Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 2016/QD-BTC dated August 21, 2009 of the Minister of Finance stipulating the functions, tasks, powers, and organizational structure of the Department of Information Technology and Financial Statistics;

Considering the proposal of the Director of the Department of Information Technology and Financial Statistics, the Head of the Cadre and Civil Servant Affairs Department,

DECISION:

Article 1. Issued herewith is the Regulation on the Organization and Operation of the Data Center and Financial Information Technology Deployment under the Department of Information Technology and Financial Statistics in Ho Chi Minh City.

Article 2. This Decision takes effect from the date of signature. The Director of the Department of Information Technology and Financial Statistics, the Head of the Cadre and Civil Servant Affairs Department, the Director of the Ministry of Finance’s Office, and the Heads of units under the Ministry of Finance shall be responsible for implementing this Decision.

PART I
POSITION, FUNCTIONS AND TASKS, POWERS

Article 1. Position, Functions

1. The Data Center and Financial Information Technology Deployment in Ho Chi Minh City is a subordinate public service unit of the Department of Information Technology and Financial Statistics, tasked with building, managing, and operating the national financial database backup system and financial communication infrastructure in Ho Chi Minh City; implementing information technology application work in southern provinces according to the assignment of the Director of the Department of Information Technology and Financial Statistics; organizing the provision of training, transfer, and technical support services for computer applications for units in need in accordance with the law.

2. The Data Center and Financial Information Technology Deployment in Ho Chi Minh City has legal personality, its own seal, and is allowed to open accounts at the State Treasury and banks in accordance with the law.

Article 2. Task

1. Building, managing, and operating the national financial database backup system in Ho Chi Minh City.

2. Organizing the management and operation of the southern center of the financial sector communication infrastructure system; supporting the operation of financial communication centers in southern provinces.

3. Installing, maintaining, and providing technical support for equipment and computer applications for financial sector units in southern provinces according to the assignment of the Director of the Department of Information Technology and Financial Statistics.

4. Installing, operating, maintaining, and repairing computer equipment and networks for units of the Ministry of Finance at the Ministry of Finance's Representative Office in Ho Chi Minh City.

5. Implementing backup for the national financial database.

6. Providing value-added services of the financial sector database system; providing consulting, training, transfer, and technical support services, maintenance of equipment and computer applications for organizations and individuals in need in accordance with the law.

7. Organizing scientific research, cooperating with domestic and foreign units; testing modern technologies related to data storage, information technology application, and communication serving the management needs of the financial sector according to plans and contents approved by competent authorities.

9. Implementing information and reporting systems in accordance with the law, the Ministry of Finance, and the guidance of the Department of Information Technology and Financial Statistics.

11. Serving as the focal point to assist the Director of the Department of Information Technology and Financial Statistics in implementing the program of work of the Department in southern provinces.

12. Performing other tasks consistent with the functions of the Center and as assigned by the Director of the Department of Information Technology and Financial Statistics.

Article 3. Powers

1. Entitled to conclude economic contracts and service provision contracts with organizations and individuals in need in accordance with the law.

2. Collecting service fees in accordance with the law.

3. Authorized to use the public service staff quota allocated by the Minister of Finance, to arrange and manage labor in accordance with the functions, tasks, and activities of the unit. Entitled to implement the labor contract system in accordance with the Labor Code and consistent with the workload and financial capacity of the unit.

4. Entitled to implement wage, remuneration, social insurance, health insurance, training, and professional skill enhancement systems for employees in accordance with the law.

Chapter II
ORGANIZATIONAL STRUCTURE

Article 4. Organizational Structure

The Data Center and Financial Information Technology Deployment in Ho Chi Minh City has the following departments:

1. Application Deployment and Database Department.

2. System Management Department.

3. Planning and Finance Department.

Specific tasks of each department are stipulated by the Director of the Department of Information Technology and Financial Statistics.

The public service staff quota of the Data Center and Financial Information Technology Deployment in Ho Chi Minh City is decided by the Minister of Finance.

Article 5. Leadership of the Center

1. The Data Center and Financial Information Technology Deployment in Ho Chi Minh City has a Director and several Deputy Directors.

The Director of the Data Center and Financial Information Technology Deployment in Ho Chi Minh City is responsible before the Director of the Department of Information Technology and Financial Statistics and the law for all activities of the Center. The Deputy Directors are responsible before the Director and the law for the tasks they are assigned to manage.

2. The appointment, dismissal, and removal of the Director, Deputy Directors, and other leadership positions of the Data Center and Financial Information Technology Deployment in Ho Chi Minh City shall be carried out in accordance with the law and the cadre management delegation of the Ministry of Finance.

Chapter III
FINANCIAL MANAGEMENT

Article 6. Financial Mechanism

The Financial Information Technology Data Center in Ho Chi Minh City shall operate under the self-governance mechanism and be financially responsible as prescribed for revenue-generating public service units by current laws and regulations of the Ministry of Finance.

Article 7. Financial Mechanism Compliance

The Financial Information Technology Data Center in Ho Chi Minh City is responsible for preparing, implementing the budget, adhering to accounting procedures, managing and utilizing assigned financial resources, assets, and infrastructure in accordance with applicable laws and regulations./.
