THE MINISTER OF PUBLIC SECURITY

Pursuant to the Law on Road Traffic dated June 29, 2001;

Pursuant to Decree No. 136/2003/NĐ-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Considering the proposal of the Director General of the Police Corps,

DECISION:

Article 1. Amending and supplementing certain provisions of the Procedure for Registration, Issuance of License Plates, and Management of Motor Vehicles on Roadways issued together with Decision No. 1370/2007/QĐ-BCA(C11) dated November 7, 2007 of the Ministry of Public Security as follows:

1. Article 5 of Chapter II shall be amended and supplemented as follows:

"Article 5. Procedures for Vehicle Registration

When conducting vehicle registration, officers must follow the procedures below:

1. Guide the vehicle owner to fill out the vehicle registration application form according to the prescribed model.

2. Inspect the actual vehicle: directly compare the contents in the vehicle registration application form with the actual vehicle regarding brand, type, engine number, frame number, paint color, seating capacity, load capacity, and other technical specifications of the vehicle; stamp over the engine and frame numbers and clearly record their name, date, month, and year of inspection. For police motor vehicles, in addition to following the aforementioned procedures, a technical safety inspection of the vehicle must also be conducted.

3. Inspect the file and issue license plates.

a) Accept the vehicle file: compare and inspect the owner's documents; valid vehicle documents (transfer certificates, tax receipts, and origin certificates) according to regulations. Assign a serial number and summarize key information (vehicle registration application form, origin certificate) on the file cover:

b) Enter the owner's name and address, vehicle characteristics into the computer such as brand, model number, engine number, frame number, paint color... (for financial leasing companies registering at the lessee's address, enter the lessee's address according to the request letter): clearly record the date, month, and year when the file was handed over to the owner in the note section of the computer;

c) Guide the owner to select a random license plate number from the computer and record it on the vehicle registration application form according to regulations;

d) Print the appointment notice according to the model.

4. Collect registration fees as stipulated by the Ministry of Finance.

5. Issue license plates.

6. Guide the owner to mark the license plate number, load capacity, gross weight, and owner's name on the vehicle, as required for all types of cars except those with nine seats or fewer.

7. Print the Vehicle Registration Certificate.

For police motor vehicles, if they meet the technical safety requirements, print the Certificate of Technical Inspection and Environmental Protection for Motor Vehicles on Roadways.

8. Review the file and report to the Head of the Department of Registration and Management of Motor Vehicles on Roadways for inspection and submission to the Director of the Highway and Railway Traffic Police Corps (at the Ministry); to the Head of the Vehicle Registration Team for inspection and submission to the Head of the Traffic Police Department; to the Head of the Vehicle Registration Work Team for inspection and submission to the Head of the Public Security Bureau at the county level (at the local level) for signing the vehicle registration documents according to regulations.

9. Laminate the Vehicle Registration Certificate and the Certificate of Technical Inspection and Environmental Protection for Motor Vehicles on Roadways (for police vehicles).

10. Stamp the title on the vehicle file: classify the vehicle file into parts to be retained and parts to be returned to the vehicle owner before stamping the title on the file:

a) Stamp the title "VEHICLE REGISTERED ON DAY... MONTH... YEAR..." and record the license plate number on the right corner of the vehicle registration application form and the origin certificate;

b) Stamp the title "OWNER'S FILE TO BE SELF-MANAGED" in the middle of each page of the documents handed over to the owner according to Clause 1.3, Section 4 of Circular No. 12/2008/TT-BCA-C11 dated August 20, 2008 of the Ministry of Public Security.

11. Collect the appointment notice and return the file and vehicle registration certificate.

a) Guide the owner or authorized person to check the file returned by the registration authority; the owner must clearly record the number of pages received and sign their full name in the note section of the summary of documents on the vehicle registration application form, then return the Vehicle Registration Certificate and part of the file according to Clause 1.3, Section 4 of Circular No. 12/2008/TT-BCA-C11 dated August 20, 2008 of the Ministry of Public Security;

b) Hand over the vehicle registration file to the officer responsible for managing the files, including: origin documents; vehicle registration certificate according to Point 1.2.1, Section 4 of Circular No. 12/2008/TT-BCA-C11 dated August 20, 2008 of the Ministry of Public Security.

