it has the right to elect additional central members but the number shall not exceed one-third of the members elected by the Congress;
The election of leadership positions within the Association shall be conducted through secret ballot or show of hands, with the method chosen by the Congress.
Article 13. Standing Board
The Standing Board is the permanent body of the Central Committee of the Association, responsible for implementing the resolutions of the Congress, and those of the Central Committee. The Standing Board meets every three months; in case of necessity or upon the proposal of the President of the Association, the Standing Board may hold extraordinary meetings.
The tasks of the Standing Board include:
1. Representing the Central Committee of the Association to direct and manage the activities of the Association according to the resolutions of the Congress, the resolutions of the Central Committee of the Association, and must report on the situation of activities between two meetings of the Central Committee;
2. Deciding on the establishment, appointment, dismissal, commendation, and disciplinary actions of cadres of specialized departments and subordinate organizations according to the provisions of the law; deciding on the admission of new members according to the regulations of the Association's Charter and in accordance with the law;
3. Depending on the requirements of work, the Standing Board may establish other departments and organizations to assist in work and define their responsibilities and authorities.
Article 14. Supervisory Board
The Supervisory Board operates independently in its professional activities and is directly guided by the Central Executive Board of the Association. The tasks and powers of the Supervisory Board are defined as follows:
1. Inspect the implementation of the Association's Charter, the execution of resolutions of the Congress, and decisions of the Central Executive Board and the Executive Board of the Association.
2. Examine and resolve complaints and petitions related to members and Association organizations in accordance with the law.
3. Has the right to request members and organizations, units of the Association to report on issues related to the inspection content approved by the Central Executive Board of the Association in accordance with the law.
4. The Supervisory Board has its own program of activities or operates upon the proposal of the President of the Association and the decision of the Central Executive Board of the Association.
Article 15. President of the Association
The President of the Association is elected by the Central Executive Board of the Association; the President has the following responsibilities:
1. Chair meetings of the Executive Board, the Executive Board, and annual meetings of the Association.
2. Direct the activities and decide matters of the Association according to the resolutions of the Congress, the Executive Board, and the Executive Board of the Association.
3. Represent the Association in internal and external relations.
4. Be responsible before the Executive Board, the Executive Board, and members for the activities of the Association.
5. Is the first account holder of the Association.
6. Chair the meeting of the next term Executive Board until a new President is elected.
Article 16. Vice Presidents
1. The Vice Presidents are elected by the Central Executive Board of the Association, including one permanent Vice President. The Vice Presidents are assigned by the President to lead certain aspects of the Association's work, have responsibilities and powers within the scope of their assignment and as stipulated in the Operational Regulations of the Central Executive Board of the Association.
2. When the President of the Association is absent, the permanent Vice President performs the duties of the President.
Article 17. Secretary General
The Secretary General is elected by the Central Executive Board of the Association, with the following responsibilities:
1. Continuously handle Association affairs as assigned by the President, assist the President in implementing daily activities of the Central Association Office; directly direct the Office and other specialized agencies of the Association (if any).
2. Perform the function of internal and external communication for the Association.
3. Organize secretarial work and compile documents for congresses, Executive Board meetings, Executive Board meetings, and annual meetings of the Association.
4. The Secretary General is the second account holder of the Association, responsible for managing the Association's assets as assigned by the President.
5. The Secretary General has an office and some staff proposed by the Secretary General, reviewed and decided by the President of the Association.
6. The Secretary General may concurrently hold the position of Director of the Office.
Chapter V
FINANCE AND ASSETS OF THE ASSOCIATION
Article 18. Sources of Income of the Association
1. Membership fees contributed by members.
2. Donations and sponsorships from organizations and individuals both domestically and internationally in accordance with the law.
3. Revenue from lawful business and service activities.
Article 19. Financial and Asset Management
1. The Association's assets and finances are managed and utilized in accordance with regulations of the Executive Board of the Association and comply with current management systems of the State.
2. When the Association is dissolved, its assets and finances must be inventoried and disposed of in accordance with the law.
Chapter VI
REWARDS AND DISCIPLINE
Article 20. Awards
Staff, members, and organizations of the Association who achieve outstanding results will be rewarded by the Association and recommended for rewards by the State and local authorities. The form of reward is determined by the Central Executive Board of the Association.
Article 21. Disciplinary Measures
1. Cadres, members, and organizations of the Association that seriously violate the Charter of the Association shall be subject to disciplinary measures. The forms of disciplinary measures shall be prescribed by the Central Executive Board of the Association.
2. In cases where national laws are violated, administrative penalties or criminal responsibility shall be pursued according to the provisions of the law.
Chapter VII
IMPLEMENTING PROVISIONS
Article 22. Effectiveness of the Charter
1. This Charter consists of 7 chapters and 22 Articles and was unanimously approved at the First National Congress of the Vietnam Economic Geology Association on July 9, 2005;
Only the National Congress of the Vietnam Economic Geology Association has the right to amend this Charter;
2. This Charter shall take effect upon approval by the Minister of Home Affairs./.
