On the organization and operation of the Inspection of Information and Communications

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on the Inspection Law dated November 15, 2010;

Pursuant to the Law on Posts dated June 17, 2010;

Pursuant to the Law on Telecommunications dated November 23, 2009;

WHEREAS, the Law on Radio Frequency Spectrum dated November 23, 2009;

Pursuant to the Law on Information Technology dated June 29, 2006;

Based on the Law on Publishing dated November 20, 2012;

Pursuant to the Press Law dated December 28, 1989; the Law Amending and Supplementing Certain Provisions of the Press Law dated June 12, 1999;

At the proposal of the Minister of Information and Communications;

The Government promulgates the Decree on the organization and operation of the Inspection of Information and Communications,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the organization, tasks, powers of the Ministry of Information and Communications' Inspection, the Department of Information and Communications' Inspection, agencies entrusted with the function of specialized inspection in information and communications; the activities of the Inspection of Information and Communications; inspectors, specialized inspection civil servants, and cooperative inspectors of the Inspection of Information and Communications.

Article 2. Inspection Objects

1. Agencies, organizations, and individuals under the direct management authority of the Ministry of Information and Communications and the Department of Information and Communications.

2. Agencies, organizations, and individuals participating in activities within the field of information and communications on the territory, territorial waters, contiguous zones, continental shelf, and exclusive economic zone of the Socialist Republic of Vietnam.

Article 3. Application of International Treaties

Where international treaties to which the Socialist Republic of Vietnam has acceded or joined provide different provisions regarding the organization and operation of the Inspection of Information and Communications, such treaty provisions shall apply.

Chapter II

POSITION, FUNCTION, ORGANIZATION, TASKS, POWERS OF THE INSPECTION OF INFORMATION AND COMMUNICATIONS

Article 4. Agencies performing the function of specialized inspection in information and communications

a) The Ministry of Labor - War Invalids and Social Affairs Inspection (hereinafter referred to as the Ministry Inspection);

a) The Ministry of Information and Communications' Inspection (hereinafter referred to as the Ministry's Inspection).

b) The Department of Information and Communications' Inspection (hereinafter referred to as the Department's Inspection).

b) Market Management Sub-Department under the Department of Industry and Trade (hereinafter referred to collectively as the Sub-Department).

a) The Radio Frequency Management Bureau; Telecommunications Bureau; Broadcasting, Television, and Electronic Information Bureau; Press Bureau; Publishing, Printing, and Distribution Bureau (hereinafter collectively referred to as the Bureaus entrusted with the function of specialized inspection).

b) Regional Radio Frequency Management Centers.

Article 5. Position, function, organization of the Ministry's Inspection

1. The Ministry's Inspection is an agency of the Ministry of Information and Communications, assisting the Minister in state management over inspection work, handling complaints and denunciations, and preventing corruption; conducting administrative inspections against agencies, organizations, and individuals under the management authority of the Ministry of Information and Communications; conducting specialized inspections in the field of information and communications against agencies, organizations, and individuals; handling complaints and denunciations and preventing corruption in accordance with the law.

2. The Ministry's Inspection has a Chief Inspector, Deputy Chief Inspectors, Inspectors, and other civil servants.

The Chief Inspector of the Ministry is appointed, relieved, or dismissed by the Minister of Information and Communications after consultation with the State Inspector General.

The Deputy Chief Inspector of the Ministry is appointed, relieved, or dismissed by the Minister of Information and Communications upon the proposal of the Chief Inspector of the Ministry.

3. The Ministry's Inspection is subject to direction and management by the Minister of Information and Communications; it is subject to guidance on work and organizational and professional matters by the State Inspectorate.

4. The Ministry's Inspection may organize departments to perform assigned tasks. The Minister of Information and Communications shall specify the organization and staffing of the Ministry's Inspection.

5. The Ministry's Inspection has its own seal and separate account.

Article 6. Duties and Authorities of the Inspectorate of the Ministry

1. Drafting the Ministry of Information and Communications' inspection plan for submission to the Minister for approval; organizing the implementation of the inspection plan within the responsibility of the Ministry's Inspection; guiding, inspecting, and urging the drafting and implementation of the inspection plans of the Bureaus entrusted with the function of specialized inspection under the Ministry.

2. Inspecting the implementation of policies, laws, and duties and powers of agencies, organizations, and individuals under the direct management authority of the Ministry of Information and Communications; inspecting state-owned enterprises established by decision of the Minister of Information and Communications.

