On Conditions for Incubating Poultry Eggs and Raising Aquatic Birds

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Animal Breeding Ordinance 2004 and the Veterinary Ordinance 2004;
Considering the proposal of the Minister of Agriculture and Rural Development,
DECISION:
Article 1. Objectives
1. To control the activities of incubating poultry eggs and raising aquatic birds in order to effectively prevent and control diseases, particularly avian influenza.
2. To encourage the development of poultry egg incubation and raising aquatic birds through farm and industrial methods to achieve sustainable growth and high economic efficiency.
Article 2. Scope of Application
1. This Decision stipulates the conditions for incubating poultry eggs using manual and industrial methods, and the conditions for raising aquatic birds (ducks, geese, swans) in farm and industrial settings, including seasonal ducks.
2. This Decision applies to organizations and individuals who are the owners of poultry egg incubation facilities and aquatic bird breeding facilities as specified in Clause 1 of this Article.
The owners of poultry egg incubation facilities and aquatic bird breeding facilities must comply with current laws on animal breeding, veterinary regulations, and the provisions of this Decision.
Article 3. Conditions for Incubating Poultry Eggs
Poultry egg incubation facilities must meet the following conditions:
1. If the poultry egg incubation facility does not fall under the category required to register business operations according to Decree No. 88/2006/ND-CP dated August 29, 2006 of the Government on Business Registration, the owner of the poultry egg incubation facility must report to the People's Committee of the commune about their business operation of incubating poultry eggs.
2. The location of the poultry egg incubation facility must be in accordance with local planning and outside urban areas, residential zones, and public places such as schools, hospitals, markets, offices, and other public areas.
3. Regarding veterinary hygiene:
a) Eggs brought for incubation must be produced from healthy parent flocks free from disease and vaccinated against avian influenza as prescribed;
b) There must be a place to dispose of dead chicks, defective eggs, eggshells, and other waste;
c) Regular disinfection and sterilization must be carried out;
d) Incubation equipment and transportation means for eggs and chicks must be disinfected and sterilized after each use;
đ) There must be a record book to track the entry of eggs for incubation and the sale of chicks;
e) Incubation activities must cease during periods when avian influenza is declared in the area.
Article 4. Conditions for Raising Aquatic Birds
1. For aquatic bird breeding facilities in farm and industrial settings:
a) The breeds of aquatic birds raised must be produced from egg incubation facilities that meet the conditions stipulated in Article 3 of this Decision;
b) If the aquatic bird breeding facility does not fall under the category required to register business operations according to Decree No. 88/2006/ND-CP dated August 29, 2006 of the Government on Business Registration, the owner of the aquatic bird breeding facility must report to the People's Committee of the commune about their business operation of raising aquatic birds;
c) The location of the breeding facility must be in accordance with local planning and outside urban areas, residential zones, and public places such as schools, hospitals, markets, offices, and other public areas;
d) Vaccination against avian influenza must be conducted regularly for the flock of aquatic birds as prescribed and there must be a record book to track vaccination;
đ) Regular disinfection and sterilization of the breeding facility must be carried out;
e) When signs of illness are detected in the aquatic birds, the breeder must immediately report to the authorities or veterinary officers; diseased aquatic birds may not be sold; dead aquatic birds must be destroyed in accordance with regulations;
g) During outbreaks, breeders must implement preventive and control measures as prescribed by law on veterinary matters; new breeding or restocking can only occur after the competent state authority has announced the end of the outbreak in the area.
2. For raising ducks in communal areas:
a) The owner of the duck breeding facility must report to the People's Committee of the commune about the breeding activity and the communal area where the ducks are raised to obtain a tracking record book;
b) The breeds of aquatic birds raised must be produced from egg incubation facilities that meet the conditions stipulated in Article 3 of this Decision;
c) The flock of ducks must be vaccinated regularly as prescribed;
d) The movement of the flock of ducks within the reported communal area must be in accordance with the provisions at point a of Clause 2 of this Article;
đ) When signs of illness are detected in the flock of ducks, the breeder must immediately report to the authorities or veterinary officers; diseased aquatic birds may not be sold; dead aquatic birds must be destroyed in accordance with regulations;
e) During outbreaks, breeders must implement preventive and control measures as prescribed by law on veterinary matters; new breeding or restocking can only occur after the competent state authority has announced the end of the outbreak in the area.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The People's Committee of the province or centrally governed city shall be responsible for:
a) Organize inspections of compliance with the provisions of this Decision in the locality;
b) Develop and approve plans for poultry egg incubation facilities and farm and industrial aquatic bird breeding facilities;
c) Implement preventive and control measures for avian influenza as prescribed by law on veterinary matters;
d) Direct relevant authorities to handle violations of the provisions of this Decision according to Decree No. 47/2005/ND-CP dated April 8, 2005 of the Government on Administrative Penalties in the Field of Animal Breeding and Decree No. 129/2005/ND-CP dated October 17, 2005 of the Government on Administrative Penalties in the Field of Veterinary Matters;
đ) Organize propaganda and mobilize households and individuals to limit and eventually eliminate small-scale and scattered aquatic bird breeding.
2. The Ministry of Agriculture and Rural Development shall be responsible for:
a) Specify specific scales for poultry egg incubation facilities and aquatic bird breeding facilities and provide guidance on technical conditions for incubating poultry eggs and raising aquatic birds as prescribed by this Decision;
b) Coordinate with the People's Committees of provinces and centrally governed cities to inspect compliance with conditions for incubating poultry eggs and raising aquatic birds, and the planning for constructing poultry egg incubation and farm and industrial aquatic bird breeding facilities.
Article 6. Effectiveness
1. This Decision takes effect from the date of signature.
2. The Minister of Agriculture and Rural Development and the Chairmen of the People's Committees of provinces and centrally governed cities are responsible for organizing the implementation of this Decision./.
