THE MINISTER OF FINANCE
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;
Pursuant to Decree No. 178/CP dated October 28, 1994 of the Government stipulating the tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 25/CP dated April 5, 1995 of the Government on the tasks, powers, and organizational structure of the State Treasury under the Ministry of Finance;
Pursuant to Decree No. 145/1999/NĐ-CP dated September 20, 1999 of the Government on the restructuring of the General Department of Investment Development;
Considering the proposal of the Director-General of the State Treasury, the Head of the Organization and Cadre Training Department,
DECISION:
Article 1: The State Treasury shall perform the task of controlling payments, accounting, and finalizing capital investment funds, operational funds with investment characteristics, and construction from state budget sources at all levels as prescribed in Decree No. 145/1999/NĐ-CP dated September 20, 1999 of the Government on the restructuring of the General Department of Investment Development.
Article 2: State Treasuries at all levels shall use the existing machinery and establish the following organizations to carry out the tasks specified in Article 1:
1. Establish the Capital Investment Payment Department under the Central State Treasury to undertake the following tasks:
- Researching and drafting control payment and capital investment finalization systems, operational funds with investment characteristics, and construction from state budget sources at all levels.
- Directing and inspecting the unified implementation of control payment and capital investment finalization tasks, operational funds with investment characteristics, and construction from state budget sources at all levels within the State Treasury system.
- Transferring capital investment, operational funds with investment characteristics, and construction according to approved plans and schedules to provincial State Treasuries (referred to as Provincial State Treasuries) for payment; implementing timely reporting on the progress of national capital investment payments according to established regulations.
2. Establish the Inter-Provincial Capital Investment Payment Office under the Central State Treasury to undertake the task of controlling payments for inter-provincial projects and other important projects as decided by the Minister of Finance.
The Inter-Provincial Capital Investment Payment Office has legal personality, can open accounts at State Treasuries, and has the right to use the seal of the Central State Treasury in payment transactions and is responsible before the state and the law.
The Head of the Inter-Provincial Capital Investment Payment Office shall be concurrently held by a Deputy Director of the Capital Investment Payment Department.
The Director-General of the State Treasury shall specify in detail the tasks, powers, and staffing of the Inter-Provincial Capital Investment Payment Office.
3. Establish the Capital Investment Payment Office under the Provincial State Treasury to guide and organize the implementation of control payment and capital investment finalization tasks, operational funds with investment characteristics, and construction from state budget sources at all levels within its jurisdiction as assigned by the competent authority.
For Provincial State Treasuries with large volumes of capital investment and operational funds with investment characteristics and construction payments, additional Capital Investment Payment Offices for central and local budgets may be established; the establishment of additional Capital Investment Payment Offices in necessary provinces and cities shall be decided by the Minister of Finance upon the recommendation of the Director-General of the State Treasury.
4. At district, county, town, and city-level State Treasuries (collectively referred to as County-level State Treasuries), the implementation of control payment and capital investment finalization tasks, operational funds with investment characteristics, and construction from state budget sources at the County-level State Treasuries shall be carried out by the Planning and Consolidation Section of the County-level State Treasury.
For County-level State Treasuries with large volumes of capital investment and operational funds with investment characteristics and construction payments, the Director-General of the State Treasury may organize a capital investment payment section or a Capital Investment Payment Office under the County-level State Treasury to undertake these tasks.
5. In places where Regional Investment Development Bureaus directly under the Investment Development Department currently exist, a Regional Capital Investment Payment Office directly under the Provincial State Treasury shall be established temporarily to continue performing all control payment tasks of the transferred Regional Investment Development Bureau.
The Regional Capital Investment Payment Office has legal personality, a separate seal, and can open an account at a State Treasury.
Article 3: This Decision takes effect from January 1, 2000. The Director-General of the State Treasury, Directors of State Treasuries at all levels in localities, Heads of units under and directly under the Ministry of Finance, and the Director of the Ministry of Finance's Office are responsible for implementing this Decision.