3. Inspecting the implementation of specialized laws on press; publishing; postal services; telecommunications; radio frequency; information technology, electronics; broadcasting and television; news agencies; foreign information; grassroots information and national information and communication infrastructure; public services in sectors and fields under the Ministry of Information and Communications' state management.

4. Checking the accuracy and legality of inspection conclusions and post-inspection handling decisions of the Bureau Chiefs entrusted with the function of specialized inspection, the People's Committee Chairmen of provinces concerning cases within the field of information and communications when necessary.

5. Taking the lead or participating in drafting normative legal documents assigned by the Minister of Information and Communications.

6. Organizing training in specialized inspection professional matters related to the field of information and communications.

7. Requesting the Bureau Chiefs entrusted with the function of specialized inspection to report on inspection work; compiling and reporting results on inspection work within the scope of the Ministry's state management.

8. Monitoring, inspecting, and urging the implementation of inspection conclusions, recommendations, and handling decisions of the Minister of Information and Communications, the Chief Inspector of the Ministry.

9. Guiding specialized inspection professional matters in information and communications for the Bureaus entrusted with the function of specialized inspection and the Department's Inspection; promoting, guiding, and inspecting agencies and units under the Ministry to implement legal provisions on inspection.

10. Conducting scientific research, summarizing experiences, building, and compiling professional materials on inspection within the scope of the Ministry of Information and Communications' state management.

11. Assisting the Minister of Information and Communications in state management over complaint and denunciation resolution, anti-corruption; performing tasks of complaint and denunciation resolution, anti-corruption according to the law on complaints and denunciations, anti-corruption.

12. Implementing international cooperation in inspection activities, complaint and denunciation resolution, anti-corruption in the field of information and communications.

13. Performing other tasks assigned by the Minister of Information and Communications.

Article 7. Duties and Authorities of the Head of the Inspectorate of the Ministry

1. Direct, guide, and inspect inspection work within the scope of the Ministry of Information and Communications' state management; lead the Ministry's Inspectorate to perform tasks and powers as prescribed by inspection laws and other relevant laws.

2. Take the lead in handling overlapping issues regarding the scope, subjects, contents, and timeframes for inspections within the scope of the Ministry's state management; coordinate with provincial Inspectors to resolve overlapping issues regarding the scope, subjects, contents, and timeframes for inspections at the provincial level.

3. Decide on inspections when signs of law violations are detected and be responsible before the Minister of Information and Communications for such decisions.

4. Decide to reinspect cases that have been concluded by the Director of the Department assigned to carry out specialized inspection functions or the Chairman of the People's Committee of the province but where signs of law violations are discovered upon assignment by the Minister of Information and Communications.

5. Require the Director of the Department assigned to carry out specialized inspection functions to conduct inspections within the scope of the Department's specialized inspection functions when signs of law violations are detected; if the Director of the Department does not agree, have the authority to issue an inspection decision, report it, and be responsible before the Minister of Information and Communications for such decision.

6. Recommend the Minister of Information and Communications to temporarily suspend the execution of incorrect inspection decisions made by agencies or units directly under the Ministry's management.

7. Recommend the Minister of Information and Communications to address issues related to inspection work; if such recommendation is not accepted, report to the Chief Inspector of the Government.

8. Recommend competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; recommend suspending or revoking regulations found to be contrary to the law through inspection work.

9. Administer administrative penalties according to laws on administrative violation handling.

10. Recommend the Minister of Information and Communications to consider responsibility and handle persons under his management who violate the law as discovered through inspections or fail to implement inspection conclusions or decisions; require heads of agencies or organizations to consider responsibility and handle persons under their management who violate the law as discovered through inspections or fail to implement inspection conclusions or decisions.

11. Advise and propose to the Minister of Information and Communications on delegating specialized inspection functions to agencies under the Ministry.

12. Inspect the responsibilities of heads of agencies or units under the Ministry's management in implementing laws on inspection.

13. Summon civil servants or officials from related agencies or units to participate in inspection activities.

14. Report to the Minister of Information and Communications and the Chief Inspector of the Government on inspection work within the scope of their responsibilities.

Article 8. Position and functions of the Department assigned to perform specialized inspection functions

1. The Department assigned to perform specialized inspection functions is an agency under the Ministry of Information and Communications responsible for performing specialized inspection functions within the scope of management of the Department.

2. The advisory unit on specialized inspection work at Departments assigned to perform specialized inspection functions shall be organized into a Division.

