DECREE
Special Preferential Import Tariff Schedule of Vietnam
to implement the Comprehensive Economic Partnership Agreement
between the Government of the Socialist Republic of Vietnam and
the Government of the United Arab Emirates for the period 2026-2027
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Export Tax and Import Tax No. 107/2016/QH13 amended and supplemented by Law No. 90/2025/QH15;
Pursuant to the Law on Customs No. 54/2014/QH13 amended and supplemented by Law No. 90/2025/QH15;
Pursuant to the Law on International Treaties No. 108/2016/QH13 amended and supplemented by Law No. 137/2025/QH15;
Pursuant to the Law on Tax Administration No. 38/2019/QH14 amended and supplemented by Law No. 56/2024/QH15;
To implement the Comprehensive Economic Partnership Agreement between the Government of the Socialist Republic of Vietnam and the Government of the United Arab Emirates which took effect from February 3, 2026;
At the proposal of the Minister of Finance;
The Government promulgates this Decree on the Special Preferential Import Tariff Schedule of Vietnam to implement the Comprehensive Economic Partnership Agreement between the Government of the Socialist Republic of Vietnam and the Government of the United Arab Emirates for the period 2026-2027.
Article 1. Scope of Regulation
This Decree promulgates the Special Preferential Import Tariff Schedule of Vietnam to implement the Comprehensive Economic Partnership Agreement between the Government of the Socialist Republic of Vietnam and the Government of the United Arab Emirates (hereinafter referred to as the CEPA Agreement) for the period 2026-2027 and the conditions for enjoying the special preferential import tariff rates under this Agreement.
Article 2. Applicability
Clause 1. Taxpayers as prescribed by the Law on Export Tax and Import Tax.
Clause 2. Customs authorities and customs officers.
Clause 3. Organizations and individuals with rights and obligations related to exported and imported goods.
Article 3. Special Preferential Import Tariff Schedule
Clause 1. This Decree promulgates the Special Preferential Import Tariff Schedule of Vietnam to implement the CEPA Agreement for the period 2026-2027 (the special preferential import tariff rate of Vietnam under the CEPA Agreement hereinafter referred to as the CEPA rate).
Clause 2. The "Commodity Code" column and the "Goods Description" column in the Special Preferential Import Tariff Schedule promulgated by this Decree are based on the List of Exported and Imported Goods of Vietnam and detailed according to the 8-digit code level.
In case the List of Exported and Imported Goods of Vietnam is amended and supplemented, the declarant shall declare the description and commodity code according to the amended and supplemented List of Exported and Imported Goods and apply the tariff rate of the amended and supplemented commodity code as prescribed in the Special Preferential Import Tariff Schedule promulgated by this Decree.
Clause 3. The "CEPA Rate (%)” column in the Special Preferential Import Tariff Schedule: Rates applicable for different periods include:
Point a) 2026: Rates applicable from February 3, 2026 to December 31, 2026;
Point b) 2027: Rates applicable from January 1, 2027 to December 31, 2027.
Clause 4. Symbol “*”: Imported goods not entitled to the CEPA rate at the corresponding time.
Article 4. Conditions for Applying the CEPA Tariff Rate
Imported goods subject to the CEPA tariff rate must meet the following conditions:
1. They belong to the Special Preferential Import Tariff List issued together with this Decree.
2. They are imported from the United Arab Emirates into Vietnam.
3. They comply with the origin requirements and have certificates of origin in accordance with the CEPA Agreement and current laws.
Article 5. Goods from Vietnam's Duty-Free Zones
Goods from Vietnam's duty-free zones imported into the domestic market and subject to the CEPA tariff rate must meet the conditions stipulated in Clause 1 and Clause 3 of Article 4 of this Decree.
Article 6. Effective Date
1. This Decree takes effect from the date of issuance until December 31, 2027.
2. For customs declarations of goods imported into Vietnam from the United Arab Emirates registered from February 3, 2026, up to the effective date of this Decree, if they meet the conditions for enjoying special preferential import tariffs as prescribed in this Decree and have already paid taxes at a higher rate, the customs authority shall handle the excess tax paid in accordance with the law on tax administration.
Article 7. Responsibility for Implementation
Ministers, heads of ministerial-level agencies, Chairpersons of provincial and centrally-administered city People's Committees, and related organizations and individuals are responsible for implementing this Decree.
