Regarding the establishment of the Management Board of the
Village of Culture and Tourism of Ethnic Groups in Vietnam
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
To implement Decision No. 667/TTg dated August 21, 1997 of the Prime Minister on the overall planning and construction and management of the Village of Culture and Tourism of Ethnic Groups in Vietnam;
At the proposal of the Minister of Culture and Information and the Minister, Head of the Government Organizational and Cadre Affairs Department,
DECISION:
Article 1. The Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam under the Ministry of Culture and Information is hereby established to perform the functions of investment construction management and organizing and managing activities of the Village of Culture and Tourism of Ethnic Groups in Vietnam in accordance with the approved overall planning.
The Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall have legal personality, its own seal, and be entitled to open accounts at the State Treasury and banks in accordance with the provisions of the law. Initially, the headquarters of the Board will be located in Hanoi City.
Article 2. The Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall have the main tasks and powers as follows:
1. Based on the overall planning of the Village of Culture and Tourism of Ethnic Groups in Vietnam approved by the Prime Minister, prepare detailed planning for functional zones and component projects for approval by the Minister of Culture and Information or submission to competent authorities for approval; manage the planning and projects that have been approved;
2. Prepare long-term and short-term plans on investment development and activities of the Village of Culture and Tourism of Ethnic Groups in Vietnam for decision by the Minister of Culture and Information or submission to competent authorities for consideration and decision. Implement tasks assigned by the Minister of Culture and Information regarding investment and construction, organizing cultural activities, and managing service activities within the Village of Culture and Tourism of Ethnic Groups in Vietnam effectively. Specifically, the basic construction investment plan shall be implemented in accordance with current regulations;
3. Mobilize and attract domestic and foreign investment capital through appropriate forms in accordance with the law;
4. Guide, accept, organize the review, and submit to competent state agencies for approval or issuance of permits for investment projects in accordance with the law. Monitor and inspect the implementation of investment projects after they have been approved or issued investment permits;
5. Take the lead and coordinate with relevant agencies in the management and use of land, clearance of land for the construction of the Village of Culture and Tourism of Ethnic Groups in Vietnam;
6. Take the lead and coordinate with relevant agencies to propose research requirements (ethnology, cultural studies, sociology), collection, editing, dissemination, and promotion of cultural values serving the construction, operation, and management of the Village of Culture and Tourism of Ethnic Groups in Vietnam;
7. Develop management and exploitation regulations for investment projects and service activities, introduce, guide tourists visiting the Village of Culture and Tourism of Ethnic Groups in Vietnam for approval by the Ministry of Culture and Information; disseminate, guide, and inspect the implementation of these regulations;
8. Take the lead and coordinate with relevant agencies to organize training and professional development for cadres, civil servants, and workers working in the Village of Culture and Tourism of Ethnic Groups in Vietnam;
9. Take the lead and coordinate with relevant state agencies, local people's committees, and investors to ensure security and public order during the construction, management, and exploitation of the Village of Culture and Tourism of Ethnic Groups in Vietnam;
10. Be permitted to cooperate with foreign organizations and individuals in areas related to the construction and management of the Village of Culture and Tourism of Ethnic Groups in Vietnam according to the assignment of the Minister of Culture and Information and the provisions of the law.
Article 3. The Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall have a Director and several Deputy Directors. The Director and Deputy Directors shall be appointed by the Minister of Culture and Information.
The specific organizational structure, subordinate units, and operational regulations of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall be decided by the Minister of Culture and Information after obtaining the agreement of the Minister, Head of the Government Organizational and Cadre Affairs Department.
Article 4. The operating funds of the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam shall be provided from the state budget. The Board is allowed to collect and use certain fees and charges on the premises in accordance with the law.
The Ministry of Culture and Information shall take the lead and coordinate with the Ministry of Finance to develop financial regulations applicable to the Management Board of the Village of Culture and Tourism of Ethnic Groups in Vietnam.
Article 5. This Decision shall take effect fifteen days from the date of issuance.
Repeal Point 7 of Article 1 of Decision No. 667/TTg dated August 21, 1997 of the Prime Minister approving the overall planning of the Village of Culture and Tourism of Ethnic Groups in Vietnam.
Article 6The Minister of Culture and Information, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, and chairpersons of provincial and centrally-administered city people's committees related to this matter are responsible for implementing this Decision.