3. The Minister of Information and Communications shall stipulate the establishment, tasks, and powers of the advisory unit on specialized inspection work.

Article 9. Tasks and powers of the Telecommunications Department; Broadcasting, Television, and Electronic Information Department; Press Department; Publishing, Printing, and Distribution Department

1. Draft plans for specialized inspections and submit them to the Inspectorate of the Ministry according to the deadline specified in Clause 1 of Article 39 of Decree No. 07/2012/ND-CP dated February 9, 2012 of the Government on agencies assigned to perform specialized inspection functions and specialized inspection activities for consolidation and submission to the Minister of Information and Communications for approval and implementation of the plan.

2. Inspect compliance with specialized laws, technical regulations, and management rules within the scope of management of the Department.

3. Inspect cases showing signs of violation of laws when assigned by the Inspector General of the Inspectorate of the Ministry.

4. Inspect other cases assigned by the Minister of Information and Communications.

5. Monitor, urge, and inspect the implementation of conclusions, recommendations, and decisions on handling inspections made by themselves.

6. Summarize and report the results of specialized inspections to the Inspectorate of the Ministry in accordance with the law and upon request.

7. Dispatch specialized inspection officials to participate in inspection teams of the Inspectorate of the Ministry and related inspection agencies when requested.

8. Perform other tasks as directed by the Inspectorate of the Ministry.

Article 10. Tasks and powers of the Radio Frequency Management Department

1. Carry out the tasks and powers stipulated in Article 9 of this Decree.

2. Direct and guide regional Radio Frequency Management Centers in drafting specialized inspection plans and consolidate them for submission to the Inspectorate of the Ministry.

3. Supervise, urge, and direct the specialized inspection activities of regional Radio Frequency Management Centers.

4. Require regional Radio Frequency Management Centers to report the results of specialized inspections.

Article 11. Tasks and powers of the Head of the Department assigned to perform specialized inspection functions

1. Lead, direct, and inspect specialized inspection work within the scope of specialized management assigned.

2. Decide to conduct inspections when signs of violations of laws are discovered or upon request of the Minister of Information and Communications, the Inspector General of the Inspectorate of the Ministry; such decisions must be reported to the Inspector General of the Inspectorate of the Ministry; assign civil servants to carry out specialized inspection tasks managed by the Department.

3. Recommend the Minister of Information and Communications, the Inspector General of the Inspectorate of the Ministry to handle overlapping issues regarding the scope, subjects, content, and time of inspections within the specialized management scope of the Department assigned to perform specialized inspection functions.

4. Recommend competent state agencies to amend, supplement, or promulgate appropriate regulations in line with management requirements; recommend suspension or revocation of unlawful regulations discovered through inspection work.

5. Impose administrative penalties in accordance with the law on handling administrative violations.

Article 12. Position, functions, tasks, powers of the Regional Radio Frequency Center

1. The Regional Radio Frequency Center is an agency under the Radio Frequency Administration, assigned to perform specialized inspection functions concerning radio frequencies within its administrative jurisdiction.

2. The tasks, powers of the Regional Radio Frequency Center and those of the Director of the Regional Radio Frequency Center shall be stipulated by the Minister of Information and Communications.

Article 13. Position, functions, organization of the Department Inspectorate

1. The Department Inspectorate is an agency of the Department of Information and Communications, assisting the Director of the Department to conduct administrative inspections against agencies, organizations, and individuals within the jurisdiction of the Department of Information and Communications; conducting specialized inspections in the field of information and communications within the jurisdiction of the Department of Information and Communications; resolving complaints and denunciations and preventing corruption in accordance with the law.

2. The Department Inspectorate has a Chief Inspector, Deputy Chief Inspector, Inspectors, and other civil servants.

The Chief Inspector of the Department is appointed, relieved, or dismissed by the Director of the Department of Information and Communications after consultation with the Chief Inspector of the province.

The Deputy Chief Inspector of the Department is appointed, relieved, or dismissed by the Director of the Department of Information and Communications based on the proposal of the Chief Inspector of the Department.

3. The Department Inspectorate is subject to the direction and management of the Director of the Department of Information and Communications; it is subject to the direction on inspection work and guidance on administrative inspection procedures from the Provincial Inspectorate, and on specialized inspection procedures in information and communications from the Ministry Inspectorate.

4. The establishment of the Department Inspectorate is decided by the Chairman of the People's Committee at the provincial level upon agreement between the Director of the Department of Information and Communications and the Chief Inspector of the province.