12. At the end of the working day, report the results of vehicle registration and the results of license plate numbers won through auction and randomly selected from the computer according to regulations."

2. Article 6 of Chapter II shall be amended and supplemented as follows:

"Article 6. Transfer registration within the province or centrally administered city

1. Acceptance of transfer registration file.

2. Write out withdrawal slip for original registration file.

3. Perform Clause 1, Clause 2; Point a, b, d Clause 3; Clauses 4, 7, 8, 9; Point b Clause 10 and Clause 11 Article 5 of this Decision. Cut off the top right corner of the front side of the Registration Certificate.

In case of motorcycles or motor vehicles transferring to another district, the file must include a transfer movement form, along with the original file.

In cases where the vehicle needs to change to a different type of license plate according to regulations, Points c Clause 3 and Clause 5 Article 5 of this Decision must also be implemented.

3. Article 9 Chapter II shall be amended and supplemented as follows:

"Article 9. Change, reissue registration certificates, license plates or modified vehicles, repainted vehicles

1. Acceptance of application for registration; official letter (for organizations) or personal declaration (except when the vehicle owner requests to retrieve the previously submitted registration file before Circular No. 12/2008/TT-BCA-C11 dated August 20, 2008 of the Ministry of Public Security took effect).

2. Inspection of the actual vehicle (modified vehicle, repainted vehicle).

3. Write out withdrawal slip, check the vehicle file according to regulations.

4. Supplement the content of change, reissue registration certificate, license plate into the computer system.

5. Implement the provisions at Point b, d Clause 3; Clauses 4, 5, 7, 8, 9; Point b Clause 10 and Clause 11 Article 5 of this Decision.

6. Stamp on the top right corner of the application for registration; in case of change, reissue of the Registration Certificate, stamp additionally "Reissued for the nth time" on the front side, above the line of the Registration Certificate.

7. If the vehicle file serves as registration evidence for a complete engine or frame to replace another vehicle, then the entire vehicle file will be used as evidence for that component (including both registered and unregistered vehicle files).

4. Article 16 Chapter III shall be amended and supplemented as follows:

"Article 16. Numbering of Engine Numbers and Frame Numbers

1. Objects for numbering of engine numbers and frame numbers:

a) Imported vehicles without engine numbers or frame numbers; if the customs declaration does not have these numbers or cannot find them, they can be numbered according to the license plate number.

In cases where imported vehicles (already registered or not yet registered) have Etiket numbers, numbers painted on, blurred numbers, or rusted numbers, they can be renumbered according to the numbers confirmed by the customs authority in the Vehicle Import Origin Declaration.

In cases where imported vehicles have engines covered by equipment making it impossible to number the engine, or vehicles without frame numbers but only have VIN numbers on the front windshield recognized by customs, there is no need to renumber the engine or frame numbers; instead, use the VIN number as the engine and frame numbers and take photos of the VIN number to keep in the file.

b) Domestic production and assembly vehicles:

Vehicles with engine numbers or frame numbers stamped with pins (lade) or numbers that are blurred and unclear can be renumbered according to the numbers recorded in the quality inspection certificate.

Vehicles with overlapping engine numbers or frame numbers must undergo appraisal. If the appraisal agency concludes that the engine and frame numbers are original, they can be renumbered according to the numbers recorded in the quality inspection certificate.

c) In cases where a registered vehicle has been replaced with a new engine or engine block without an engine number, the number should be assigned according to the license plate number.

d) Vehicles with confiscation decisions, disposal decisions, or investigative conclusions stating that the engine and frame numbers have been tampered with or cannot be determined, can be renumbered according to the license plate number.

2. Write out a proposal for numbering engine numbers and frame numbers to be reviewed by the Director of the Highway Traffic Police Department (at the Ministry), the Head of the Traffic Police Department, and the County Chief of Public Security (at the local level).

3. Carry out numbering of engine numbers and frame numbers.

Article 2. 4. Enter the newly numbered engine and frame numbers into the application for registration and the Proposal for Numbering Engine Numbers and Frame Numbers.

This Decision shall take effect thirty days from the date of signature.

The Director of the General Administration of Police is responsible for guiding, directing, and supervising the implementation of this Decision.