5. The Department Inspectorate has its own seal and separate account.

Article 14. Tasks and Powers of the Department Inspectorate

1. Drafting inspection plans for approval by the Director of the Department of Information and Communications; organizing the implementation of inspection plans within the responsibility of the Department Inspectorate.

2. Conducting administrative inspections against agencies, organizations, and individuals directly managed by the Department of Information and Communications.

3. Inspecting the implementation of laws on press; publishing; postal services; telecommunications; radio frequency; information technology, electronics; broadcasting and television; news agencies; foreign information; grassroots information and national information and communication infrastructure for agencies, organizations, and individuals within the local jurisdiction.

4. Guiding and inspecting subordinate agencies and units of the Department of Information and Communications in implementing legal regulations on inspection.

5. Assisting the Director of the Department of Information and Communications in resolving complaints and denunciations, and preventing corruption in accordance with the law; performing tasks related to complaint resolution, denunciation handling, and anti-corruption in accordance with the law on complaints and denunciations, and anti-corruption.

6. Monitoring, inspecting, and urging the implementation of conclusions, recommendations, and decisions on inspection made by the Director of the Department of Information and Communications and the Chief Inspector of the Department.

7. Organizing training in specialized inspection procedures in information and communications for Inspectors and civil servants involved in inspection work under the Department of Information and Communications.

8. Inspecting other cases as directed by the Chief Inspector of the Ministry or assigned by the Director of the Department of Information and Communications.

9. Summarizing and drawing lessons from inspection work within the scope of state management of the Department of Information and Communications; compiling results of specialized inspection work in information and communications and reporting them to the Ministry Inspectorate as prescribed.

Article 15. Duties and Authorities of the Inspector General of the Department

1. Leading, directing, and inspecting inspection work within the scope of management of the Department; leading the Department's Inspectorate to perform tasks and authorities as prescribed by the Inspection Law and other relevant laws.

3. Deciding on inspections when signs of law violations are detected and bearing responsibility before the Director of the Department of Information and Communications for such decisions.

7. Recommending state agencies and authorized individuals to amend, supplement, or issue regulations in accordance with management requirements; recommending suspension or revocation of regulations found to be contrary to national legal documents through inspection work.

8. Administering administrative penalties according to the law on handling administrative violations.

9. Inspecting the responsibilities of heads of agencies and units under the Department's management in implementing laws on inspections.

10. Reporting to the Director of the Department of Information and Communications, the Inspector General of the province, and the Inspector General of the Ministry on inspection work, complaint and denunciation resolution within their respective responsibilities.

11. Summoning civil servants and employees of related agencies and units to participate in inspection activities.

Chapter III

INSPECTORS, SPECIALIZED INSPECTORS, AND ASSOCIATE INSPECTORS OF INFORMATION AND COMMUNICATIONS

Article 16. Inspectors of Information and Communications

1. Inspectors of Information and Communications (hereinafter referred to as Inspectors) are civil servants of the Inspectorate of the Ministry of Information and Communications and the Inspectorate of the Department of Information and Communications appointed to the inspector rank to carry out administrative and specialized inspection tasks in the field of information and communications and perform other tasks assigned by the Inspector General of the Ministry and the Inspector General of the Department.

2. Inspectors of Information and Communications must meet the criteria stipulated in Clause 1, Article 32 of the Inspection Law, Articles 6, 7, and 8 of Decree No. 97/2011/ND-CP dated October 21, 2011 of the Government on Inspectors and Associate Inspectors, and specialized criteria as prescribed by the Minister of Information and Communications.

3. Inspectors of Information and Communications have duties and authorities as prescribed by the law on inspections, the law on Information and Communications, and related international treaties; compelling the cessation of administrative violations using professional measures as prescribed by law.

Article 17. Specialized Inspectors in Information and Communications

1. Specialized inspectors are civil servants within the establishment of the Bureau who are assigned to perform specialized inspection functions and are tasked by the Director of the Bureau with carrying out specialized inspection tasks within the scope of the Bureau's state management.

2. Specialized inspectors must meet the conditions and standards as stipulated in Article 12 of Decree No. 07/2012/ND-CP and specific regulations set forth by the Minister of Information and Communications.

3. Specialized inspectors have duties, powers, and responsibilities as prescribed in Article 54 of the Inspection Law, Article 31 of Decree No. 07/2012/ND-CP, and other relevant legal documents.

4. The uniform and identification card of specialized inspectors shall be regulated by the Minister of Information and Communications.

Article 18. Collaborators for Information and Communications Inspection

1. Collaborators for inspection are individuals summoned by the Inspector General of the Ministry or the Inspector General of the Department to join the inspection team.

2. Collaborators for inspection are civil servants or employees with good political qualities, moral integrity, sense of responsibility, honesty, fairness, objectivity, and appropriate professional qualifications in accordance with the requirements and tasks of inspection.

3. Collaborators for inspection have duties, powers, and responsibilities as prescribed in Articles 47 and 54 of the Inspection Law and other relevant legal documents.

4. Collaborators for inspection enjoy benefits and policies as stipulated in Article 25 of Decree No. 97/2011/ND-CP and other relevant legal documents.

Chapter IV

ACTIVITIES OF INFORMATION AND COMMUNICATIONS INSPECTION

Article 19. Forms of Inspection

1. Inspection activities are carried out in the form of planned inspections, regular inspections, and spot inspections.

2. Planned inspections are conducted according to approved plans.

3. Spot inspections are carried out when signs of violations of laws and regulations are detected, upon request for handling complaints and denunciations, or at the direction of the head of the competent administrative agency.

4. Regular inspections are conducted based on the functions and tasks assigned to the Bureau for performing specialized inspection functions.

Article 20. Administrative Inspection Activities

1. Inspect compliance with policies, laws, and assigned tasks of agencies, organizations, and individuals as specified in Clause 1 of Article 2 of this Decree.

2. Administrative inspection activities are implemented in accordance with the provisions from Article 43 to Article 50 of the Inspection Law and from Article 19 to Article 31 of Decree No. 86/2011/ND-CP dated September 22, 2011, guiding certain provisions of the Inspection Law.

Article 21. Specialized Inspection Activities in Information and Communications

1. Inspect and monitor compliance with policies, laws, procedures, norms, quality, standards, and technical specifications in the field of information and communications for agencies, organizations, and individuals as specified in Clause 2 of Article 2 of this Decree, including:

a) Regulations on the press (including print media, online newspapers, radio, television, news agencies);

b) Regulations on publishing (including publishing, printing, distribution);

c) Regulations on external information;

d) Regulations on advertising in the press (including print newspapers, magazines, online newspapers, radio, television), on the internet, and in publications; integrated advertising on postal, telecommunications, and information technology products and services;

đ) Regulations on postal services;

e) Regulations on telecommunications;

g) Regulations on radio frequency spectrum;

h) Regulations on electronic information;

i) Regulations on information technology and electronics (including the information technology industry, information technology applications, and cybersecurity);

k) Regulations on base information (propaganda, publicity);

l) Regulations on information and communication infrastructure;

m) Legal regulations on copyright for press products, encrypted radio and television programs, publications, stamps, and information and communication technology products and services; intellectual property rights for inventions and patents under the management of the Ministry of Information and Communications;

n) Regulations on public services within the scope of the Ministry of Information and Communications' state management;

o) Other legal regulations within the scope of the Ministry of Information and Communications' state management.

2. Specialized inspection activities are implemented in accordance with the provisions from Article 51 to Article 56 of the Inspection Law and from Article 14 to Article 28 of Decree No. 07/2012/ND-CP.

Article 22. Re-inspection

1. Re-inspection is the examination, evaluation, and handling of inspection conclusions when signs of violation of laws are discovered during the inspection process or in the inspection conclusion.

2. The Inspector General of the Ministry shall decide to re-inspect cases that have been assigned to implement specialized inspection functions by the Director of the Frequency Management Center, the Director of the Regional Radio Frequency Management Center; re-inspect cases concluded by the People's Committee of the province within the scope and authority of management of the Ministry of Information and Communications but found signs of violation of laws when assigned by the Minister of Information and Communications.

3. The conduct of re-inspection shall be carried out in accordance with the provisions from Article 48 to Article 52 of Decree No. 86/2011/NĐ-CP.

Article 23. Means and Technical Facilities

The Inspection of Posts and Telecommunications shall be provided with office space, technical facilities, means, equipment, and other necessary conditions to serve inspection work and administrative penalty enforcement.

Chapter V

IMPLEMENTING PROVISIONS

Article 24. Effective Date

This Decree takes effect from December 10, 2013, abolishing Decree No. 115/2006/NĐ-CP dated October 4, 2006 of the Government on the organization and operation of the Posts and Telecommunications Inspectorate and Information Technology.

Article 25. Responsibilities for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of the People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
